HomeMy WebLinkAbout1950-09-13 432 Bozeman, Montana September 13, 1950 The Commission of The City of Bozeman met in regular session in the Commission Room, Ci~ Hall Building, Wednesday afternoon, September 13, 1950 at 1:00 o'clock f. M. Those being present were Mayor Lowe, Commissioner Secor, Commissioner Healy, City Manager Henderson, City Attorney Lovelace and the Clerk when the following proceedings were had: The minutes of the last regular session were read, and it was moved by Commissioner Healy, seconded by Commissioner Secor, that the minutes be approved as read, and the motion was carried by the following Aye and No vote: those voting Aye being Mayor Lowe, Commissioner Secor and Commissioner Healy; those voting No, none. Release of Bond - City Manager It was reported the Great American Indemnity Company has requested release on the band of M. E. Henderson, as City Manager. a new bond for Mr. Henderson having been furnished by another bonding company. It was moved by Commissioner Healy, seconded by Commissioner Secor, that the mayor be authorized to sign a letter releasing the Great American Indemnity Company bond effective August 15th, 1950, and the motion was carried by the following Aye and No vote: those voting Aye being Mayor Lowe, Commissioner Secor and Commissioner Healy; those voting No, none. Resolution No. 683 -- Sprinkling Assessment The Manager stated that the resolution levying the assessment for the cost of sprinkling streets in the amount of $1,196.18 for 1960 has been prepared. He presented Resolution No. 683, entitled: A RESOLUTION OF mE COMMISSION OF THE CITY OF BOZEMAN LEVYING AND ASSESSING A SPECIAL ASSESSMENT OF TAXES Ul'ON ALL TIlE PROFERTY IN STREET SPRINKLING DISTRICTS OF THE CITY OF BOZEMAN, COUNTY OF GALLATIN, STATE OF MONTANA, TO DEFRAY SEVENTY-FIVE FERCENT OF' THE COST OF SPRINKLING STREETS WITHIN SAID STREET SPRINKLING DISTRICTS OF THE CITY OF BOZEMAN FOR THE YEAR 1950. It was moved by Commissioner Healy, seconded by Commissioner Seoor, that the resolution be provi- sionally passed and September 20th~ 1960 be set as the date for the hearing of protests, and the motion was carried by the following Aye and No vote: those voting Aye being Mayor Lowe, Commissioner Secor and Commissioner HealYJ those voting No, none. Resolution No. 684 -- Parking Maintenanoe The Manager stated that the resolution levying the assessment in the amount of $4,461.55 for the oare of parking for the year 1960, has been prepared. He presented Resolution No. 684, entitled: A RESOLUTION OF THE COMMISSION OF THE CITY OF BOZEMAN, LEVYING AND ASSESSING A Sl'EClAL ASSESSMENT OF' TAXES UPON ALL THE FROPERTY IN SPECIAL IMPROVEMENT DISTRICTS OF THE CITY OF BOZEMAN, COUNTY OF' GALLATIN, STATE OF MONTANA, FOR THE MAINTENANCE OF FARKINGS TO DEFRAY THE COST OF MAINTAINING THE FARKINGS WITHIN SAID SFECIAL IMFROVEMENT DISTRICTS OF THE CITY OF BOZEMAN FOR THE YEAR 1950. It was moved by Commissioner Secor, seoonded by Commissioner Healy, that the resolution be provi- sionally passed and September 20th, 1950 be set as the date for the hearing of protests, and the motion was oarried by the following Aye and No vote: those voting Aye being Mayor Lowe, Commies ioner Secor and Commissioner Healy; those voting No, none. Resolution No. 686 -- Lighting Maintenanoe The Manager stated the resolution levying the assessment in the amount of $2,042.49 for the cost of the various lighting distriots for the year 1950 has been prepared. He presented Resolution No. 685, enti tled: A RESOLUTION OF THE COMMISSION OF THE CITY OF BOZEMAN~ MONTANA, LEVYING AND ASSESSING LIGHTING DISTRICT MAINTENANCE AND ELECTRICAL CURRENT COSTS FOR SFECIAL IMFROVEMENT LIGHTING DISTRICTS NUMBERS 361, 284~ 288, 289, 290, 295 AND 300 OF THE CITY OF BOZEMAN, PURSUANT TO THE PROVISIONS OF SECTIONS 5266 R.C.M., 1935. It was moved by Commissioner Healy, seconded by Commissioner Secor, that the Resolution be provi- sionally passed and September 20th, 1950 be set as the date for hearing protests, and the motion was carried by the following Aye and No vote: those voting Aye being Mayor Lowe, Commissioner Secor end Commissioner Healy; those voting No, none. 1 I 1 1 I 1 433 Sale of S. I. D. 359 Bond. The Manager stated that in order to pay the contraotor for the construction of S. I. D. No. 359, it will be necessary to sell bonds of this district in the approximate of Eighteen hundred Dollars. It was thereupon moved by Commissioner Secor, seconded by Commissioner Healy, that the Clerk of the Commission be authorized to advertise for the sale of S. I. D. No. 359 bonds, and the motion was carried by the following Aye and No vote: those voting Aye being Mayor Lowe, Commissioner Secor and Commissioner Healy; those voting No, none. Manager to Attend Meetings The Manager reported the Mayor's Association and the Executive Conuni ttee of the Montana Munioipal League will meet in Great Falls, September 15th and 16th, and the Executive Committee. Montana Section of the American Water Works Association will meet in Helena, September 23rd, and requested permission to attend these meetings. It was moved by Commissioner Secor, seconded by Commissioner Healy, that it being in the publio interest, the City Manager be authorized to attend these meetings and his expenses be paid from the General F'und for the Great F'alls meeting and the Water Fund for the Helena meeting, and the motion was carried by the following Aye and No voter those voting Aye being Mayor Lowe, Conunissioner Secor and Commissioner Healy; those voting