September 14, 1949 The Commission of the City of Bozeman met in rel;;ular session in the Commission Room, City Hall Building, Wednesday afternoon, September 14, 1949 at 1:00 o'clock P. M. Those being present were Mayor So renson, Commissioner Lowe, Commissioner Healy, City Manager Henderson, City Attorney Lovelace and the acting Clerk, when the following proceedings were had: I The minutes of the last regular session were read, and it was moved by Commissioner Lowe, seconded by Commissioner Healy that the minutes be approved as read, and the motion was carried by the following Aye and No vote: those voting Aye being Mayor Sorenson, Commissioner Lowe and Commissioner Healy; those voting; No, none. Building Request - Smith Motors King Smith of Smitll Motors ap~eared before the Commission and requested permission to locate a temporary frame building, approximately 10 ft. by 10 ft. on the vacant lot along their main building at Bozeman Avenue and M$ldenhall. This lot is to be used as a used car lot and the proposed building will be used as a sales office. It was pointed out that this location is in Fire Zone No. 2 and a frame building located there would be in violation of the Fire Ordinance. It was also pointed out that this building is on skids and of a temporary nature and would be located at not less than 25 ft. from any other building. After consideration it was moved by Commissioner Healy, seconded by Commissioner Lowe, that the request of Mr. Smith be granted, and the motion was carried by the following Aye and No vote: those voting Aye being Mayor Sorensonl Commissioner Lowe and Commissioner Healy; those voting; No, none. Re InsuranCe on Sewage Treatment Plant City Manager Henderson read a letter from Burns and McDonnell in anSwer to his inquiry concerning I types and amounts of insurance they would recorrunend on the Sewage Treatment Flant. This letter pointed out that of the hazards of fire, earthquake, explosion, and others, explosion was the most serious. In view of' the fact that the estimated premium would be about $750.00 per year, their recommendation was that the City carry its own insurance on this plant. Mr. Henderson stated that he would discuss this matter further wi th the 100 al agents, end would report their recommendations to the Commission at a later date. flat - Property of Dr. Williams Dr. R. A. Williams was present and presented a sketch of a proposed re-arrangement of a portion of Northern Pacific Addition on part of which he plans to build a ball park. It was moved by Commissioner Lowe, seconded by Commissioner Healy, that this sketch be approved, it being understood that no final action can be taken on this matter until a proper plat is made and presented for apfroval as provided by law, and the motion was carried by the following Aye and No vote: those voting Aye being Mayor Sorenson, Commissioner Lowe and Commissioner Healy; those voting No, none. Reports The following reports for the month of August were presented: Director of Finance Cemetery Board Building Inspector Recreation Director I Also a report by the Recreation Director of the operation of the swimming pool for the 1949 season and his outline of proposed recreational activities during the winter of 1949-50. It was moved by Commissioner Healy, seconded by Commissioner Lowe, that the reports be accepted and ordered filed and the motion was carried by the following Aye and No vote: those voting Aye being Mayor Sorenson, Commissioner Lowe and Commissioner Healy; those voting No, none. Gratuities for Folicemen from Cole Bros. Circus City Manager Henderson reported that Cole Bros. Circus which showed in Bozeman on September 9th had been charged a license of $l60.00. The License Ordinance provides a 1 icense for circuses of' $100.00 for 300 the first Ring and $60.00 for each additional Ring. The Manager explained that these license fees are normally adjusted and that Cole Bros. had been charged $l60.00 license at their last showing in Bozeman. He had therefore approved the issue of the license for them in the same amount this year. After the last performance of this circus on September 9th the manager came to Chief of Folice Haas and presented him with fifty ($50 .00) dollars which he stated was to be divided $25.00 for Chief Haas and $25.00 fbr the other policemen who had been on duty around the circus area, and was in ap~reciation I of the good work which they had done. It being the fixed policy of this City that police officers can not accept rewards, gratuities or pay for police services except from the City of Bozeman unless approved by the City Manager, Chief Haas had turned this money over to the City. It was moved by Commissioner Lowe, seconded by Commissioner Healy, that Chief Haas be commended for his action, for turning th is money over, and that the money be turned back to him for distribution to himself and other policemen as recommended by the circus manager and the motion was carried by the following Aye and No vote: those voting Aye being Mayor Sorenson, Commissioner Lowe and Commissioner Healy; those voting No, none. Police Radio City Manager Henderson discussed specifications which had been prepared on radio equipment to be purchased jointly by the City and Gallatin County_ He pointed out that these specifications call for equipment to do a certain job rather than for equipment of some specific size and provide further that the company selling the equipment will furnish a bond to guarantee such performance. i'roposed Gift of' Land by Verne Ballantyne for Park 'r'he Manager informed the Commission that Mr. Verne Ballantyne has reconsidered his offer to deed Block 20 of Normandy Rearrangement West Side Addition to the City of Bozeman for park purposes. 1\11 il e he agreed in open commission meeting on August 17th to the conditions on which the City would accept I this ground. he has now decided that unless the area is named Ballantyne Park he will not deed it as agreed. The City Commissioners expressed themselves individually as being willing to go through with the agreement reached on August 17th but that they were not interested if the terms of the agreement were to be changed. Applications for City Licenses The following applications for City Licenses were presented: Home Construction Co. Bozeman Bit & Spur Club {Slot Machine} It was moved by Commissioner Healy. seconded by Commissioner Lowe, that the applications be approved and the licenses issued, and the motion was carried by the following Aye and No vote: those voting Aye being Mayor SorenSon, Corrunissioner Lowe and Cowmissioner Healy; those voting No, none. Resolution No. 657 Creating S. I. D. No. 358 The Manager stated that the City Attorney as instructed had prepared the resolution creating Special Improvement District No. 358. He presented Resolution No. 657, entitled: A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF BOZEMAN CREATING A SPECIAL IMPROVEMENT DISTRICT TO BE KNOWN AS Sf'ECI.AL IMJlOOVEM:WT DISTRICT NUMBER 358 OF THE CITY OF BOZEMAN FOR THE FURPOSE OF CONSTRUCTING AND INSTALLING A STORM SEWER IN THE FIRST ALLEY SOUTH OF EAST MAIN STREET BETWEEN SOUTH BOZEMAN AVENUE AND SOUTH TRACY AVENUE IN SAID CITY. It was moved by Commissioner Lowe, seconded by Commissioner Healy, that the resolution be passed and I adopted and September 28th be set as the date for opening of bids and the motion was carried by the following Aye and No vote: those voting Aye being Mayor Sorenson, Commissioner Lowe and Commissioner Healy; those voting No, none.
