HomeMy WebLinkAbout1950-10-11 444 Bozeman, Montana October 11, 19pO The Cormnission of The City of Bozeman met in regular session in the Commission Room, City Hall Building, Wednesday afternoon, October 11, 1950 at 1:00 o'clock P. M. Those being present were Mayor Lowe, Commissioner Secor, Commissioner Healy, City Manager Henderson, City Attorney Lovelace and the Clerk when the following proceedings were had: The minutes of the last regular session held October 4, 19PO, and of the special session held Ootober 6, 1950, were read, and it was moved by Commissioner Healy, seoonded by Commissioner Secor, that the minutes be approved as read, and the motion was carried by the following Aye and No vote: those voting Aye being Mayor Lowe, Commissioner Secor and Commissioner Healy; those voting No, none. Claim for State Gas Tax Refund The claim of the City of Bozeman against the State Board of Equalization in the amount of $859.50 for refund of state gasoline tax was presented. It was moved by Commissioner Healy, seconded by Commissioner Secor, that the claim be approved and presented for payment, and the motion was carried by the following Aye and No vote: those voting Aye being Mayor Lowe, Commissioner Secor and Commissioner Healy; those voting No, none. Claim of Universal Manufacturing & Sales Co. Claim No. 9734 of the Universal Manufacturing & Sales Company in the amount of $301.50 was presented. The claim is subject to a 2% cash discount and, after examination of the claim by the City Commission, it was moved by Commissioner Secor, seconded by Commissioner Healy, that the claim be approved and a warrant drawn for its payment, and the motion was carried by the following Aye and No vote: those vot- ing Aye being Mayor Lowe, Commissioner Secor and Commissioner Healy; those voting No~ none. Cemetery Sexton Resigns The Manager announced that Clarence Hays has resigned as Sexton and Thurman Cloninger, Park Superintendent, is being put in charge of tile Cemetery, this to be in addition to his regular duties as Park Superintendent. Sale of S. I. D. No. 3p9 Bonds The Manager stated this is the time and l,lace set for the sale of Special Improvement District No. 369 bonds. He presented the affidavit of publioation of the Notice, and stated that no written bids have been filed. The Mayor called for oral bids, and the following bids were heard: Chas. H. Bell Ernest Anderson Chas. H. Bell 5.75% 5. 50% 5.00% par par par There being no further bids heard, it was moved by Commissioner Healy, seconded by Commissioner Secor that the bid of Chas. H. Bell of par and 5% interest for the bonds of S. I. D. No. 359 be accepted, and the motion was carried by the following Aye and No vote: those voting Aye being Mayor Lowe, Commissioner Secor and Commissioner Healy; those voting No, none. Proposed Plat of Langohr's F'irst Addi tion A proposed plat of Langohr's First Addition was presented. The area included is one half block in width and adjoins the city limits between Cleveland Street and Garfield Street. The question of whether or not Langohr should be required to dedicate ground for park or playground in the proposed addition was discussed at length. In view of the small area of the addition, the Commission indicated that they will approve the plat, without park area, as soon as it is completed and officially presented. Vacation of Streets & Alleys for School District No. 7 A sketch showing lots south of Block One, the Violette Addition which School District No.7 proposed to purchase was presented. Officials of School District No. 7 have made verbal inquiry on possibility of having Short Street, between Fifth Avenue and Sixth Avenue, and the alley in Block 1 and part of the 1 I 1 1 I 1 445 alley in Block 4, The Violette Addition, vacated. School District No.7 now owns Block 1 and is contemplat- ing purchasing the four north lots in Block 4 providing the street and alleys can be closed to make the entire area a school ground. The Commission recommended that, if the street and alleys are closed as requested, there should be an alley across Block 4, along the south side of Lots 2 and 17. The City Manager was instructed to inform School District No. 7 that, if a formal application for vacating this street and the alleys in accordance with the above recommendation is [resented, it will be given favor- able consideration. Request for Sidewalk, Block 10, West Side Addition A written request from Newton Kent wes read asking that sidewalk be constructed abutting Lots 19, 20, 21 and 22, and on Koch Street to the alley all in Block 10, West Side Addition. It was considered too late in the season to order the walk constructed this year, and the request will be reconsidered in the spring of 1951. Reports The following reports for the month of September, 1950 were presented: Chief of Police Recreation Director It was moved by Commissioner Seoor, seconded by Commissioner Healy, that the reForts be accepted and ordered filed and the motion was carried by the following Aye and No vote: those voting Aye being Mayor Lowe, Commissioner Secor and Commissioner Healy; those voting No, none. Petition for Water Main Extension A petition requesting an extension of water main on Twelfth Avenue from Koch to Curtiss Street was read. It was moved by Commissioner Healy, seconded by Commissioner Secor, that the petition be referred to the City Manager for further information as to costs, and the motion was carried by the following Aye and No vote: those voting Aye being Mayor Lowe, Commissioner Secor and Commissioner Healy; those voting No, none. Contract for Lease -- Legion Housing iroject A contract for lease of Block 38, Imes Addition between Gallatin Post #14 of the American Legion and the City of Bozeman, for the Legion Housing Project was presented and read. The contract having been prepared by the City Attorney, it was moved by Commissioner Healy, seconded by Commissioner Secor, that the Mayor and the Clerk of the Commission be authorized to sign the contract for The City of Bozeman and the motion was carried by the following Aye and No vote: those voting Aye being Mayor Lowe, Commissioner Secor and Commissioner Healy; those voting No, none. Resolution No. 690 -- Waiving Lanham Act Requirements Resolution No. 690 unconditionally waiving the requirements of the Lanham Act that the Housing Project Administrator remove the building structures from the Legion Housing Froject was presented, en titled: A RESOLUTION OF THE COMMISSION OF THE CITY OF BOZEMAN, MONTANA, UNCONDITIONALLY WAIVING THE REQUIREMENTS FOR REMOVAL BY THE PUBLIC HOUSING ADMINISTRATOR CONTAINED IN SECTION 313, PUBLIC LAW 849, 75th CONGRESS, AS AMENDED, OF THE TEMPORARY HOUSING :PROJECT BUILDINGS DESIGNATED AS MONTANA -V-240G8, BOZEMAN, MONTANA. It was moved by Commissioner Healy, seconded by Commissioner Secor, that the resolution be passed and adolted, subject to the Gallatin Post #14, American Legion, entering into the contract for leasing the ground where the housing projeot is located, and the motion was carried by the following Aye and No vote: those voting Aye being Mayor Lowe, Commissioner Secor and Commissioner Healy; those voting No, none. Adjournment There being no further business to come before the Commission at this time, it was moved by Commissioner Secor, seconded by Commissioner Healy, that the meeting adjourn and the motion was c No, none.
