HomeMy WebLinkAbout1950-05-10 Bozeman, Montana May 10, 1950 The Commission of the City of Bozeman met in regular session in the Commission Room, City Hall Building, Wednesday afternoon, May 10, 1950 at 1;00 o'clook P. M. Those being present were Mayor Lowe, Commissioner Healy, Commissioner Secor, City Manager Henderson, City Attorney Lovelace, and the Clerk when the following proceedings were had: I The minutes of the last regular session held May 3, 1950 were read, and it was moved by COInmis- sioner Healy, seconded by Commissioner Secor, that the minutes be approved as read, and the motion was carried by the following Aye and No vote: those voting Aye being Mayor Lowe, Commissioner Healy and Commissioner Secor; those voting No, none. C 1 e. ims A claim of Marshall Wells Company for pipe fittings was presented. The Manager stated the claim, in the amount of $36.60, was subject to a 2% discount if paid within ten days, whereupon. it was moved by Commissioner Secor, seconded by Commissioner Healy, tha,t the claim be approved and 8. warrant drawn for its payment and the motion was carried by the following Aye and No vote: those voting Aye being Mayor Lowe, Commissioner Healy and Commissioner Secor; those voting No, none. A cIa 1m of Haggerty-Messmer Company for the final payment for the construction of the Sewage Disposal Flant. in the amount of $1,000.00, was presented. It was moved by Commissioner Healy, seconded by Commissioner Secor, that the claim be approved and a warrant drawn for its payment and the motion was carried by the following Aye and No vote: those voting Aye being Mayor Lowe, Commissioner Healy and Commissioner Secor; those voting No, none. Resolution No. 676 - Embra.cing Dudley's F'irst Addition I A resolution prepared by the City Attorney, embracing and including within the corporate limits of the City of Bozeman certain properties owned by the Bennett Realty Co., and Paul K. Dudley adjoin.. ing; at the southeast part of the city limits. was presented. entitled; A RESOLtJTION OF THE CO~~~ISSION OF THE CITY OF BOZEMAN DF,CL~qING IT TO BE TO THE BEST INTEREST OF TEE CITY OF' BOZEMAN AND THF; INHADITANTS TPEREOF AND OF THE INHABITANTS OF A TRACT OF LJt.ND CONTIGUOl'S TO THE SAID CITY O:F' BOZEMAN AND HEREIN MORE fARTIC11LAHLY DESCIUBTl:D TO EXTEND THE BOUNDARHS OF TI-IE SAID CITY OF BOZEMAN SO AS 'fO INCLUDE THE SAID CONTIGUOUS TRACT WITHIN 'nIE COHfORATE LIMITS THEREOF. It was moved by Commissioner Healy, seconded by Commissioner Secor, that the resolution be }.Iaased and adopted and the motion was carried by the following Aye and No vote; those voting Aye being Mayor Lowe, Commissioner Healy and Commissioner Secor; those voting No, none. Recommendations of the Adjustment Board The Manager reI,orted that the Board of Adjustment. at a public hearing held on May 8th. 1950, recommended that the "B" Residence District south of Garfield Street be included in the "A" Residence District end that basement apartments in the "A", "B". "C" Residence Districts be required to have the same floor space as a single family dwelling. It was moved by Commiss ioner Healy, seconded by Commissioner Secor. that the City Attorney be instructed to prepare an amendment to the Zoning Ordinance conforminf:. with the reconuuendations of the 1 Adjustment Board, a,nd includine; the zoning of Dudley's First Addition in the "B" Residence Zone. and the motion was carried by the following Aye and No vote: those voting Aye being Mayor Lowe, Commissioner Healy and Commissioner Secor; those voting No, none. Reports The following reports for the month of April, 1950 were presented: Chief' of :rolice Cemetery Board Building Inspector It was moved by Commissioner Healy, seconded by Corrunissioner Lowe, that the reports be acce:pted and ordered filed and the motion was carried by the following Aye and No vote: those voting Aye being :381 382 Mayor Lowe, Commissioner Healy and Commissioner Secor; those voting No, none. Hearing -- S. I. D. No. 361 This beint; the time and place set for the hearing of protests to the creation of Special Improve- ment Lighting District No. 361, the affidavit of publication of the Notice and the Clerk's mailing certificate were presented, showing that all p'operty owners heve been notified. The Manager stated that no protests have been filed end no one is present to protest. It was moved by Commissioner Healy, seconded by Commissioner Secor, that the hearing be adjourned until May 17th, 1950, and the motion was carried by the following Aye and No vote: those voting Ay'e beinE Mayor I Lowe, Commissioner Healy and Commissioner Secor; those voting No, none. Public Hearing S. I. D. No. 362 The Manager stated that this was the time and r lace for the hell ring of protests to the creation of Srecial Improvement Lighting District No. 362. He presented the affidavit of publication of the Notice and the Clerk's Mailing; Certificate that all property owners have been notified. The written protest of 1.24% of the property owners in the district were presented. It was moved by Commissioner Healy, seconded by Commissioner Secor, that the hearing be adjourned until May 17th, 1950, and the motion was carried by the following Aye and No vote: those voting Aye being Mayor Lowe, Commissioner Healy and Commissioner Secor; those voting No, none. Contribution to City-County Heal th Unit The City Manager reported on a Board of Health meeting at which time a proposed budget for the year was presented. The budget being increased considArably over the past year, it was recommended that the contribution of' the City of Bozeman be raised $300.00 per year. The Manager stated the budget would be presented to the County Commissioners for final approval. After consideration by the City Commission, I it was moved by Commissioner Secor, seconded by Commissioner Healy, that the City's contribution to the Ci ty-County Health Uhit be increased $300.00 per year, provided the proposed budget is approved by the Board of County Con~issioners, and the motion was carried by the following Aye and No vote: those vot- ing Aye being Mayor Lowe, Commissioner Healy and Commissioner Secor; those voting No, none. Misc. W & C 1950 The report of sidewalk inspection and reoonnnendations with reference to needed repairs or construc- tion of new walk for the year 1950 was :presented. The City Manager and City Commission having checked the report, it was moved by Commissioner Healy, seconded by Cormnissioner Secor, that the refort cover- ing the repair or construction of Misc. W & C 1950 be and the same is hereby accepted, approved and adopted and that the reFort of the defective sidewalk be made a part of this minute entry by such adoption, the defective sidewalk as listed be repaired or constructed and the owners or agent of owners be notified in wri ting of such order for repair or construction as required by law, and the motion was carried by the following Aye and :No vote: those voting Aye being Mayor Lowe, Commissioner Healy and Commissioner Secor; those voting No, none. Investment of S. D. S. Revenue Funds The Director of Finance re!-,orted a surplus of $20,000.00 in the Sewage Disposal System Revenue Fund that could be invested in U. S. Government Securities and recommended the investment that would 1 mature in time for a sewer revenue bond call in March, 1953. It was moved by Commissioner Healy, seconded by Commiss ioner Secor, that the Director of Finance be authorized to purchase U. S. Government securities in the amount of' $20,000.00 from the Sewage Disposal System Revenue lUnd, and the motion was carried by the following Aye and No vote: those voting Aye being Mayor Lowe, Commissioner He&y and Commissioner Secor; those voting No, none. Adjournment There being no further business to come before the Commission at this tillie, it was moved by Commissioner Healy, seconded by Commissioner Secor, that the meeting adjourn and the motion was oarried by the following Aye and No vote: those voting Aye being Mayor Lowe, Commissioner Healy and Commissioner Secor; those voting No, none.
