HomeMy WebLinkAbout1949-09-21 302 Bozeman, Montana September 2l, 1949 The Connnission of the City of Bozeman met in regular session in the Conunission Room, City Hall building, Wednesday afternoon, September 21, 1949 at 1:00 o'clock F. M. Those being present were Mayor Sorenson, Commissioner Lowe, Commissioner Healy, City Manager Henderson, City Attorney Lovelace and the Clerk, when the following proceedings were had: The minutes of the last regular session were read, and it was moved by Commissioner Healy, I seconded by Commissioner Lowe, that the minutes be approved as read and the motion was carried by the following Aye and No vote: those voting Aye being Mayor Sorenson, Commissioner Lowe and Commissioner Healy; those voting No, none. Ballantyne Offer of Block 20 W. S. Addition for Park Furposes Mr. Verne Ballantyne, who has offered Block 20 of Normandy Rearrangement of West Side Addition to the City of Bozeman for park purfoses, was present to further discuss his proposal. Since Mr. Ballantyne had tentatively withdrawn his offer at the last meeting of the City Commission, there was no action taken at this time but the matter was held open for one week before final withdrawal of the offer by Mr. Ballantyne or rejection or acceptance of the offer by the City of Bozeman. Bond of A. W. Coleman The bond of Archie '\'i. Coleman as Plumbing & Gas Inspector and Assistant Building Inspector in the amount of $1,000.00 was presented. The bond was approved as to form by the City Attorney, whereupon, it was moved by Commissioner Healy, seconded by Commissioner Lowe, that the bond be accepted and ordered filed and the motion was carried by the following Aye and No vote: those voting Aye being Mayor Sorenson. Commissioner Lowe and Commissioner Healy; those voting No, none. Leak in Basement at Montgomery-Ward Co. I A conununication from Earl Dawes, of Dawes Properties, Inc., was presented and read requesting the City of Bozeman to make repairs to frevent leaks into the basement of the building occupied by Montgomery-Ward & Co., at Main Street and Bozeman Avenue. In discussion it was pointed out that, at the location in question, the basement is built under Bozeman Avenue the full width of the sidewalk. Investigation shows that there have been leaks around an ornamental street light pole or around cables connecting the street light at this point but, since this installation is entirely on street area and the basement encroaches ten feet or more on street area, it was not considered a responsibility of the City to make repairs as requested. On advice of the Gi ty Attorney, the City Manager was instructed to write to Dawes Froperties, Inc. to inform them that the City of Bozeman will assume no responsibility for leaks into the basement or for damage from such leaks as may occur at the point in question. Additions at Sewage Flant A communication from Burns & McDonnell Engineering Co. regarding engineering costs for chaI~es, extras or additions to the sewage llant construction contract was presented and read. After discus- sion, it was decided to leave the matter up to Burns & McDonnell Engineering Company as to any adjust- ments on the engineering costs because of these additions. Cleim oi Dorr & Company I Claim No. 6800 of the Dorr Company in the amount of $4,236.00, balance due on equiflnent f~rnished The City of Bozeman for the sewage treatment plant was presented and examined by the City Commission. It was moved by Commissioner Lowe, seconded b;y Corruniss ioner Healy, that the claim be a.pproved and e. warrant drawn for its payment and the motion was carried by the following Aye end No vote: thos e voting Aye being Mayor Sorenson, Conunissioner Lowe and Commissioner Healy; those voting No, none. ietition for Sanitary Sewer -- North Black A peti tion from property owners requesting that a Special Improvement Di.strict be created for the 303 Furpose of installing a sanitary sewer on North Black Avenue from Cottonwood to Tamarack was presented. It was moved by Commissioner Healy, seconded by Commissioner Lowe, that the City EnGineer prepare estimates of costs and based on these