Wednesday afternoon, September 7, 1949 at 1:00 o'clock f. M. Those being present were Mayor Sorenson, Commissioner Lowe. Commissioner Healy. City Manager Henderson. City Attorney Lovelace and the Clerk, when the following proceedings were had: The minutes of the last regular session were read, and it was moved by Corrnnissioner Lowe, seconded I by Commissioner Healy that the minutes be approved as read. and the motion was carried by the following Aye and No vote: those voting Aye being Mayor Sorenson. Commissioner Lowe and Commissioner Healy; those voting No, none. Jfroposed J'la t -- Don Langohr The City Engineer presented a suggested plat of ground east of Blocks 1, 7. 8 and 13. Butte Addition. The proposed plat was primarily to plat ground for Don Langohr in this area but showed an over all plan to include ground of two other owners. It was suggested that an attempt be made to get all three owners to join in platting this ground rather than to have it platted pieoemeal. Vacating Street & Alleys in N. F. Addition The City Attorney as instructed presented a resolution of' intention to vacate certain streets and alleys as petitioned by Dr. R. A. Williams. The Manager stated that Dr. Williams desires to proceed immediately with grading ground f'or his proposed Ball Park. He has not, however, completed planning for the east half of this tract. The Manager was instructed to inf'orm Dr. Williams that he could safely proceed with his grading but that the vacating of' streets would be def'erred until his plans are completed to cover this entire tract. Applications f'or City Licenses I The following applications for City Licenses were presented: May Stone Evan Bennett It was moved by Commissioner Healy. seconded by Commissioner Lowe. that the applications be approved and the licenses issued and the motion was carried by the following Aye and No votet those voting Aye being Mayor Sorenson, Commissioner Lowe and Commissioner HealYi those voting No, none. Reports The following reports for the month of August, 1949 were presented: Cashier i'olice Chief Fire Chief Librarian Sanitary Inspector It was moved by Commissioner Healy, seconded by Commissioner Lowe, that the reports be accepted and ordered filed and the motion was carried by the following Aye and No vote: those voting Aye being Mayor Sorenson, Commissioner Lowe and Commissioner Healy; those voting No, none. i'ublic Hearing S. I. D. No. 358 The Manager stated this was the time and place set for the public hearing of protests to the oreation of Special Improvement District No. 358, storm sewer in the first alley south of Main Street between Tracy Avenue and Bozeman Avenue. He presented the affidavit of publication of the Notice to I property owners, and the Clerk's mailing certificate that all property owners have been notified. He stated that no protests have been filed and no one is present to protest. It was thereupon moved by Commissioner Lowe, seoonded b;y Commissioner Healy, that the City Engineer prepare detailed specifications for the district and the City Attorney be instructed to prepare the resolution creating the district and the motion was carried by the following Aye and No vote: those voting Aye being Mayor Sorenson, Commissioner Lowe and Cowaissioner HealYi those voting No, none. Fublic Hearing -- 1949 Farking Maintenance Assessment The Manager stated this was the time and place set for the public hearing for the levying of the ---- - -.- 297 assessment for the maintenance of parkings for the year 1949. He presented the affidavit of publication of the Notice, and stated that no one was present to protest and no protests have been filed. He presented Resolution No. 655, entitled: A RESOLUTION OF' TIlE COMMISSION OF THE CITY OF BOZEMAN, LEVYING AND ASSESSING A SFBX:IAL ASSESSMENT OF TAXES UPON ALL THE FROi'ERTY IN SFECIAL IMPROVEMENT DISTRICTS OF '!HE CITY OF' BOZEMAN, COUNTY OF G ALLAT IN, STATE OF MONTANA, FOR THE MAINTENANCE OF PARKINGS TO DEFRAY TIlE COST OF MAIN TAINING THE i'ARKINGS WITHIN SAID SPECIAL IMPROVEMEN'r DISTRICTS OF THE CITY OF BOZEMAN FOR THE YEAR 1949. I It was moved by Commissioner Lowe, seconded by Commissioner Healy, that the resolution be finally passed and adopted and the motion was carried by the following Aye and No vote: those voting Aye being Mayor Sorenson, Commissioner Lowe and Commissioner Healy; those voting No, none. Joint Resolution No. 656. Folice-Sheriff Radio A joint resolution No. 656 and agreement between the City Commission and the Board of County Commissioners of Gallatin County for the purchase, maintenance and operation of a jointly-owned radio