The Commission of the City of Bozeman met in regular session in the Commission Room, City Hall
Building, Wednesday afternoon, August 17th, 1949 at 1:00 0' clock F. M. Those being present were Mayor
Sorenson, Commissioner Lowe, Commissioner Healy, City Manager Henderson and the Clerk, when the follow-
ing proceedings were had:
The minutes of the last regular session were read. and it was moved by Commissioner Healy, seconded I
by Commissioner Lowe, that the minutes be approved as read, and the motion was carried by the following
Aye and No vote: those voting Aye being Mayor Sorenson, Commissioner Lowe and Commissioner Healy; those
voting No. none.
Claim for Gas Tax Ref'und
The Manager presented the claim of the Ci~ of Bozeman against the State of Montana for the refund
of the state gasoline tax paid by the City of Bozeman. It was moved by Commissioner Healy, seconded
by Commissioner Lowe, that the City Manager be authorized to sign the claim for the City of Bozeman and
the motion was carried by the following Aye and No vote: those voting Aye being Mayor Sorenson,
Commissioner Lowe and Commissioner Healy; those voting No, none.
Bond of Standard Construction Company S. 1. D. 356
The bond of the Standard Construction Company for the construction of S. I. D. No. 356, prepared
by the City Attorney, was presented. It was moved by Commissioner Lowe. seconded by Commissioner Healy,
that the bond be approved and accepted and the motion was carried by the following ~e and No vote:
those voting Aye being Mayor Sorenson, Commissioner Lowe and Commissioner Healy; those voting No, none.
Resolution No. 654 -- Intention to Create S. I. D. 358
.
The Manager stated that as instructed the City Attorney has prepared the resolution of intention I
to create Special Improvement District No. 358, storm sewer in the first alley south of Main Street
from Tracy Avenue to Bozeman Avenue. He presented Resolution No. 654. entitled:
A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF BOZEMAN DECLARING IT TO BE THE INTENTION
OF THE CITY OF' BOZEMAN TO CREATE A SFECIAL IMFROVEMENT DISTRICT TO BE KNOWN AS SPECIAL
IMFROVEMENT DISTRICT NUMBER 358 OF THE CITY OF BOZEMAN FOR THE PURroSE OF CONSTRUCTnm AND
INSTALLING A STORM SEWER IN THE FIRST ALLEY SOtITH OF EAST MAIN STREET BETWEEN SOUTH BOZEMAN
AVENUE AND SOUTH TRACY AVENUE IN SAID CITY.
It was moved by Commissioner Healy, seconded by Commissioner Lowe, that the Resolution be passed
and adopted and September 7th, 1949 be set as the date for the public hearing and the motion was carried
by the following Aye and No vote t those voting Aye being Mayor Sorenson, Commissioner Lowe and
Commissioner Healy; those voting No, none.
Applications for City Lioenses
The following applications for City Licenses were presented:
Business: Eldon Dahl Warren Fenno Pete Vavich A. F. Kapinos
Slot Machines: George's Drive Inn
It was moved by Commissioner Lowe, seconded by Commissioner Healy, that the applications be
approved and the licenses issued and the motion was carried by the following Aye_"ali~ No vote: those
voting Aye being Mayor Sorenson, Commissioner Lowe and Commissioner Healy; those voting No, none. I
Reports
The following reports for the month of July, 1949 were presented:
City Engineer Building Inspector Plumbing Inspector Cemetery Board
It was moved by Commissioner Healy, seconded by Commissioner Lowe, that the reports be accepted
and ordered f'iled and the motion was carried by the following Aye and No vote: those voting Aye being
Mayor Sorenson, Commissioner Lowe and Commissioner Healy; those voting No, none.

