August 31, 1949
The Commission of the City of Bozeman met in regular session in the Commission Room. City Hall
Building, Wednesday afternoon, August 3lst, 1949 at 1:00 o'clock P. M. Those being present were Mayor
Sorenson, Commissioner Lowe, Commissioner Healy, City Manager Henderson, City Attorney Lovelace and the
Clerk, when the following proceedings were had:
The minutes of the last regular session were read, and it was moved by Commissioner Healy, seconded I
by Commissioner Lowe that the minutes be approved as read, and the motion was carried by the following
Aye and No vote; those voting Aye being Mayor Sorenson, Commissioner Lowe and Commissioner Healy; those
voting No, none.
Storage Tank for Butane Gas
The Manager reported that he has checked the requirements for the fencing of the Butane Gas Tank
located on Block 102, Northern Pacific Addition, and finds no information which would require the tank to
be fenced, but that the outlet should be the distance from the tank that. is required for the tank to be
from the property line.
Gas & Plumbing Bond -- McCay Hardware
The continuation certificate of the gas fitter's bond in the amount of $2.000.00 and the plumbing
bond, in the amount of $500.00, of the McCay Hardware Company were presented. The certificates were
arproved as to form by the City Attorney, whereupon it was moved by Commissioner Healy, seoonded by
Commissioner Lowe, that the certificates be approved and accepted and the motion was carried by the follow-
ing Aye and No vote: those voting Aye being Mayor Sorenson, Commissioner Lowe and Commissioner Healy;
those voting No, none.
Resolution No. 655 -- Farking Maintenance Assessment I
The Manager stated that the resolution levying the assessment for the care of parkings for the year
1949, in the amount of $5,257.05, has been prepared. He presented Resolution No. 655, entitled:
A RESOLUTION OF THE COMMISSION OF THE CITY OF BOZEMAN. LEVYING .AND ASSESSING A SPECIAL ASSESSMENT
OF TAXES UPON ALL THE FIDPERTY IN SPECIAL IMl'ROVEMENTDISTRICTS OF THE CITY OF BOZEMAN, COUNTY OF
GALLATIN, STATE OF MONTANA. FOR THE MAINTENANCE OF FARKINGS TO DEFRAY THE COST OF MAINTAINING THE
PARKINGS WITHIN SAID SFECIAL IMJ'ROVEMENT DISTRICTS OF THE CITY OF BOZEMAN FOR THE YEAR 1949.
It was moved by Commissioner Healy, seconded by Corrnnissioner Lowe, tha.t the resolution be provision-
ally passed and September 7th, 1949 be set as the date for the hearing of protests and the motion was
carried by the following Aye and No vote: those voting Aye being Mayor Sorenson, Commissioner Lowe and
Commissioner Healy; those voting No, none.
Bids for W and C 1949
The Manager submitted a report showing the amount of sidewalk replacement, cross walks, and new
sidewalk to be constructed during 1949. which have not been completed as ordered. It was moved by
Commissioner Lowe, seconded by Commissioner Healy, that the Clerk of the City Commission be authorized
to advertise for bids for this sidewalk work, and the motion was carried by the following Aye and No
vote; those voting Aye being Mayor Sorenson, Commissioner Lowe and Commissioner Healy; those voting No,
none.
Reports I
The following reports were presented: For July, 1949: Director of Finance
For August, 1949: Water Collector and Folice Judge
It was moved by Commissioner Healy. seconded by Commissioner Lowe, that the reports be accepted and
ordered f'iled and the motion was carried by the following Aye and No vote; those voting Aye being Mayor
Sorenson, Commissioner Lowe and Commissioner Healy; those voting No. none.

