HomeMy WebLinkAbout1949-08-03 Bozeman, Montana 279 August 3, 1949 The COlmnission of the City of Bozeman met in regular session in the Commission Room, City Hall Building, Wednesday afternoon, August 3rd, 1949 at 1:00 o'clock F. M. Those being present were Mayor Sorenson, Commissioner Lowe, Commissioner Healy, City Manager Henderson. City Attorney Lovelace and the Clerk~ when the following proceedings were had: I The minutes of the last regular session were read, and it was moved by Commissioner Lowe, seconded by Commissioner Healy~ that the minutes be approved as read~ and the motion was oarried by the following Aye and No vote: those voting Aye being Mayor Sorenson, Commissioner Lowe and Commissioner Healy; those voting; No, none. Offer of Blook for fark Purposes The following letter from Verne H. Ballantyne offering Block 20 of the Normandy Rearrangement of the West Side Addition to the City of Bozeman for park purposes was presented and read: Verne H. Ballantyne F. O. Box 737 Bozeman, Montana August 3, 1949 Honorable Mayor and City Commission City of Bozeman Bozeman, Montana Gentl amen: As is known by the Commission, the recent residential growth in the west part of the City of Bozeman is creating the need for additional park and recreational facilities in that area which will increase as further settlement takes place. In connection with the development of the NORMANDY HOMES District one block has been kept free of settlement with the thought in mind of offering it for co~ I munity use. Accordingly this 1s an offer to give a deed to the City of Bozeman for Block 20 of NORMANDY REARRANGEMENT upon the following conditions: 1. That the area be accepted by the City of Bozeman for play- ground, educational, recreational, and/or park purposes for the use and enjoyment of the people of Bozeman and community with particular emphasis for facilities for children and youth activities. 2. That the area be named "BALLANTYNE PARK". 3. It is understood that title will be transferred to the City subject to all Special Improvement District assess- ments or property taxes now due and payable and which will become due and payable. Claims of Blacktop Construction Company Claims Nos. 6493 and 6494 of the Blacktop Construction Company for the estimate of the work co~ pleted in the construction of Special Improvement District No. 351 in the amount of $6,600.00. and Special Improvement District No. 354 in the amount of $3,600.00 were presented. The Manager stated I that proceeds from the sale of the bonds in these two districts have not been received from Grande & Co., Inc. Whereupon, it was moved by Commissioner Healy, seconded by Commissioner Lowe, that the claims ~ be approved and warrants be drawn for their payment upon the receipt of the money from Grande & Co., Inc. for purchase of the bonds of these distriots, and the motion was oarried by the following Aye and No vote: those voting Aye being Mayor Sorenson, Commissioner Lowe and Commissioner Healy; those voting No, none. Claims for Month Claims No. 6259 to 6492 inclusive and Nos. 6495 to 6614 inclusive were presented on the various 280 funds as follows: Band $ 1,524.53 Cemetery 1.933.92 Cerny. Perm. Care 45.00 Cemetery Suspense 66.00 Garbage 7,410.29 General 15,300.86 Library 1,001.97 Park 3,983.03 Parking Meter 770.40 Police Reserve 585.65 I S. I. D. 13.350.00 W-H Tax 1,399.70 SDS Construction 5,987.96 SDS Revenue 60.00 Water 13,662.65 Total $ 67,081.96 The Manager stated that he has audited these claims and finds them to be true and lawful claims against the City of Bozeman and recommends that warrants be drawn for their payment. After examination of the claims in detail by the City Commission, it was moved by Commissioner Healy, seconded by Commissioner Lowe, that the claims be approved and warrants drawn for their payment, and the motion was carried by the following Aye and No vote: those voting Aye being Mayor Sorenson, Commissioner Lowe and Commissioner Healy; those voting No, none. Bond & Contract S. I. D. 355 The bond and contract of the Blacktop Construction Company for the construction of street improve- ments in Special Improvement District No. 355 were presented. The bond and contract were approved as to form by the City Attorney, whereupon, it was moved by Commissioner Lowe. seconded by Commissioner Healy, that the bond and contract be approved and the Mayor and the Clerk of the City Commission be authorized to sign them for the City of Bozeman; and the bid check be returned to the Blaoktop Construc- tion Company, end the