The Commission of The City of Bozeman met in regular session in the Commission Room, City Hall Build-
ing, Wednesday afternoon, June 7th, 1950, at 1:00 o'clock P. M. Those being present were Mayor Lowe,
Commissioner Secor, Commissioner Healy, City Manager Henderson, City Attorney Lovelace and the Clerk
when the following prooeedings were had:

The minutes of the last regular session were read, and it was moved by Commissioner Healy,
seoonded by Commissioner Seoor that the minutes be approved as read, and the motion was carried by the
following Aye and No vote: those voting Aye being Mayor Lowe, Commissioner Seoor and Commissioner Healy;
those voting No, none.
Application for Beer Lioense
The application of the Northern Quarter Horse Breeder's Association for a special beer license for
three days was presented. It was moved by Commissioner Healy, seconded by Commissioner Secor, that the
application be approved and the license issued and the motion was carried by the following Aye and No
votel those voting Aye being Mayor Lowe, Commissioner Seoor and Commissioner He&y; those voting No,
none.
Application for Trailer Camp
Mr. Paul Janes, 818 North Seventh Avenue, presented an application for a permit to oonstruct a
trailer camp on his property. The application was accompanied by the required fee of $5.00. It was
moved by Commissioner Secor, seoonded by Commissioner Healy, that the application be approved and a permit
issued upon receipt from Mr. Jones of a ground plan for the proposed trailer camp, and the motion was
oarried by the following Aye and No vote: those voting Aye being Mayor Lowe, Commissioner Secor and

Commissioner Healy; those voting No, none.
Reconstruction of Paving Districts 349, 353, 354, 351 & 355
Mr. Scott Hart, Fred Brown, and R. J. Studer were present to discuss paving constructed by the
Blacktop Construction Company in Bozeman during 1949. Mr. Hart, who had been engaged by the City to
carry on necessary engineering work to determine causes of failures in this pavement and to prepare
plans for their correction, presented his verbal report. He reported that, from extensive tests which
have been made and from laboratory analysis, it has been determined thata
1. In all paving tested there is a deficienoy of asphalt.
2. Gravel aggregates in the pavement mat in most of the tests showed an excess of fines.
3. Distribution of bitumuls in all tests showed lack of uniformity probably due to
improper or inadequate mixing.
4. There are some small areas of base failure and some areas where grades and drainage
need correction.
5. On all new pavement where seal ooat and chips have been applied, that operation was a
complete failure and must be re-done.
Mr. Hart made the following recommendations:

1. That all the paving mat laid in 1949 by the Blacktop Construction Company, with the
exoeption of certain specified small areas, be torn up by scarifying, have additional
bitumuls added, be thoroughly re-mixed ~d relaid.
2. That, in cases of base failure, the City make the neoessary correction to the base.
3. That the Ci~ make necessary oorrections in drainage.
4. That, prior to soarifying this pavement, the City clean each of the streets.
5. That no oiling work be commenced until after July first.
6. That this paving be re-sealed.

Mr. Hart's recommendation went into detail as to depth to which the pavement mat should be scari-
fied, amount of bitumuls to be added, and on other points.
The entire situation was discussed at length with Mr. Studer who concurred in all recommendations.
Mr. Studer stated that he will do the necessa~ work and furnish the required materials to accomplish
this work and that it is his intention to complete the work on all these streets as required by the
specifications end to make them satisfaotory in all respeots.
Mr. Hart was instructed to submit his full end detailed recommendations in writing and Mr. Studer
agreed that, if these recommendations are as s~ated at this meeting, he will give his written concurrence
to them and will be prepared to start the necessary work by July 10, 1950.
Extending City Limits
The Manager stated this was the time and place set for hearing of protests to extending the City
Limits to include property south of College Street and east of Tracy Avenue. The Manager stated further
that no protests have been filed and no one is present to protest. Mr. Don Bennett and Keith Gastineau
were present and stated they favored the extension of the City Limits to include this property, where-
upon Resolution No. 679 extending said city limits was presented, entitled.
A RESOLUTION OF' THE COMMISSION OF THE CITY OF BOZEMAN EXTENDING THE BOUNDARIES OF THE SAID CITY
OF BOZEMAN SO AS TO EMBRACE AND INCLUDE A TRACT OF LAND CONTIGUOUS TO THE SAID CITY OF BOZEMAN
AND HEREIN MORE PARTICULARLY DESCRIBED WITHIN THE CORPORATE LIMITS THEREOF, AND DESIGNATING AND
ZONING SAID TRACT OF LAND AS A PART OF THE "B" 'RESIDENCE DISTRICT.
It was moved by Commissioner Healy, seconded by Commissioner Secor, that the resolution be passed
and adopted and the motion was carried by the following Aye and No vote: those voting Aye being Mayor
Lowe, Commissioner Healy and Commissioner Secor; those voting No, none.
Amendments to Zoning Ordinance
The City Attorney stated that as instructed he has prepared the following amendments to the Zoning
Ordinance~
1. To rezone the south one-half of Blocks 51 & 52 of the West Park Addition as Business
District No.2,
2. To include all the area south of Garfield Street in the "A" Residence District,
3. To prohibit permanent dwellings below ground level in the "A", "B", "C", Residence
Districts,
4. To require the basement apartments in all districts to have the same floor area
as above-ground apartments.
5. To include the new Dudley's 1st Addition in the "B" Residence District.
Ordinance No. 753, including the above amendments was presented, entitled:

