M. Those being present were Mayor Lowe, Commissioner Secor, Commissioner Healy, City Manager Henderson, City Attorney Lovelace and the CIa rk when the following proceedings were had; The minutes of the last regular session were read, and it was moved by Commissioner Healy, seconded by Commissioner Secor, that the minutes be ap}roved as read, end the motion was carried by the following Aye and No vote: those voting Aye being Mayor Lowe, Corr~issioner Secor and Commissioner Healy; those voting; No, none. Sewer Charge Adjustment AFproved for 1501 South Third Avenue A written request for en adjustment in the monthly sewer service charge for the property owned by Montana State College. adjoining the city limits on South 3rd Avenue, was discussed. It was stated that approximately three-fourths of the water consumed at this }roperty does not enter the sanitary sewer system. The Manager reported that at the time this property was connected to the sanitary sewer a charge of $250.00 was paid as an estimated cost for the construction of a sewer to service the property. After consideration, it was moved by Commissioner Secor, seconded by Commissioner Healy, that a charge of $2.00 per month be set as the sewer service charge for 1501 South Third Avenue, and the motion was carried by the following Aye and No vote: those voting Aye being Mayor Lowe, Corr~issioner Secor and Commissioner Healy; those voting No, none. Resolution of Intention to Create S. I. D. No. 364 The Manager reported on his investigation as to estimated costs of a proposed improvement district to extend the water main on Twelfth Avenue from Koch to Curtiss Street, and recommended that the district be established with the cost to be assessed on an area basis. A resolution of intention, numbered 696, to create Special Improvement District No. 364, for the extension of a water main on Twelfth Avenue from Koch to Curtiss Street was presented, entitled: A RESOLUTION OF' THE CITY COMMISSION OF THE CITY OF' BOZEMAN, MONTANA, DECLARING IT ro BE THE INTEN- TION OF' SAID COMMISSION TO CREATE A Sl'ECIAL IMPROVEMENT DISTRICT OF' SAID CITY TO BE KNOWN AND DESIGNATED .AS "SPECIAL IMFOOVEMENT DISTRICT NUMBER 364ft FOR THE FURJ'OSE OF CONSTRUCTING .AND INSTALLING A SIX INCH WATER MAIN ON TWELF'TH AVENUE SOUTH FROM V/EST KOCH STREET TO WEST CURTISS STREET IN THE CITY OF BOZEMAN. MONTANA, AND TO SFECIALL Y ASSESS THE COST OF SUCH CONSTRUCTION AND INSTALLATION AGAINST THE FROfERTY WITHIN TEE BOUNDARIES OF' SAID SPECIAL IIvlFROVEMENT DISTRICT SO CREATED ON .AN AREA BASIS, fURSUANT TO THE STATUTES IN SUCH CASES MADE .AND PROVIDED. It was moved by Commissioner Healy, seconded by Commissioner Secor, that the resolution be passed, and November 8th, 1950 be set as the date for the hearing of protests, and the motion was carried by the following Aye and No vote: those voting Aye being Mayor Lowe, Commissioner Secor and Commissioner Healy; those voting No, none. Resolution No. 691 -- Assessing S. I. D. No. 359 The Manager stated the resolution levying the assessment in the amount of $1,808.12 for Special Improvement District No. 359, sanitary sewer on North Black Avenue from Cottonwood to Tamarack has been prepared. He presented Resolution No. 691, entitled: A RESOLUTION OF' TEE COMMISSION OF THE CITY OF BOZEMAN, MON'fANA, LEVYING AND ASSESSING A SPECIAL ASSESSMENT OF TAXES Ui'ON ALL THE PROfER'l'Y I:N SJ'ECIAL IMPROVEMENT DISTRICT NO. 359 IN THE CITY OF BOZEMAN, COUNTY OF' GALLATIN, STATE OF MONTANA, TO DEFRAY THE COST OF CONSTRUCTING AND MAKING THE IMPROVEMENTS WITHIN SAID SPECIAL IMFROVEMENT DISTRICT NO. 359. It was moved by Commissioner Secor, seconded by Commissioner Healy, that the Resolution be ~rovi- sionally passed, a.nd October 25th, 1950 be set as the date for hearing protests, and the motion was carried by the following Aye and No vote: those votin~ Aye being Mayor Lowe, Commissioner Secor and Commissioner Healy; those voting No, none. Resolution No. 692 -- Assessing S. I. D. No. 362 The Manager stated the resolution levying the assessment in the amount of $2,151.60 f'or the 1 I 1 447 construction of SFecial