August 24th. 1949, at 1:00 o'clock i.M. Those beinE present were Mayor Sorenson, Commissioner L.owe, Commissioner Healy, City Manager Henderson, and the Clerk, when the f'ollow- ing proceedings were had to-wit: The minutes of the last regular session were read, and it was moved by Commissioner Lowe, seconded I by Commissioner Healy that the minutes be afproved as read. and the motion was carried by the following Aye and No vote; those voting Aye being Mayor Soresnon. Commissioner Lowe and Commissioner Healy; those voting No, none. FeU tion to Vacate Streets & Alleys A petition from Dr. R. A. Williams requesting the following streets and alleys be vacated was presented and read: Olive Street from Cypress to Switzler Avenue Curtiss Street from MacAdow to Switzler Avenue Babcock Street from Cypress to Switzler MacAdow Avenue from Babcock Street to Curtiss Street Aylsworth Avenue from Babcock Street to Curtiss Street and the east and west alleys in Blocks 13, 15, 18 19 and 20 all in the Northern Facific Addition. Dr. Williams proposes to develop this proper~ for a baseball park. The petition was referred to the City Attorney for investigation, and the Commission stated they would look over the ground and would have definite information regarding the petition within a few days. Butane Storage Tank on Block 102, N. F. Addition Two owners of property in the vicinity of Block 102, Northern Facific Addition appeared to make further protest against a Butane gas storage tank located on said Block 102. Froper~ owners in the I vicinity had previously filed apetition against this installation. The owners present stated they un- derstood that there was supposed to have been ahigh fence placed around this tank and the outlet was supposed to have been placed at least seventy-five feet from the tank. The City Manager informed them the owner of the tank claims to have ordered a pump for use in filling small tanks from the large storage tank which will eliminate leakage of any gas during such operations. The owner has also stated that all hoses on trucks loading into the storage tank will not be emptied until such trucks have left the storage tank area and are out in open country. The Manager further informed those Iresent he would investigate the original permit as to requirements on fencing and the location of the outlet. Rezoning of South one-half of Blocks 51 & 52. West Park Addition Mr. H. B. Landoe was present to inquire if the City Commission will give further consideration to rezoning the south one-half of Blocks 51 and 52 of West Park Addition. He stated that. before a peti- tion is filed for the rezoning of this porperty, the owners desired to learn the feeling of the Com- mission toward such a proposal. He was informed that no further consideration has been given to this matter but that upon proper petition, the matter oould be given another public hearing. Temporary Office -- 131 East Mendenhall I Mr. Dean Chaffin was present to request pemission to place a small building to be used for tem- porary office quarters on the proper~ at 131 East Mendenhall. which will be used in connection with a used car lot. He stated the building would set back approximately seventy-five feet from the sidewalk, and would be thirty-five feet from buildings on the side with the exception of a brick building on the rear of the lot, and would be of a temporary nature only. He stated the building would be modern in design and similar to other buildings of this nature now being oonstructed in other cities for this purpose. After consideration by the City Commission, it was moved by Commissioner Healy, seconded 289 by Commissioner Lowe that the request be granted and the motion was carried qy the following Aye and No vote; those voting Aye being Mayor Sorenson, Commissioner Healy and Commissioner Lowe; those voting No, none. Water Line for Sewage Treatment Flant Mr. Fred Quinnell, Project Engineer for the Sewage Plant. was fresent and presented maps showing the I possible methods of' laying a water line to the treatment plant. He stated that the shortest line would be north on Rouse Avenue to the plant and that a 4" line would be sufficient to serve only the needs at the treatment plant. It was pointed out that the 4" extension from the main line serving the Northern Facific Coal Docks was the property of' the railroad, and that permission to connect to this line and extend the line under their tracks would have to be obtained before definite action could be taken. Bids for Snow Loader Bids submitted at the last meeting on a mechanical loader were given further consideration at this time. Sales representatives present were given time to explain their machines. The City Manager, having tabulated the bids recommended that a Pettibone-Mulliken machine should be further investigated before a decision is made. One of these machines is in opera.ti on in Salt LakeCi ty and the Sietz Machinery Company will make arrangements for representatives of this City to go there to see it. After consideration, it was moved by Commissioner Healy, seconded by Commissioner Lowe that it being in the public interest that the City Manager, the Street Superintendent and any members of the City Commission who could go, be authorized to make the trip to Salt Lake City to look over the Fettibone- Mulliken Loader, and their expenses be paid from the General Fund, and the motion was carried qy the following Ave and No vote; those voting Aye being Mayor Sorenson, Commissioner Lowe and Commissioner I Healy; those voting