NUMBER 711 OF THE CITY OF BOZmuN, THE SHORT TITLE OF WHICH ORDINANCE NUMBER 711 IS "TIlE
ZONING ORDINANCE", AND ADDING SUBSECTION XIII H TO SUCH ORDINANCE, SO AS TO ALTER THE BOUNDARIES
OF THE "Att AND "Bn RESIDENCE DISTRICTS AS DEFINED IN SAID "THE ZONING ORDINANCE", TO ESTABLISH
MINIMUM AREA REQUIREMENTS FOR BASEMENT APARTMENTS AND PROHIBIT PERMANENT DWELLINGS BELOW GROUND
LEVEL IN itA" AND "Btt AND "C"RESIDENCE DISTRICTS AND SO AS TO CREATE BUSINESS DISTRICT NUMBER
2 AND PRESCRIBE BUILDING AND USE RESTRICTIONS WITHIN SAID BUSINESS DISTRICT NUMBER 2.
It was moved by Commissioner Healy, seconded by Commissioner Secor, that the Ordinance being
presented for consideration be ordered to layover for further consideration and final action at the
regular meeting of the City Commission to be held on the 21st day of June, 1950 and the motion was
carried by the following Aye and No vote: those voting Aye being Mayor Lowe, Commissioner Healy and
Commissioner Secor; those voting N01 none.
Operation of City-County Ambulance
A written proposal from the Bozeman Elks Lodge was presented outlining a plan under which they
will give an ambulance to this community conditioned on the City of Bozeman and Gallatin County making
provision to pay an ~lticipated deficit of approximately $1,000.00 per year in operational cost of

an ambulance. Recognizing the urgent need for adequate ambulance service for this community and
considering ita necessary and justifiable part of the e:llp ense of operating the Health Department of
a city or county, the Commission gave tentative approval to the proposal provided the County
Commissioners of Gallatin County also apfrove it and budget the necessary funds and provided further
that the City Attorney renders an opinion that suoh action is permitted under the law. The City
Manager waS instructed to interview the County Commissioners and the City Attorney was instructed to

prepare his opinion in the matter so that it can be further considered at the next regular meetine.
The Manager stated that, as instruoted, he has notified property owners of defective sidewalks
to be repaired and of certain new sidewalk to be constructed. and reoommended that bids be called for
as soon as possible so that the work could be finished this season, whereupon, it was moved by
Commissioner Healy, seconded by Commissioner Seoor, that the Clerk of the City Commission be authorized
to advertise for bids for the construotion and/or repair of Misc. W & C for 1950, the bids to be opened
June 28th, 1950, and the motion was oarried by the following Aye and No vote: those voting Aye being
Annual Audit for 1950
Mayor Lowe, Commissioner Healy and Commissioner Seoor; those voting No, none.
A communioation from Douglas Wilson, Ferris & Company of Great Falls, Montana was read, stating
they would make the annual audit of the reoords of The City of Bozeman upon the same basis as was made
last year. It was moved by Commissioner Healy, seconded by Commissioner Seoor, that the firm of
Douglas Wilson, Ferris & Company be engaged to make the annual audit and the motion was carried by the

The Me,nager stated that he has audited these claims and finds them to be true and lawful olaims
against The City of Bozeman and recommends that warrants be drawn for their payment. After examina-
tion of the cl aims in deta 11 by the City Commission, it was moved by Commissioner Healy, seconded by
Commissioner Secor, that the claims be approved and warrants drawn for their payment, and the motion
and Commissioner Secor; those voting No, none.

License for Clyde Beatty Circus
Mr. Ray Smith, Advance Agent of the Clyde Beat~ Circus, was in to request a city license for the
Clyde Beatty Circus on the 8th of July, 1950. It was moved by Commissioner Healy, seoonded by Commis-
sioner Seoor, that a license for the Clyde Beatty Circus be approved subject to their paying the
required fee and complying with all other city regulations and the motion was carried by the follow-
ing Aye and No vote: those voting Aye being Mayor Lowe, Commissioner Healy and Commissioner Secor;
those voting No, none.
Reward for Policemen
The Manager reported that two members of the Folice Department had partioipated in the apprehension
of Yolland York, a wanted oriminal, for whioh a reward has been offered. It was moved by Commissioner
Healy, seconded by Commissioner Secor, that the reward be divided between the two oity officers, and the
motion was carried by the fbllowing Aye and No vote: those voting Aye being Mayor Lowe, Commissioner
Healy and Commissioner Seoor; those voting No, none.
Adjournment
There being no further business to come before the Commission at this time, it was moved by
Commissioner Seoor, seoonded by Commissioner Healy, that the meeting adjourn and the motion was oarried