Acoeptanoe of Ballantyne Offer of Block 20, NR West Side Addition
The Manager stated that during the past week the City Commission had met informally to discuss
the offer of Verne Ballantyne to give Block 20 of the Normandy Rearrangement of the West Side Addition
to the City of Bozeman for park purposes.
It was moved br Commissioner Lowe. that the written offer of Verne Ballantyne, made to the City
Commission on August 3rd, 1949, to give Block 20, Normandy Rearrangement. West Side Addition to the
I City of Bozeman for park. playground or school purposes be accepted in accordance with Mr. Ballantyne's
letter, but subject to the following exoeptions or conditions:
1. That the tract should be named Normandy Park,
2. That the City will maintain the tract in its present condition by keeping it
mowed and clean,
3. That the City will assume no obligation to improve or equip the tract for park
or playground purposes at any fixed time. The time at which park improvements
or installation of playground equipment will be made on the tract will be
entirely at the discretion of the City Commission.
The above motion was discussed, and Mr. Ballantyne being present stated this would be agreeable
to him, thereupon the motion was seconded by Commissioner Healy and was carried by the following Aye
and No vote: those voting Aye being Mayor Sorenson. Commissioner Lowe and Commissioner Healy; those
voting No, none.
Interested property owners present expressed their thanks to the City Commission for the action
taken and offered their services gratis for the i~provement of said Block 20.
Bids for Loader
The Manager stated that this was the time and place set for the opening of bids for a mechanical
loader. He presented the affidavit of publication of the Notice to bidders, whereupon, it was moved
. by Commissioner Lowe, seconded by Commissioner Healy. that the bids be opened and read and the motion
I was carried by the following Aye and No vote: those voting Aye being Mayor Sorenson. Commissioner Lowe
and Commissioner Healy; those voting No, none. The following bids were thereupon opened and read:

After the reading of the bids, each representative present was given an opportunity to explain and
give further information regarding the equipment bid on. After hearing those present, it was moved by
Commissioner Healy, seconded by Commissioner Lowe. that the City Manager tabulate the bids for further
consideration. and the motion was carried by the following Aye and No vote: those voting Aye being
Mayor Sorenson. Corrnnissioner Lowe and Commissioner Healy; those voting No, none.
Bids for S. I. D. Bonds No. 356
The Manager stated that this was the time and place set for the opening of bids for the Special
Improvement District No. 366 Bonds. He presented the affidavit of publication of the Notioe of the sale
of bonds. Whereupon it was moved by Commissioner Healy, seconded by Commissioner Lowe, that the bids
be heard, and the motion was carried by the following Aye and No vote: those voting Aye being Mayor
I Sorenson, Commissioner Lowe and Corrnnissioner Healy; those voting No. none.
The written bid of E. I. Gillespie was opened and read, and found to be as follows:

The following oral bids were received:

There being no further bids, it was moved by Commissioner Healy, seconded by Commissioner Lowe.

Bids for Bonds of S~ecial Improvement District No. 355
The Manager stated that this was the time and place set for the opening and hearing of bids for the
bonds of Special Improvement District No. 355. He presented the affidavit of publioation of the Notioe
of Sale of Bonds. whereupon, it was moved by Commissioner Lowe, seconded ~ Commissioner Healy, that the I
bids be heard. and the motion was carried by the following Aye and No vote: those voting Aye being Mayor
Sorenson, Commissioner Lowe and Commissioner Healy; those voting No, none.
The following oral bids were heard:

those voting No, none.
Completion of S. I. D. 349, 351, 353, and 354
Mr. R. J. Studer, of the Blacktop Construction Company was present to discuss the status of the
completion date of his contract for the construction of Special Improvement Districts No. 349, 351,
353. and 354. He stated that normally. contracts do not start until sale of the bonds, which in this
case was May 18th, 1949. I
A written request from Mr. R. J. Studer asking for an extension of time was presented. The City
Commission stated they so construed the contract that it should begin at the time of the sale of the
bonds, and that with this interpretation of the contract, it would not be necessary to take any action
on the request for a time extension.
Delegate to State Firemen's Convention
The Manager stated that the City Commission had authorized the Fire Chief to attend the Annual
Firemen's Convention, but at the present the Assistant Fire Chief is on vacation. Whereupon, it was
moved that Fire Chief McCrosson be authorized to attend the Annual Firemen's Convention in Butte,
Montana, August 18th, 19th and 20th, 1949, and his expenses be paid from the General Fund, and that
Mr. John Schmitz, Fireman, serve as Acting Fire Chief during his absence and the motion was carried
by the following Aye and No vote: those voting Aye being Mayor Sorenson, Commissioner Lowe and
Commissioner Healy; those voting No, none.
Lioense for Cole Brothers Circus
The Manager stated that the Cole Brothers Circus has asked about a license to show in Bozeman near
the lOth of September, 1949. It was moved by Commissioner Lowe, seconded by Commissioner Healy, that
upon the proper application and submitting the required fee that a license be issued to the Cole Brothers I
Circus, and the motion was carried by the following Aye and No votet those voting Aye being Mayor
Sorenson, Commissioner Lowe and Commissioner Healy; those voting No, none.
Adjournment
There being no further business to come before the Commission at this time, it was moved by
Commissioner Lowe, seconded by Comrndssioner Healy, that the meeting adjourn and the motion was
carried by the following Aye and No votet those voting Aye being Mayor Sorenson, Commissioner Healy