receiving and transmitting station was presented and read, entitled: AN AGREEMENT AND JOINT RESOLUTION OF THE CITY COMMISSION OF THE CITY OF BOZEMAN, MONTANA, AND OF THE BOARD OF COUNTY COMMISSIONERS OF GALLATIN COUNTY, MONTANA, IN REGULAR SESSION ASSEMBLED, ENTERING INTO .AN AGREEMENr BETWEEN SAID CITY COMMISSION OF THE CITY OF BOZEMAN, MONTANA, AND THE SAID BOARD OF COUNTY C01'!MISSIONERS OF GALLAT IN COUNTY, MONTANA, TO ESTABLISH, MAINTAIN, AND SUF- FORT A JOINTLY OWNED RADIO RECEIVING AND TRANSMITTING STATION FOR THE JOINT USE OF THE CITY OF BOZEMAN, MONTANA, POLICE DEPARTMENT AND THE OFFICE OF THE SHERIFF OF GALLATIN COUNTY, MONTANA, AND SFECIFICALLY FROVIDING WHAT PORTIONS THERIDF SHALL BE OWNED JOINTLY BY THE CITY Oli' BOZEMAN, MONTANA, AND THE COUNTY OF GALLATIN, Y.DNT AN A, AND WHAT PORTIONS THEREOF SHAlL BE SEFARATELY OWNED BY TIlE CITY OF BOZEMAN AND THE COUNTY OF GALLATIN, MONTANA. It was moved by Commissioner Healy, seconded by Commissioner Lowe, that the resolution be passed and adopted and the motion was carried by the following Aye and No vote: those voting Aye being Mayor Sorenson, Commissioner Lowe and Commissioner Healy; those voting No, none. Claim of Haggerty-Messmer Company I Claim #6743 of Haggerty-Messmer Company for the semi-final estiroote for the construction of the Sewage Treatment Flant was presented, in the amount of $40,784.49. A schedule of extra work totaling $2,072.99 was explained in detail by Mr. Fred Quinnell, i'roject Engineer and Frank Messmer of Haggerty- Messmer Company, together with credits for work omitted in an amount of $625.00. The claim also shows an amount of $1,000.00 held in reserve for minor corrections and adjustments to be made by the contractor, to be paid by the City of Bozeman when these are completed. After consideration, it was moved by Commissioner Healy, seconded by Commissioner Lowe that the claim be approved and a warrant drawn for its payment, and the motion was carried by the following Aye and No vote: those voting Aye being Mayor Sorenson, Commissioner Lowe and Commissioner Healy; those voting No, none. Claims for the Month Claims No. 6633 to 6742 and 6744 to 6799 inclusive were presented on the various funds as follows: General $ 11,996.47 Parking Meter 773.95 Water 5,851.07 SDS Construction 2,163.51 Library 770.70 Fark 2,186.96 Cemetery 266.05 Band 898.00 Garbage 379.47 I 80s Revenue 4,359.15 Cemetery Suspense 16.25 Police Reserve 86.15 Cemetery Ferm. Care 2,000.00 W-H Tax 1,544.80 Total - - - $33,292.53 The Manager stated that he has audited these claims and finds them to be true and lawful claims against The City of Bozeman, and recommends that warrants be drawn for their payment. After examination of the claims in detail by the City Commission, it was moved by Commissioner Healy, seconded by Commissioner Lowe that the claims be approved and warrants drawn for their payment and the motion was carried by the .-~ 298 following Aye and No vote: those voting Aye being Mayor Sorenson, Commissioner Lowe and Commissioner Healy; those voting No, none. Gas & flumbing Bond of Montana Air Conditioning Co. The continuation certificate of the Gas Fitter's bond and the Flumbing bond of the Montana Air Conditioning Company were presented. The certificates were apFroved as to form by the City Attorney, whereupon it was moved by Commissioner Healy, seconded by Commissioner Lowe, that the certificates be I approved and accepted and the motion was carried by the following Aye and No vote: those voting Aye being Mayor Sorenson, Commissioner Lowe and Commissioner Healy; those voting No, none. Communication Re: Completion of Heating Equipment at Swimming; Fool A communication from R. J. Frussing, Mechanical Engineer, for the installation of the heating equipment at the swimming pool, was read. The letter called attention to the uncompleted work of the installation, and final checking which can not now be made until next season, and suggested that the Ci~ get written assurance from the contractor that this work will be completed. Request to Use Scout Cabin The Manager stated that Reverend Guy Fry. assistant Pastor of the Grace Gospel Tabernacle, has made a request to use the Scout Cabin on Tuesday evenings during the coming winter season for a boys' club sponsored by their organization. It was moved by Commissioner Healy, seconded by Commissioner Lowe, that the request be conditionally granted and subject to revocation by the City Commission and the motion was carried by the followir.g Aye and No vote: those voting Aye being Mayor Sorenson, Commissioner Lowe and Commissioner Healy; those voting No, none.
