M. Those being present were Mayor Lowe, Commissioner Secor, Commissioner Healy, City Manager Henderson, City Attorney Lovelace and the Clerk when the following; proceedings were had: 1 The minutes of the last reGula r session were read, and it was moved by Conunissioner Healy, seconded by Commissioner Secor, that the minutes be an roved as read, and the motion was carried by the followinE Aye and No vote: those votine; Aye being Mayor Lowe, Commissioner Secor and Conunissionor Healy; those votir.g No, none. Resolution No. 695 -- Assessing S. I. D. 355 The Manager stated this was the time and rlace set for the hearint'; of protests to the final r;ass8g;e of the resolution levyinG the assessment for the construction of Special Improvement District No. 355. He presented the affidavit of publication of the Notice, and stated that no I,rotests have been filed and no one is [resent to protest. It was moved by Commissioner Secor, seconded by Commissioner Healy, that the resolution be finally passed and adopted and the motion was carried by the followinG Aye and No vote; those voting Aye being Mayor Lowe, Cornmissioner Secor and Commissioner Healy; those voting No, none. Resolution No. 693 -- Weed Assessment The Manager stated this was the time and place set for the hearing of protests to the final }8ssage of the resolution levying the assessment for the cutting of weeds for the season of 1950. He [resented the aff'idavi t of publication of the Notice, and stated that no protests have been filed and no one is present to I;rotest. It was moved by Commissioner Secor, seconded by Commissioner Healy, that the resolution be finally ~assed and adopted and the motion was carried by the following Aye and N~ vote: those voting Aye being Mayor Lowe, Commissioner Secor and Commissioner Healy; those votine No, none. Resolution No. 697 -- W & C 1960 Assessment The Mar~ger stated this wes the time and place set for the hearing of protests to the final passage of the resolution levying the assessment for Miscellaneous Walks & Curbs 1950 construction and repair. He presented the affidavit of publication of the Notice, and stated that no protests have been filed and no one is present to protest. He presented Resolution No. 697, entitled: 453 454 A RESOLUTION OF THE COMMISSION OF' THE CITY OF BOZEMAN LI~VYING AND ASSESSING A SFECIAL ASSESSMENT OF' TAXES UPON CERTAIN PROPERTIES IN TIlE CITY OF' BOZEMAN, COUNTY OF GALLATIN, STATE OF' MONTANA, TO DEFRAY TIlE COST OF CONSTRUCTI:KG AND INSTALLING AND/OR REPAIRING MISCELLANEOUS SIDEWALKS AND CURBS DURING THE YEAR 1950. It was moved by Commissioner Healy, seconded by Commissioner Secor, that the resolution be finally passed and adopted and the motion was carried by the following Aye and No vote: those voting Aye being Mayor Lowe, Commissioner Secor and Commissioner Healy; those voting No, none. Driveways at Safeway Store on Mendenhall Street Mr. L. G. Winter and Mr. M. J. Griffiths, representing Safeway Stores, Inc., and Frank Messmer, their contractor, ap~eared before the Commission to discuss the matter of driveways into the parking lot of the Safeway store now being constructed in Block C of Tracy's Second Addition. Repres8ntati ves of Safeway Stores, Inc., ask tha t the original plan providing for four driveways on Lamme Street and two driveways on Mendenhall Street be reconsidered by the Commission. They stated these driveways were needed to fully utilize their parking lot, and to provide less congestion in getting in and out of the parking lot and on the street. After discussion and careful consideration, it was thought two driveways from Lamme Street and one from Mendenhall Street would adequately serve the need of entering and ~aving the parking lot and would best preserve and protQct the rif,hts, safety and interest of the general public in the street area. It was thereupon moved by Commissioner Healy, seconded by Commissioner Secor, that only three driveways be permitted (one on Mendenhall Street, and two on Lamme Street}, but that permission be granted to widen the three driveways to thirty feet at the propert;y line and thirty- five feet at the curb line, and the motion was carried by the following Aye and No vote: those voting Aye being Mayor Lowe, Commissioner Secor and Commissioner Healy; those voting No, none. Recornmendations of Board of Fire Underwriters A communication from the Board of Fire Undel"Writers was read, stating that before favorable considera- tion to reduce the grading of Bozeman from a Class 6 to a Class 5 city for fire insurance rates, the following recommendations should be complied with: 1. Strengthen the water distribution system in and about the industrial and morca.ntile areas. 2. Install additional fire hydrants in the mercantile district. 3. Purchase of a modern 65-75 foot aerial quint. 