Applications for City Licenses
The following applications for City Licenses were presented: C. C. Hill Ken Conzelman
It was moved by Commissioner Lowe, seconded by Commissioner Healy, that the applications be a~proved
and the lioenses issued and the motion was carried by the following Aye and No vote: those voting Aye
being Mayor Sorenson, Commissioner Lowe and Commissioner Healy; those voting No, none.
I Refort of Initial Inspeotion of Sewage Plant
A letter from Allan Wymore of the Burns & McDonnell Engineering Company was presented and read, tell-
ing of the initial inspection of the operation of the sewage treatment plant. and calling attention to
minor changes and suggestion for the completion and operation of the plant.
Request for Fire Truck at Airport
The Manager stated that on September 11th, 1949 a B-36 bomber and many other planes would be at
Gallatin F'ield. and that request has been made to have a fire truck stand by in case of an emergenoy. The
Commission approved the request.
A request for the Municipal Band to play during this time was tabled.
Audit Report for 1949
The Annual Audit Report of Douglas Wilson, Ferris Company of Great Falls. Montana was presented. It
was moved by Commissioner Healy, seconded by Commissioner Lowe. that the report be accepted and ordered
filed and the motion was carried by the following Aye and No vote: thOSe voting Aye being Mayor
Sorenson, Commissioner Lowe and Commissioner Healy; those voting No, none.
Police-Sheriff Radio
Members of the Board of County Commissioners were present to discuss the joint purchase of Police-
I Sheriff radio f'or the City of Bozeman and the County of Gallatin. It was agreed that the central equipment,
transmitter and receiver be purchased and maintained on an equal basis. and that other equipment necessary
for the proper operation of the equipment should be paid for by each governmental unit.
A lease between Malcolm C. & Rose A. Story and the City of Bozeman. and Gallatin County for land
upon which to erect a joint police-sheriff radio transmitting station and a building to house the same
together with a transmission pole for a period of five years was presented and read. It was moved by
Commissioner Healy, seconded by Commissioner Lowe, that the Mayor and the Clerk of the City Commission be
authorized to sign the lease for the City of Bozeman, and the motion was carried by the f'ollowing Aye and
No votet those voting Aye being Mayor Sorenson, Commissioner Lowe and Commissioner Healy; those voting
No, none.
Joint Resolution for Police-Sheriff' Radio
It was deoided that a joint resolution of the City of Bozeman and the County of Gallatin f'or the
purohase and maintenance of a police-sheriff radio should be drawn, and it was moved by Commissioner Lowe,
seoonded by Commissioner Healy. that the City Attorney be instructed to work with the County Attorney in
the preparation of such a joint resolution, and the motion was carried by the following Aye and No vote:
those voting Aye being Mayor Sorenson, Commissioner Lowe and Commissioner Healy; those voting No, none.
I Water Line Right-of-way f'or Sewage Flant
The City Manager was instructed to write the Board of County Commissioners requesting a right-of-way
easement in the county road extending north from Rouse Avenue for the installation of water line from the
City Limits to the Sewage Treatment Flant.
Canvass of ~rima.ry Election
The Clerk of the Commission presented the canvass of the election returns for the primary nominating
election held August 30th, 1949. The canvass was checked by the Commission, and found oandidates to have
received the following votes:

R. D. Lanphear 87 votes
Walter A. Seoor 161 votes
Chas. Wm. Sorenson 195 votes
It was moved by Commissioner Lowe, seconded by Commissioner Healy, that Walter A. Secor and Chas.
WID. Sorenson, having received the largest number of votes, be declared nominated for the offioe of City
Commissioner. and the motion was carried by the following Aye and No votet those voting Aye being Mayor
Sorenson, Commissioner Lowe and Commissioner Healy; those voting No, none.

The Manager stated that he has audited these olaims and finds them to be true and lawful claims
against the City of Bozeman and recommends that warrants be drawn for their payment. After examination
of the claims by the City Commission, it was moved by CommisSioner Lowe. seconded by Commissioner Healy
that the claims be approved and warrants drawn for their payment and the motion was oarried by the
following Aye and No vote: those voting Aye being Mayor Sorenson, Commissioner Lowe and Commissioner
Healy; those voting No, none.
Vacation of Streets and Alleys for Baseball Park I
The petition of Dr. R. A. Williams, presented at the last regular meeting, to vacate certain streets
and alleys in the Northern Pacific Addition. was given further consideration at this time. It was moved
by Commissioner Healy, seconded by Commissioner Lowe, that the City Attorney be instructed to prepare a
resolution of intention to vacate the streets and alleys as petitioned, and before final consideration of
said resolution a sketch plan of the proposed permanent development of the baseball park should be sub-
mitted for consideration, and the motion was carried by the following Aye and No vote: those voting Aye
being Mayor Sorenson, Commissioner Lowe and Commissioner Healy; those voting No, none.
Insurance for Sewage Plant
The matter of the type and amount of insurance that should be carried on the sewage treatment plant
was disoussed, and the City Manager was instructed to write to the Burns & McDormell Engineering Company
for their recommendations regarding insurance.
Con~issioner Lowe asked to be excused and permission was granted.
Bids for Mechanical Loader
The Manager reported that Commissioner Healy. Street Superintendent Springer and himself had gone
to see the Pettibone-Mulliken Loader as authorized at the last regular meeting, and they also had an
opportunity to see a Barber-Greene Loader, and that after caref'ul consideration of prices bid, the use I
to which the machines will be put to serve the city's needs, it was their recommendation that the bid of
the Seitz Machinery CompaLY for a Pettibone-Mulliken Loader be accepted as the best bid.
It was moved by Commissioner Healy, seconded by Mayor Sorenson, that the bid of the Seitz Machinery
Company for a Pettibone-Mulliken Loader, Model 5, Sl-eed Loader in the amount of $10,682.00, be accepted
with the following additions:
faint to oonform with other city equipment $30.00
Side wings for the feeder 96.00
Heater for the cab 42.00
and tha t the machine be furnished wi th a bucket-type feeder, and if this type of feeder does not ~295
prove satisfactory that a dragger-back feed be furnished by the bidder wit~~ut cost to the City, and
the motion was carried by the following Aye and No vote: those voting Aye being Mayor Sorenson and
Commissioner Healy; those voting No, none.
Adjournment
There being no further business to come before the Commission at this time, it was moved by
