July 13th, 1949 at 1:00 o'clock F. M. Those being present were Mayor Sorenson, Corrnnissioner Lowe, Commissioner Healy, City Manager Henderson, City Attorney Lovelace and The Clerk. when the following proceedings were had: The minutes of the last rer;ule.r session were read, and it was moved bS Commissioner Healy, seconded I by Corrnnissioner Lowe, that the minutes be afproved as read, and the motion was carried bj the following Aye and No vote: those voting Aye being Mayor Sorenson. Commissioner Lowe and Commissioner Healy; those voting No, none. Bids for S. I. D. Nos. 355 & 356 The Manager sta,ted that this was the time and place set for the opening of bids for Special Improve- ment Distriots No. 355 & 356. He :rresented the affidavit of publication of the Notice to bidders, where- upon. it was moved by Commissioner Healy, seconded by Commissioner Lowe. that the bids be opened and read and the motion waS carried by the following Aye and No vote: those voting Aye being Mayor Sorenson, Commissioner Lowe and Commissioner Healy; those voting No, none. The following bids were thereupon opened and read: S.I.D. 355 S. I.D. 356 Standard Construction Co., Bozeman $43,885.50 i 7.758.64 Blacktop Construction Co., Billings 42,915.40 7,933.00 rhe bids were referred to the City Engineer for verification, and it was moved by Commissioner Lowe, seconded by Commissioner Healy, that action on the bids be deferred until the next regular meet- ing of the City Commission and the motion was carried by the fall owing Aye and No votet those voting Aye being Mayor Sorenson, Commissioner Lowe and Commissioner Healy; those voting No, non~. I Bond & Contract -- S. I. D. 357 The bond and contract of the Standard Construction Company for the construction of Special Improve- ment District No. 357, sanitary sewer on Beall Street between Third Avenue and Fifth Avenue were presented. The bond and contract were arproved as to fonn by the City Attorney, whereuIon, it was moved by Commissioner Lowe, seconded by Commissioner Healy. that the Mayor and the Clerk of the Commission be authorized to sign the contract f'or The City of Bozeman. subject to the bonding company properly executinG the bond, and the motion was ca.rried by the following Aye and No vote: those voting Aye being Mayor Sorenson, Commissioner Lowe and Commissioner Healy; those voting No, none. feti tion for S. I. D. -- Storm Sewer A petition of property OWlle rs requesting a special improvement district be created for the installa- tion of a storm sewer in the allay between Main Street and Babcock Street from Tracy Avenue to Bozeman Avenue was presented and read. It was moved ~J Commissioner Lowe, seconded by Commissioner Healy, that the City Engineer be instructed to prepare an estimate of cost and. based on this estimate. the City Attorney be instructed to prepare a resolution of intention to create the district and the motion was carried by the following Aye and No vote: those voting Aye being Mayor Sorenson, Commissioner Lowe and Commissioner Healy; those voting No. none. I Frogress of Installation of Swinuning Fool Heating Equipment The Manager rSForted that Mr. Frank Trunk has informed him that the heat exchanger and one motorized valve for the heating equipment have been shipped and, upon arr ivaI, it should be possible to put the heating equipment into operation in two or three days. Fire protection f'or lictsweet Foods, Inc. The f'ollowing written request from Fictsweet Foods, Inc. asking permission to connect their automa- tic f'ire alarm system to the City's fire alarm system without any obligation or liability whatsoever on the part of' the city was presented and read: 273 FICTSWEET FOODS. INC. Bozeman. Montana July 13th. 1949 The Honorable Mayor and City Commission The City of Bozeman Bozeman. Montana Gentlemen: I At various times in the past few weeks we have conferred with various city officials of The City of Bozeman concerning the possibility of securing fire protection f'rom the Fire Depart- ment of The City of Bozeman for our plant, the greater portion of' which is located outside of the city limits of The City of Bozeman. We understand that there is some question as to whether the City can legally offer us this protection, and because of this we wish to make the f'ollowing proposal. In lieu of a contractual arrangement between the City and this Company whereby the City would agree to of'fer fire protection to us for our plant. we now propose that we be allowed to con- nect our bell alarm system with the alarm system of the Bozeman Fire Department in such a manner that a fire alarm from our plant will register with the Fire Department of' the City. This would serve to give the Bozeman Fire Department notice of a fire in our plant and would enable them to attempt to combat such fire in the event that they are able and willing to do so at the time of' such alarm. The above proposal is made wi th the express understanding that its acceptance does not commit the City to provide f'ire f'ighting equipment and personnel to combat fires at our plant. and we do hereby agree to hold The City of Bozeman free and harmless from and of any and all liability arislllg from any failure, mechanical or otherwise, of' our alarm system to register with the Bozeman Fire Depa rtment or from the omission of the Bozeman Fire Department, or any of it, to answer any fire calls at our rlant. It is hoped that we will continue to receive the cooperation of the Bozeman Fire Department in furnishing fi re pro tection to our plant. and we feel that the connection of our alarm systems will facilitate this protection. but we fully realize that the City cannot and does not by the acceptance of this proposal commit itself to combat fi re outside of its corporate limits. Bozeman, Montana Gentlemen: Your request of' July 13, 1949 f'or authority to connect your fire alarm system at your property adjoining the City limits of Bozeman near North Rouse Avenue to the fire alarm system of the City of Bozeman was presented to the City Commission at their regular meeting on July 13. 1949. I am instructed to inform you that your request has been aprroved and this letter will serve as authority for your firm to connect your alarm system to the fire alarm system of the City of Bozeman subject to the conditions set forth in your request and with the distinct understand- ing that the City of' Bozeman will assume no responsibility. financial or otherwise, for the connection or maintenance of' your alarm system. City Manager After discussion, it was moved by Commissioner Healy, seconded by Commissioner Lowe, tha t the City Manager be auttorized to permit Fictsweet Foods, Inc. to connect their fire alarm system to the City's I fire alarm system as requested and conditioned further on the connection being made and maintained at the expense of Fictsweet f'oods. Inc., and the motion was carried by the following Aye and No vote: those voting Aye being Mayor Sorenson. Commissioner Lowe and Commissioner Healy; those voting No. none. Rerorts The followinG reports for the month of June, 1949 were presented: Chief of Folice i'lumbing Inspector It was moved by Commissioner Healy, seconded by Commissioner Lowe, that the reports be accepted and ordered filed and the motion was carried by the following Aye and No vote: those voting Aye being ~~74 Mayor Sorenson, Commissioner Lowe and Co~~issioner Healy; those voting No, none. Applications for City License The afplication of Ralph Crabb f'or a one-half year City License was presented. It was moved by Commissioner Healy, seconded by Commissioner Lowe, that the application be approved and the license issued and the motion was carried by the following Aye and No vote: those voting Aye being Mayor Sorenson. Commissioner Lowe and Commissioner Healy; those voting No, none. I Budget 1949-1950 The City Manager presented and eXI'lained Frel iminary figures fo r the annual budget for the fiscal year ending June 30th, 1950. Adjournment There being no further business to corne before the Commission at this time, it was moved by Commissioner Lowe. seconded by Corrnnissioner Healy, that the meeting adjourn end the motion was carried by the following Aye and No vote: those voting Aye being Mayor Sorenson, Commissioner Healy and Commissioner Lowe; those voting No, none.
