The Commiss ion of The City of Bozeman met in regular session in the Commission Room, City Hall
Building, Wednesday afternoon, October 25, 1950 at 1:00 0' clock f'. M. Those being present were Mayor
Lowe, Conmissioner Secor, Cozrunissioner Healy, City Manager Henderson, City Attorney Lovelace and the
Clerk when the f~llowing proceedings were had:

The minutes of the Ie st regular session were read, and it was moved by Commissioner Secor, seconded
by Commissioner Healy, that the minutes be apt.:roved as read, and the motion was carried by the folbwing

Bids for S. I. D. No. 363
The Manager stated this wes the time and l-'lace set for the opening of bids for Sfecial Improvement
District No. 363, water ma.in on Beall Street from Third Avenue to Fifth Avenue. He presented the
affidavit of publication of the Notice to Bidders, whereupon it wes moved by Commissioner Secor, seconded
by Cormnissioner Healy, that the bids be oIened and read, and the motion was carried,; Commissioners Healy,
Lowe and Secor voting Aye; those votine No, none. The bid of the Home Construction Comrany was as follows:
F'or laying water main in S. I. D. No. 363 - - $896.00
It was moved by COIn.."ilissioner Healy, seoonded by Commissioner Secor, that the bid of the Home
Construction Company be accepted, and the Clerk of the Commission be authorized to advertise for the
sale of S. 1. D. No. 363 bonds to pay the contractor, and the motion was carried by the following Aye and
No vote: those voting Aye being Mayor Lowe, Commissioner Secor and Commissioner Healy; those voting No,
none.

Final passage Resolution 691. Assessment S. I. D. 359
The Manager stated this was the time and place set for the hearing of protests to the final passage
of the resolution levying the assessment for the construction of Specie,l Improvement District No. 359,
sani tary sewer on North Black from Cottonwood to Tamarack Street. He presented the affidavit of publica-

Final Passage Resolution No. 692. Assessment S. I. D. 362
The Manager stated this was the time and place set for the hearing of protests to the final passage
of the resolution levying the assessment for the construction of Special Improvement District No. 362~
ornamental lights on Main Street from Fourth Avenue to Eighth Avenue. He presented the affidavit of

publication of the Notice, and stated that no protests have been filed and no one is f'resent to protest.
He presented Resolution No. 692, entitled:

Resolution No. 693. Weed Assessment
The Manager stated the resolution levying the assessment for the cutting of weeds for the season of

The Manager stated the resolution levying the assessment in the a.mount of $8,901.34 for the con-
struction of Special Improvement Lighting District :No. 361, ornamental lights on Main Street from Fourth
Avenue to Ida Avenue has been prepared. He presented Resolution No. 694, entitled:

The Manager stated the resolution levying the assessment in the amount of $5,876.86 for Miscellaneous
Walks and Curbs for 1950 has been rrepared. He presented Resolution No. 697 , entitled:

Request of F'rank J. Trunk for Exceftion of Builcing Code
Frank J. Trunk and Son having made verbal inquiry relative to usinf; the west wall at the rear of the

American Legion Hall, 225 East Main, as a party wall for an addition which they propose to build on
the rear of the I. O. O. F. Hall, 221 East Main. and they having been informed that this would be in
violation of tile building Ordinance, Mr. Trunk and Son appeared before the Commission to request that an
excel,tion be made to the building code in this case.
The City Commission recessed and made a personal inspection on the ground of the wall in question.
After full consideration, it was moved by Commissioner He&y, seconded by Commissioner Secor, that the
request be denied and the motion was carried by the following Aye and No vote: those voting Aye being
Mayor Lowe. Commissioner Secor and Commissioner Healy; those voting No, none.
B. M. Crenshaw -- Zoning Ordinance Violation
B. M. Crenshaw appeared before the Commission relative to a building which he owns in Block 18,
Butte Addition. On instructions from the City Commission the City Manager had on September 13, 1950
notified Mr. Crenshaw that his placing and permitting this building to remain at its present location is
a violation of Ordinance No. 711 and that the situation must be corrected wi thin thirty (30) days of
tha t date. Mr. Crenshaw's appearance before the Commission was aIparently for the purpose of informing
the Commission that he did not propose to move the building and to invite the City of Eozemall to do some-
thing about it.
Zoning Ordinance Violation -~ Phipps and Schlechten
The Manager infonned the Commission of Zoning Law violations wherein W. N. Phipps is operating an
auto repair shop and has commenced the buildinl:; of an addition thereto in Block 7, West Side Addition.
and wherein Chris Schlechten has applied for permit to move his photographic studio to 216 South Grand
Avenue. Each of these parties have been given official notice by the City Manager of their violation 0 f
the Zoning Ordinance.
Final Estirrate Main Street Lighting S. I. D. No. 361
The Manager reported that work has been completed on instal line new street lightine on Main Street
from Ida to Fourth Avenue and the Yellowstone Electric Company, Billings, Montana is entitled to payment
at this time for final estimate on their contract less the 10% reserve to be held for 90 days. The
Manager presented Claim No. 9736 in the amount of $6,915.60 to cover this final estimate and Claim No.
9737 for $212.50 to cover special work which this contractor had done installing conduit for traffic

control signals.
After examination of the claims in detail, it was moved by Commissioner Secor, seconded by
Commissioner Healy, that the claims be afproved and warrants drawn for their payment. and the motion was
carried by the following Aye and No vote: those voting Aye beinG Mayor Lowe, Commissioner Secor and
Commissioner Healy; those voting No, none.
Official Census of Bozeman
A letter from the Bureau of Census was read, stating that an official census for the City of
Bozeman has not been made, but would be announced with the next few months.
Drainage Problems on South Eleventh Avenue
Drainage problems on South Eleventh Avenue were discussed. The City Commission recessed and made
an inspection of this situation on the ground. but no definite action was taken pending further develop-
ment of engineering plans.
State Highway Commission Policy on Maintenance of Arterial Highways
Written inquiry having been made on September 27th, 1950 to the State Highway Commission for a
statement of policy on maintenance of arterial highways in Bozeman, a reply from the State HiGhway Commis-
sion was presented and read. The letter stated that no definite policy has ever been fixed on this
question, but the matter is being given further consideration.

Request for Water Connection - David Vogel, Sr.
An application for water service for a new dwelling to be constructed on the property of David
Vogel, Sr., near tile Montana Flour Mill, by David Vogel, Jr. was discussed. It is the general policy
of the city not to furnish water service to property outside the city limits but, because the main
supply line of the city from its north reservoir crosses this property, this application was given
special consideration.
It was moved by Commissioner Secor, seconded by Commissioner Healy, that, because of the right-

of-way easement permitting the city water main to cross this property, perlnission be granted David
Vogel, Sr. to connect to the city water line on the following conditions:
1. That the connection be made at Vogel's expense and under the supervision of
the City Water Department,
2. That water for this service be limited to normal household use,
3. That the service be metered, and the charge be the current charge established
for water users wi thin the city,
end the motion was carried by the following Aye and No vote: those voting Aye being Mayor Lowe,
Commissioner Secor and Commissioner Healy; those voting No, none.

There being no further business to come before the Commission at this time, it was moved by
Commissioner Secor, seconded by Commissioner Healy, that the meeting adjourn and the motion was