4. Frovide gas engine for generHting power for flood lighting;. Additional Street Lights The placing of e.ddi tional street lights was discussed, and it was moved by Commissioner Healy, seconded by Commissioner Secor, that the City Manager be instructed to order the Montana lower Company to install street lights at the following street intersections: Fourteenth Avenue and Alderson Street Twelfth Avenue and Alderson Street Fourteenth Avenue and Story Street Tenth Avenue and Olive Street Third Avenue and Grant Street and tile motion was carried by the following Aye and No vote: those voting Aye being Mayor Lowe, Commissioner Secor and Commissioner Healy; those voting No, none. Addi tional V~ork in Special Improvement District No. 361 The matter of addi tionEl.l work in the construction or Speci9.1 IrnFrovement District No. 361, removing &: installing cable in conduit which was in place &: was not included in the contract, was discussed. It waS recormnended the Yellowstone Electric Company be allowed $125.00 for this work, and that the City of Bozeman will assume responsibility for /olDy additional work and me. terial necessary for the trench back- filling where paving cuts were made. It was moved by Commissioner He~y, seconded by Commissioner Secor, that the City Manager be authorized to enter into an agreement with the Yellowstone Electric Company for final settlement of their contract on this basis, ani the motion was carried by the following; Aye and No vote: those voting Aye being Mayor Lowe, Commissioner Secor and Commissioner Healy; those voting No, none. I. I 1 455 Appl ica tion for Ci ty License The application of the Union Distributing Company for a city license to operate a butane and propane plant at 318 North Broadway was presented. It was moved by Conunissioner Healy, seconded by Commissioner Secor, tha t the appl ication be aH,roved and the license issued, and the motion was carried by the follow- ing Aye and No vote: those voting Aye being Mayor Lowe, Commissioner Secor and Commissioner Healy; those voting No, none. 1"1 Real_pointment of Adjustment Board Members The Mayor announced the reappointment of the following members to the Zoard of Adjustment for a three-year term ending November 8, 1953: Mrs. Vi. W. Spain Chris A. Heackel Elmer Bartholomew W. H. Lovelace F. L. Stone It was moved by Commissioner Secor, seconded by Commissioner Healy, that the appointments be aI-Froved and the motion was carried by the following Aye and No vote: those voting Aye being Mayor Lowe, Commissioner Secor and Conunissioner Healy; those voting No, none. ReForts The following reports for the month of October, 1960 were presented: Sanitary Officer for Milk Inspection Police Judge Water Collector and the ref.;ort of the Sewage Flant Superintendent for the month of September and October, 1960. It was moved by Commissioner Healy, seconded by Conunissioner Secor, that the reports be accepted and ordered filed and the motion was carried by the following Aye and No vote: those voting Aye being Mayor Lowe, Commissioner Secor and Commissioner Healy; those voting No, none. I Boz eman Canning; Co. Liability Insurance Released A request from the Bennett Agency for s. release of the liability insurance I,olicy of the Bozeman Canning Company was reported. It was stated the Bozeman Canning Company has finished their 1950 pack and are no longer using the city sewer system in connection with canning or Facking operations other than normal winter use. It was moved by Commissioner Healy, seconded by Commissioner Secor. that the City Manager be authorized to release the Bozeman Canning Co. under their liability insurence policy No. LC103046.effective Nov. 1. 1960,the city reserving all its rights to cover the period from July 28. 1950 to Nov. 1, 1950 under this policy and the motion was carried by the followinG Aye and No vote: those voting Aye being Mayor Lowe, Commissioner Secor and Commissioner Healy; those voting No. none. Tempore.ry Building - 131 East Mendenhall A. verbal request from Dean Chaffin, representing the United Sales Agency. to move a temporary build- ing now located on the lots at 131 East Mendenhall to wi thin twelve feet of' the west property line, and twenty feet from Mendenhall Street was reported. After consideration. it was moved by Commissioner Secor, seconded by Commissioner Healy, that permission be granted to move the building on the lots at 131 East Mendenhall to within not less than twelve feet of the east or west buildings now located there and not less than twenty feet of the front prope rty line; that the build ing will be considered as a temporary structure, and will be removed at the owner's eXI,ense at any time upon a sixty day notice, and the I motion was carried by the following Aye and No vote: those voting Aye being Mayor Lowe, Commissioner Secor and Commissioner Healy; those voting No, none. Bond & Contract S. I. D. No. 363 The bond and contract of Allen Edens of the Home Construction Company for the construction of Sr.ecial Improvement District No. 363, laying of water main on Beall Street from Third Avenue to Fifth Avenue was presented. The bond and contract were apI, roved as to form by the City Attorney, whereupon. it was moved by Commissioner Healy, seconded by Commissioner Secor, that the bond and contract. subject to the completion by Allen Edens, be approved and the Mayor and the Clerk be authorized to sign the 45fi contract for the City of Bozeman, and the motion was carried by the following Aye and No vote: those voting Aye being Mayor Lowe, Couwissioner Secor and Commissioner Healy; those voting No, none.