motion was carried by the following Aye and No vote: those voting Aye being Mayor I Sorenson, Commissioner Lowe and Commissioner Healy; those voting No, none. Request for Peach Street to be an Arterial Street The Manager reported that Mr. Heber Porter end Howard Lewis representing the Chamber of Commerce had made a request that Peach Street be made a stop street beoause of the large number of trucks using this street to get to the industrial part of the City. The matter was taken under advisement with the probability of including such a provision in the traffic ordinance which is now being revised. Lot Flan for Conoco Station at Rouse & Main The plot plan of the Conoco Service Station to be oonstructed at the oorner of Main Street and Rouse Avenue was presented. After examination of the plan as proposed. it was moved by Commissioner Healy, seconded by Commissioner Lowe. that the plan be approved and the motion was carried by the follow- ing /we and No vote: those voting Aye being Mayor Sorenson, Commissioner Lowe and Commissioner Healy; those voting No, none. Applications for City Licenses The following applioations for City Licenses were presented: H. E. Jaoobs Wm. Williamson L. C. Bergen Brooke Hartman I It was moved by Commissioner Lowe, seconded by Commissioner Healy, that the applications be approved and the licenses issued and the motion was carried by the following Aye "and No vote: those voting Aye being Mayor Sorenson. Commissioner Lowe and Commissioner Healy; those voting No, none. Reports The following reports for the month of July, 1949 were presented; Librarian Fire Chief Sanitary Inspector Water Collector Police Judge Recreation Direotor Cashier 281. and the report of the City Engineer for June, 1949 and the annual report of the Fire Chief. It was moved by Commissioner Healy, seconded by Commissioner Lowe, that the reports be accepted and ordered filed and the motion was carried by the following Aye and No vote: those voting Aye being Mayor Sorenson, Commissioner Lowe and Commissioner Healy; those voting No, none. Annual Salary Ordinance No. 762 I The Manager stated that the annual ordinance fixing salaries of the City Manager, the Heads of Departments and the Employees of the City Commission has been prepared. He presented Ordinance No. 752, entitled: AN ORDINANCE OF THE CITY OF BOZEMAN, MONTANA FIXING THE MONTHLY SALARY AND OFFICIAL BOND OF THE CITY MANAGER, THE HKADS OF DEPARTMENTS, AND THE EMFLOYEES OF THE CITY COMMISS ION AS REQU IRED BY LAW. It was moved by Commissioner Healy, seconded by Commissioner Lowe, that the Ordinance be passed and adopted and the motion was carried by the following Aye and No vote: those voting Aye being Mayor Sorenson, Commissioner Lowe and Commissioner Healy; those voting No, none. Tax Levy Resolution No. 653 The Manager stated that the resolution setting the tax levy in the amount of 31.1 Mills for the year 1949-1950 has been prepared. He presented Resolution No. 653, entitled: A RESOLUTION OF THE COMMISSION OF THE CITY OF BOZEMAN DETERMINING THE AMOUNT OF CITY TAXES FOR ALL fURPOSES, GENERAL AND SPECIAL, TO BE LEVIED AND ASSESSED ON TAXABLE ProPERTY IN THE CITY OF BOZEMAN, STATE OF MONTANA, FOR THE FISCAL YEAR ENDING JUNE 30th, 1950. It was moved by Commissioner Lowe, seconded by Commissioner Healy, that the resolution be passed and adopted and the motion was carried by the following Aye and No vote: those voting Aye being Mayor Sorenson, Commissioner Lowe and Commissioner Healy; those voting No, none. I Request for Awning at 3 North Tracy The Manager stated that Bert Griffin of the Top Hat Lounge, at 3 North Tracy, has made a request for an awning to cover the steps going down to his place of business. The Manager stated that the awn- ing would not be the required seven feet above the sidewalk, but that the awning would not cover the sidewalk at this address, but would only cover the stairway. After consideration of the request, it was moved by Commissioner Healy, seconded by Commissioner Lowe, that the request be granted and the motion was carried by the following Aye and No vote: those voting Aye being Mayor Sorenson, Commissioner Lowe and Commissioner Healy; those voting No, none. Adjournment There being no further business to come before the Commission at this time, it was moved by Commissioner Lowe, seconded by Commissioner Healy. that the meeting adjourn and the motion was carried by the following Aye and No vote: those voting Aye being Mayor Sorenson, Commissioner Healy and Commissioner Lowe; those voting No, none.