No, none. Applications for City Licenses The following afplications forCi ty Licenses were presented: Business: Dairy Queen Store John L. MacDonald Gerald D. Collett Beley & Frood Slot Machine: B-B Caf'e It was moved by Commissioner Healy, seconded by Commissioner Lowe that the applications be approved and the licenses issued and the motion was carried by the following Aye and No vote; those voting Aye being Mayor Sorenson, 'Commissioner Lowe and Commissioner Healy; those v'Jting No, none. Final Fassage Ordinance No. 751 -- ApFropriation Ordinance The Manager stated that this was the time and place set for the final passage and adoption of the Appropriation Ordinance for the fiscal year ending June 30th. 1950. He presented the affidavit of pub- lication of the Ordinance and stated that no protests have been filed and no one is present to protest. whereupon Ordinance No. 751 Was presented, entitled: AN ORDINANCE AFPROPRIATING MONIES FOR EXI-ENDITURES DEEMED NECESSARY AND IN ACCORDANCE WITH BUDGETaRY REQUIREMENTS FOR MAINTENANCE ETC., OF THE MUNICIPAL GOVERlirMEN1' OF THE CITY OF BOZEMAN, MONTANA FOR THE FISCAL YEAR mDING JUNE 30. 1950. It was moved by Commissioner Healy, seconded by Commis sioner Lowe that the Ordinance be finally I passed and adopted and the motion was carried by the following Aye and No v otej those voting Aye beine; Mayor Sorenson, Commissioner Healy and Commissioner Lowe; those voting No. none. Patching Material from State Highway The Manager stated the city needs road oils for mixing patching material for city streets, and to obtain this material from the State Highway Comrodssion, a resolution auth'Jrizing the City Manager to make such purchase must be adopted and presented to the Highway Commission. The following resolution authorizinE the purchase of material was presented and read: 290 RESOLUTION WHEREAS, the City of Bozeman has immediate need for limited quantities of' road oil f'or use in making emergency repairs on streets in Bozeman, and WHEREAS. the City of Bozeman does not have proper facilities for procuring and storing quan- ti ties of' such oils in Bozeman, and WHEREAS, the Montana State Highway Commission has quantities of road oil of the required types stored in Bozeman from .which it may be able to supply the immediate needs of the City of' Bozeman at cost plus handling charge. I NOW. THEREFORE. BE IT RESOLVED: That an emergency does exist and the City Manager is hereby authorized to purchase from the Montana State Highway Commission, from its stocks in storage in Bozeman, approximately 3000 gallons of road oil as required for use in patohing pavement in Bozeman during 1949. Resolution Authorizing Maturity Date of SID Bonds The Manager stated that Grande & Company, Inc. has asked that a resolution authorizing them to place a stamp giving a maturity date on the special improvement district bonds which they purchased on May 18th, 1949 be adopted by the City 'Commission. He I.resented the following resolution: RESOLUTION WH&REAS , The City of Bozeman. Montana advertised for the sale of the bonds of Special Improvement I Districts Nos. 349, 35l, 353, and 354, and has sold to Grande & Company, Inc. of Seattle, Washington the bonds of each of the above-named districts, and WHEREAS , the bonds of said Special Improvement Districts Nos. 349, 35l, 353, and 354 were printed, issued and sold without a specific maturity date being prinLed or shown on the face of' each bond, & WHEREAS , it is advantageous to the purchasers or owners of said bonds to have a maturity date shown on each bond. NOW THEREFORE BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF BOZEMAN. MONTANA That, L. G. Shadoan, Clerk of the City Commission of The City of Bozeman, Montana is hereby authorized to notify Grande & Co., Inc. to stamp on each of the bonds of Sepcial Improvement Districts Nos. 349 and 354, "This bond matures on or before July 1, 1959.", and to stamp on each of the bonds of Special Improvement Districts Nos. 351 and 353, "This bond matures on or before July I, 1969." I" Investment of Cemetery Fermanent Care Funds The Manager stated that Special Improvement District Bonds of The City of Bozeman can be purchased from Grande & Company, Inc. for investment of Cemetery Permanent 'Care Funds. It was moved by Commissioner Healy. seconded by Commissioner Lowe that the Director of Finance be authorized to negotiate with Grande ~ Company Inc. for the purchase of $9,000.00 pf Special Improvement District Bonds for the Cemetery Fermanent Care Fund, and the motion was carried by the following Aye and No vote; those voting Aye being Mayor Sorenson, Commissioner Lowe and Commissioner Healy; those voting No, none. 291 Purchase of Bass Horn for Band The Manager stated that the Municipal Band needs a bass horn. After consideration. it was moved by Commissioner Lowe, seconded by Commissioner Healy that the City Manager be authorized to purchase a bass horn and case, in an amount not to exceed $700.00, for the Municipal Band, and the motion was carried by the following Aye and No vote; those voting Aye being Mayor Sorenson, Commissioner Lowe and Commissioner I Healy; those voting No. none. Adjournment There being no further business to come before the Commission at this time. it was moved by Commis- sion at this time, it was moved by Commissioner Healy, seconded by Commissioner Lowe that the meeting adjourn and the motion was carried by the following Aye and No vote; those voting Aye being Mayor Sorenson, Commissioner Lowe and Commissioner Healy; those voting No, none.
