The Commission of the City of Bozeman met in regular session in the Commission Room, City Hall
Building, Wednesday afternoon, FebruarJT I, 1950 at 1:00 0' clock F. M. Those being; present were Mayor
Lowe, Conunissioner Healy, Commissioner Secor, City Manager Henderson, City Attorney Lovelace, and the
Clerk when the following proceedings were had:
Commissioner Healy, seconded by Commiss ioner Secor, that the minutes be approved as read, and the
motion was carried by the following Aye and No vote: those votinb Aye being Mayor Lowe, Commissioner
Healy and Conunissioner Secor; those voting No, none.
Loading & Unloading Delivery Trucks
Lester Gee. George Sikonia, John Lux, and Robert Ramrey, representing trucking firms in Bozeman,
appeared before the Commission to discuss loading and unloading problems in the business district.
Locations where the problem causes most difficulty were at Ralph's Food Store, Montgomery Ward Co. and
the Bon Ton Bakery. Truckers feel that, when loading or unloading heavy freight. they should be allowed
to back into the curb instead of being required to park parallel. After a lengthy discussion. it was
agreed that these ere problems which require olose coo};eration between the truokers, the police and
owners or operators of businesses, that when trucks have heavy or unusual loads which neoessitate their
backing into the curb the police should be called to direct traffic around the backed-in truck, and
that efforts should be made to provide special loading facilities at the Bon Ton Bakery and alley load-
ing doors at Ralph's Food Store and Montgomery Ward Co. The City Manager was instructed to interview
owners and operators of these three businesses to see what can be done at each of those places.
The City Manager stated that the State Highway Commission is to have a concrete school in Helena,

Engineer to Attend Concrete School
February 9th and lOth, 1950. It was moved by Commissioner Healy, seconded by Commissioner Seoor, that
it being in the public interest that City Engineer Babcock be authorized to attend this conference and
his expenses be paid from the General Fund and the motion was carried by the following Aye and No vote:
those voting Aye being Mayor Lowe, Commissioner Healy and Commissioner Secor; those voting No, none.
City Manager to Attend Exeoutive Meetings
The Manager stated there would be a meeting of the Executive Committee of the Water Works Associe-
tion on February 3rd, 1950 and a meeting of the Executive Committee of the Municipal League, on February
18th, 1950, both meetings to be in Helena. It was moved by Commissioner Healy, seconded by Commissioner
Secor, tha tit being in the public interest that City Manager Henderson be authorized to attend these
two meetings, and his expenses be paid from the GenerdFund and the motion was carried by the following;
Aye and No vote: those voting Aye being Mayor Lowe, Commissioner He&y and Commissioner Secor; those
voting No, none.

It was moved by Commissioner Secor, seconded by Commissioner Healy, that the retorts be accerted

Resolution No. 669 -- Levying Assessment S. I. D. 350
The Manager stated that the resolution levying the assessment for Slecial Improvement Distriot No.
350, in the amount of $5,125.00 had been frepared. He rresented Resolution No. 669, entitled:

Resolution No. 670 -- Levying Assessment S. I. D. 351
The Manager stated that the resolution levying the assessment for the construction of Special
Improvement District No. 351, in the amount of $47,161.22 had been prepared. He presented Resolution
No. 670, entitled:

The Manager stated that the resolution levying the assessment for the construction of Special

Bids for Truck -- Water Department
The Manager discussed need for a new truck for the Water Department and recommended that a new
":rick-up" truck be Furchased. It was moved by Commissi oner Healy, seconded by Commissioner Secor,
that the City Manager be authorized to advertise for bids for a truck for the Water Department and the
motion was carried by the following Aye and No vote: those voting Aye being Mayor Lowe, Commissioner
Healy and Commissioner Seoorj those voting No, none.
Resolution No. 668 -- Cancelling S. 1. D. Liabilities
The Manager stated that the City Attorney as instructed has prepared the resolution cancelling
special improvement district liabilities incurred prior to February 25th, 1929 and which liabilities
have been extinguished by reason of the issuance of tax deeds or by the apFlication of the Statute of
Limitations. He presented Resolution No. 668. entitled:

Bond 8nd Contract -- S. I. D. 359
The bond and contract of the Blacktop Construction Company for the construotion of Special Improve-
ment District No. 359 were presented. The bond and contract were approved as to form by the City
Attorney. whereupon, it was moved btJ Commissioner Healy, seconded by Commiss ioner Secor. that the bond
and contract be accel-'ted and approved and the Mayor and the Clerk of the Commission be authori zed to
execute the contract for The City of Bozeman. and the motion was carried by the following Aye and No
vote: those voting Aye being; l1ayor Lowe, Cormnissioner Healy' and Commissioner Secor; those voting No.
none.
Cancellation of Lease at Gallatin Field
The following resolution, cancell ing the lease of A. R. and C. II. Mackleberg of certain property
of the Gallatin Field was presented and read:
RESOLUTION
The Commissioners have considered the application of the Gallatin Field Board
for permission to cancel that certain Lease entered into between said Board and A. R.
MACKLEBERG and C. H. MACKLEBERG. of Bozeman, Montana. as partners, dated October 14,
1947. for the reason that the land leased by said Agreement is no longer necessary
as a facility to the said Gallatin Airport.
NOW THEREFORE, BE IT RESOLVED, that the Board hereby grants the said Airport
Boerd authority to cancel said Lease and release the said A. R. MACKLEBERG and C. H.
WLACKLEBERG of any a.nd all interest by the Gallatin Field Board in sa id real property
described in the Lease.