No, none. Reports The following reports for the month of August, 1950 were presented: Plumbing Inspeotor Cemetery Board Director of Finance Building Inspector Engineer It was moved by Commissioner Healy, seconded by Commiss ioner Secor, that the reports be accerted and ordered filed and the motion was carried by the following Aye and No voter those voting Aye being Mayor Lowe, Commissioner Secor and Commissioner Healy; those voting No, none. Continuation Certificate for Gas & Plumbing Bond -- McCay Hardware The continuation certificate of the McCay Hardware for a gas fitter's bond in the amount of $2,000.00 and plumbing bond in the amount of .500.00 were presented. The certificates were approved as to form by the City Attorney whereupon, it WaS moved by Commissioner Healy, seconded by Commissioner Secor, that the certificates be accepted and approved and the motion was carried by the following Aye and No vote: those voting Aye being Mayor Lowe, Commissioner Secor and Commissioner Healy; those voting No, none. Fluorine in Water Supply The Manager reported to the City Commission on information received to date on the installation of equipment necessary to add fluorine to the City water supply. Gas Conversion for City Hall The Manager stated that he has made repeated effort to secure quotations from Bozeman dealers on installation of a gas conversion burner in the heating plant of the City Hall but, up to date, he has received only one quotation. He stated that an estimated cost of such an installation would be more than Five hundred Dollars but less than One thousand Dollars. It was pointed out that, if such an installation is to be made, it must be done in the very near future before winter sets in. It was moved by Commissioner Healy, seconded qy Commissioner Secor, that the Manager be instructed to attempt to secure further quotations and that, conditioned on the oost being less than One thousand Dollars, he be authorized to accept the lowest quotation received and prooeed to have the gas conversion installa- tion made and the motion was carried by the following Aye and No vote: those voting Aye being Mayor Lowe, Commissioner Secor and Commissioner Healy; those voting No, none. Fetition for S. I. D. A petition of owners of property on West Beall Street requesting that a Speoial Improvement District 434 be created for the purpose of installing a six-inoh water main on Beall Street between Third Avenue and Fifth Avenue was presented. The City Commission looking with favor upon the creation of this district, and the City Attorney having prepared the resolution of intention to create the district, Resolution No. 686 was presented entitled; A RESOLUTION OF THE CITY COMMISSION OF' THE CITY OF BOZEMAN, MONTANA, DECLARING IT TO BE THE INTENTION OF SAID COMMISSION 'ill CREATE A SFECIAL IMPROVEMENT DISTRICT OF SAID CITY TO BE KNOWN AND DESIGNATED AS "SPECIAL IMFROVEMENT DISTRICT NUMBER 363- FOR THE PURPOSE OF CONSTRUCT.. ING AND INSTALLING A SIX INCH WATER MAIN ON WEST BEALL STREET BETWEEN NORTH TEmD' AVENUE AND NORTH FIFTH AVENUE IN THE CITY OF BOZEMAN, MONTANA, AND TO SPECIALLY ASSESS THE COST OF SUCH CONSTRUCTION AND INSTALLATION AGAINST THE fROfERTY WITHIN TIlE BOUNDARIES OF SAID SPECIAL IMPROVEMENT DISTRICT SO CREATED ON A FooNT FOOT BASIS, PURSUANT TO THE STATUTES IN SUCH CASES MADE AND FROVIDED. It was moved by Commissioner Secor, seconded by Commissioner Healy, that the resolution be passed and Ootober 4th, 1950 be set as the date for hearing protests, and the motion was carried by the fullowing Aye and No vote: those voting Aye being Mayor Lowe, Commissioner Secor and Commissioner Healy; those voting No, none. Foliey on Out of Town Traffic Violators The Manager and the Chief of Polioe discussed with the Commission problems which arise relative to out of town motorists who violate Bozeman traffic regulations. It has been common experience for a Police officer to issue a traffic ticket to an out of town violator and find that the violator leaves town without any effort to appear in Folice Court. After considerable discussion the following policy was agreed upon and approved, and in oases of traffic violations except for parking violations. Police officers will be instructed and authorized to require the violator to immediately report to Folice Headquarters or to the office of the police Magistrate. A Folice officer making an arrest of suoh persons will accompany the violator to Police headquarters or to the office of the Folice Magistrate. Safeway Store :Plan Plans which ha.ve been presented to the Building Inspector as a basis for application for a Building Fermit to construot a store and parking lot in Block "en, Traoy's Seoond Addition, for Safeway Stores, Inc. were discussed. The proposed parking lot would have two driveways on Mendenhall Street and four on Lamme Street. would necessitate removal of 180 ft. of curb and generally prohibit park- ing on either Mendenhall Street or Lamme Street along the full area of the lot. It wa.s pointed out that each driveway, where the public is permitted to drive across sidewalks, creates additional hazard to pedestrians and that in this oase adequate ingress and egress to the parking lot could be provided with one driveway on Mendenhall Street and two driveways on Lamme Street. The Manager was instructed to inform Haggerty-Messmer Company, the building contraotors for the project, that the plan with the proposed six driveways is disapproved but that the plan with three driveways, as outlined above, would be approved.