Improvement District No. 362, ornamental lighting on Main Street from Fourth Avenue to Eighth Avenue has been prepared. He presented Resolution No. 692, entitled: A RESOLUTION OF THE COMMISSION OF THE CITY OF BOZEMAN. MONTANA, LEVYING AND ASSESSING A SFECIAL ASSESSMENT OF TAXES UPON ALL THE l'ROFERTY IN SPECIAL IMPROVEMENT DISTRICT NO. 362 IN THE CITY OF BOZEMAN, COUNTY OF GALLATIN, STATE OF MONTANA. TO DEFRAY THE COST OF' COKSTRUCTlliG AND MAKING THE IMi'ROVEMENTS WITITIN SAID SPECIAL IMPROVEMENT DISTRICT NO. 362. It was moved by Commissioner Healy, seconded by Commissioner Secor, that the resolution be provi- 1 sionally passed, and October 25th, 1950 be set as the date for the hearing of protests, and the motion was carried by the following Aye and No vote: those voting Aye being Mayor Lowe, Corr~issioner Secor and Commissioner Healy; those voting No, none. Report of Meeting of Folice Chiefs Chief of Police Haas, reported t:J the City Commission on the convention of ]lolice Chiefs which he attended in Colorado Springs, Colorado. Study of City Water Supply The Manager reported that during the past week Harold Eagle of the Morrison Engineering Company, Helena, had been in to discuss the expansion of the city's water supply as studied in the survey made by his company. It was stated the Morrison Engineering Company thought the City should make a decision as to the amount of water that should be taken from the Hyalite Reservoir for use by the City. After discussion, it was decided that a meeting should be arranged between city officials and representa ti ves of the Morrison Engineering Company to thoroughly discuss the !)roblems involved in making such a decision, and the City Manager was instructed to arrange such a meeting. Culvert on South Eleventh Avenue The following property owners: I George Sikonia James Emerson Don Moore J. Meedendorp Philip Sandquist 604 South 11th Avenue 516 South 11th Avenue 608 South 11th Avenue 612 South 11th Avenue 513 South lOth Avenue appeared before the Commission to protest against water conditions on South 11th Avenue. A ditch along the west s ide of 11th Avenue has for many years carried off flood water from this area. Wi thin the last two years the owners of property on the west s ide of 11th Avenue. between Alderson and Dickerson Street. installed a 24ft culvert in this ditch and the City of Bozeman also installed a 24/t culvert at the inter- section of Alderson at 11th Avenue. This culvert is of insufficient size to carry off flood water. It frequently becomes clogged and flood waters are diverted to the east side of the street and onto properties along that side of the street. The flood situation along 11th Avenue has been a problem for many years and the installation of this culvert has definitely aggravated the problem. It was explained to these property owners that the only practical solution to the problem would be the installation of a large storm sewer from College Street on 11th Avenue at least to Curtiss Street, but that the expense of such a sewer would necessa.rily be assessed against abutting property and would be prohibitive at this time. It was agreed the. t the 24" culvert which has been installed should be removed a.nd the open ditch repla ced to its original condition unless and until such a sewer is insta.lled. The City Manager was instructed 1 to conver with the owners of property on the west side of 11th Avenue between Alderson and Dickerson to advise them that th is cuI vert must be removed and to try to work out some plan under which these flood waters can be handled. Cla.im of Grinnell Company of Pacifio Claim No. 9735 on the Water fund of Grinnell Company of the Pacific in the amount of $205.25 was presented. The cla.im is subject to a 2% cash discount. After examination of the claim by the Commission, it was moved by Commissioner Secor, seconded by Commissioner Healy. that the claim be approved and a warrant drawn for its payment, and the motion was carried by the following Aye and No vote: those 448 voting Aye being Mayor Lowe, Corrumissioner Secor and Commissioner Healy; those voting No, none.
