The Commission of The City of Bozeman met in regular session in the Commission Room, City Hall
Building, Wednesday afternoo~October 4, 1950 at 1:00 o'clock F. M. Those being present were Mayor
Lowe, Commissioner Secor, Commissioner Healy, City Manager Henderson, City Attorney Lovelace and the
Clerk when the following proceedings were had:
The minutes of the last regular session were read, and it was moved by Commissioner Healy, seconded
by Commissioner Secor, that the minutes be approved as read, and the motion was carried by the following
Aye and No vote: those voting Aye being Mayor Lowe, COJronissioner Secor and Commissioner Healy; those
voting No, none.
Request to Lease Ground for Housing Project
George Horken, John Parker, Howard Erwin and Rod Kippen, representing the American Legion, appeared
before the Commission with a proposal that the City waive the requirements of the Lanham Act as it
applies to the Legion Housing Project in Bozeman. If the City will waive the requirements, the r'ederal
Housing Authority will transfer full title to the buildings and equipment in the project to the American
Legion and the Legion will enter into a lease agreement with the City on the same terms as the lease now
existing from the City to the Federal Housing Authority.
After discussion, the City Attorney was instructed to co-or-erate with Legion representatives in
preparing an agreement whereby the Legion would lease the city grounds for the housing project, upon the
city's adopting a resolution waiving Lanham Act requirements.
Resolution No. 687 -- Final Passage
The Manager stated this was the time and place set for the hearing of protests to the levying of
the assessment for Special Improvement District No. 356. He presented the affidavit of publication of
the Notice, and stated that no protests have been filed and no one is present to protest. He presented
Resolution No. 687, entitled;
A RESOLUTION OF THE COMMISSION OF THE CITY OF BOZEMAN, MONTANA LEVYING AND ASSESSING A SFECIAL
ASSESSMENT OF' TAXES UFON ALL THE PROI'ERTY :rn SPECIAL IMPROVEMENT DISTRICT NO. 356 IN THE CITY
OF BOZEMAN, COUNTY OF GALLATIN, STATE OF MONTANA, TO DEFRAY THE COST OF CONSTRUCTING AND MAKING
THE IMPROVEMENTS WITHIN SAID SPECIAL IMPROVEMENT DISTRICT NO. 356.
It was moved by Commissioner Healy, seconded by Commissioner Secor, that the resolution be finally
passed and adopted and the motion was carried by the following Aye and No vote: those voting Aye being
Mayor Lowe, Commissioner Secor and Commissioner Healy; those voting No, none.
Resolution No. 688 -- Final Fassage
The Manager stated this was the time and place set for the hearing of protests to the levying of
the assessment for garbage collection for 1950. He presented the affidavit of publication of the Notice,
and stated that no protests have been filed and no one is present to protest. He presented Resolution
No. 688, entitled:

ASSESSMENT OF TAXES WON ALL REAL PROfERTY IN THE CITY OF BOZEMAN, COUNTY OF GALLATIN, STATE OF
MONTANA, SERVICED AND FROM WHICH GARBAGE WAS COLLECTED AND REM:>VED DURING THE YEAR 1950, TO
DEFRAY THE COST AND EXfENSE OF COLLECTING AND DISPOSING OF GARBAGE UNDER THE FROVISIONS OF
ORDrnANCE NO. 696 OF THE CITY OF BOZEMAN.
It was moved by Commissioner Secor, seconded by Commissioner Healy, that the resolution be finally
passed and adopted and the motion was carried by the following Aye and No vote; those voting Aye being
Mayor Lowe, Commissioner Secor and Commissioner Healy; those voting No, none.
Fublic Hearing -- S. I. D. No. 363
The Manager stated this was the time and place set for the hearing of protests to the creation of
Special Improvement District No. 363, installation of water mains on Beall Street from Third Avenue to
Fifth Avenue. He presented the affidavit of publication of the Notice, and the Clerk's Mailing Certifi-
cate showing that all property owners have been notified. There was no one present to protest and, no

protests having been filed, a resolution creating the district numbered 689 was presented, entitled:

the Commission be authorized to advertise for bids, and the motion was carried by the following Aye and

Claims for the Month
The claim of Dr. A. L. Vadheim in the amount of $3.00 for treatment in his office of a sick prisoner
from the City Jail was presented. The claim was discussed, and it was decided that this charge should be
paid by Gallatin County as payment of medical services for indigent persons is not a city function, and
it was moved by Commissioner Secor, seconded by Commissioner Healy, that the claim of Dr. A. L. Vadheim
be disallowed, and the motion was carried by the following Aye and No vote: those voting Aye being Mayor
Lowe, Commissioner Secor and Commissioner Healy; those voting No, none.

The Manager stated that he has audited these claims and finds them to be true and lawful claims
against the City of Bozeman, and recommends that warrants be drawn for their payment. After examination
of the claims in detail by the City Commission, it was moved by Commissioner Healy, seconded by Commissioner
Secor, that the claims be approved and warrants drawn for their payment and the motion was carried by the

Bond of A. W. Coleman
The bond of A. W. Coleman in the amount of $2,000.00 as Plumbing and Gas Inspector and Assistant
Building Inspector was presented. The bond was approved as to form by the City Attorney, whereupon, it
was moved by Commissioner Secor, seconded by Commissioner Healy, that the bond be aplroved and accepted,
and the motion was carried by the following Aye and No vote: those voting Aye being Mayor Lowe,

Purchase of Fire Hydrants
The Manager recommended the purchase of six new fire hydrants. It was moved by Commissioner Healy,
seconded by Commissioner Secor, that the City Manager be authorized to purchase six fire hydrants and the

Authori ty to Sell Water Fipe
Owners of PrQperty on Main Street, east of Buttonwood Avenue, are proposing to install a water main

approximately 1000 feet in length, this project to be installed under private contract and then turned
over to the City. Special Improvement District No. 363 will require apFl"oximately 635 f~et of pipe.
The Manager stated that the Water Department has sufficient 6-inch cast iron pipe on hand which could be
sold to the contractors or the property owners to complete these two projects. He explained that it
would be impossible to secure such pipe from factories or sup~liers within several months which would
delay completion of these projects at least until next spring. The City does not have any immediate
need for the 6" pipe it has on hand.
It was moved by Commissioner Secor, seconded by Commissioner Healy, that the City Manager be
authorized to sell sufficient water pipe and fittings at current market price to complete these two
projects, and the motion was carried by the following Aye and No vote: those voting Aye being Mayor
Lowe, Commissioner Secor and Commissioner Healy; those voting No, none.

Discussion on Bozeman Becoming City of the First-Class
Freliminary announcement from the District Office, Bureau of Census, Butte, Montana, shows the
populs,tion of Bozeman, a.ccording to the count taken as of April 1, 1950, as 11,252. Montana Statute
provides that, when a city reaches a population of 10,000 or more, the city governing body must by
resolution declare it to be a city of the first-class. After discussion it was decided that, before
official action is taken in this matter, the City Manager should write to the Director of the Bureau
of Census and seoure official figures for the present population of the City.