estimates the City Attorney be instructed to prepare the resolution of intention to create the district and the motion was carried by the followinG Aye end No vote: those voUng Aye being Mayor Sorenson, Commissioner Lowe and Commissioner Healy; those voting No, none. Housing Project I Housing conditions in Bozeman were discussed. The Manager fresented a l'ublication on the Federal Housing Act of 1949. He stated that Howard Irwin, Manager of the American Legion Housing Project, informs him that the number of applicants for living quarters continues to increase. The Manager was instructed to write to the Federal Housing Authority to get full information on havinG a housing survey made in Bozeman and on what would be necessary to set up a new Federal Housine; froject in this city. Resolution No. 658 -- Lighting Assessment The resolution levying the assessment for the various lighting districts for the year 1949 in the runount of $l,854.02 was presented, entitled: A RESOL1JTION OF THE COlVIMISSION OF THE CITY OF BOZEMAN, MONTANA, L1""'VYING AND ASSESSING LIGHTING DISTRICT MAINTENANCE AND ELECTRICAL CURRSNT COSTS :F'OR SfECIAL IMFROVEMENT LIGHTIKG DISTRICTS NtlMBERS 100, 284. 288, 289, 290. 295, AND 300 OF THE CITY OF BOZEMAN. fURSUANT TO THE PROVISIONS OF SECTIONS 5266 R. C. M., 1935. It was moved by Commissioner Healy, seconded by Commissioner Lowe, that the resolution be pro- visionally passed and September 28th, 1949 be set as the date for the hearing of l'rotests and the motion was carried by the followinG Aye and No vote: those voting Aye being Mayor Sorenson. Commissioner Lowe and Co~~issioner Healy; those voting No, none. Resolution No. 659 -- Sprinkling Assessment I A resolution levying the assessment for sprinkling District No. 1 for the year 1949 in the amount of $1,l87.85 was presented, entitled: A RESOLUTION OF THE COMMISSION OF THE CITY OF BOZEMA.L~ LEVYING A'tIJD ASSESSING A SfECIAL .ASSESSM}~Nr OF' TAXES UFON .ALL THE fROFERTY IN STREET SIRINKLING DISTRICTS OF THE CITY OF BOZEMAN, COUNTY OF GALLATIN, STATE OF MONTANA, TO DEFRAY SEVENTY-FIVE FERCENT OF THE COST OF Sf'RINKLING STI?EETS WITHIN SAID STREET SI'RINKLING DISTRICTS OF' THE CITY OF BOZEMAN FOR THE YLAR 1949. It was moved by Corrunissioner Lowe, seconded by Commissioner Healy, that the resolution be pro- visionally adopted and September 28th, 1949 be set as the date for the hearing of protests and the motion was carried by the followinG Aye and No vote: those voting Aye being Mayor Sorenson. Commissimler Lowe and Commissioner Healy; those voting No, none. Snow & Weed Assessment for 1949 Waived The Manager stated that the City's cost for cutting weeds during 1949 was $56.00, and the cost of the removal of snow was $63,25 of which $9.88 was assessable to City property. After consideration by the City Commission, it was moved by Commissioner Healy, seconded by Commissioner LOWe that. in view of the small amount involved and the cost of making the assessment, this cost be absorbed as maintenance work for the year 1949, and the motion was carried by the following Aye and N0 vote: those voting Aye being Mayor Sorenson, Commissioner Lowe and Commissioner Healy; those voting No, none. I Report The report of the City Engineer for the month of August, 1949 was presented. It was moved by Cornrniss ioner Healy, seconded by Commissioner Lowe, that the report be accepted and ordered fi led and the lootion was carried by the following Aye and No vote: those voting Aye being Mayor Sorenson, Commissioner Lowe and Commissioner Healy; those voting No, none. Bids for W & C 1949 The Manager stated that this was the time and place set for the opcming of bids for the construction of new sidewalk and cross walks, and the repair of sidewalks for 1949. He presented the ai'f'idavi t of 304. publication of the Notice to Contractors, and stated that no bids have been filed and no one is present to bid. It was decided that in view of the lateness of the season the bids be held in abey- ance until weather conditions are more favorable and the Clerk be instructed to readvertise at that time. Storm Sewer for State Highway Yards The Manager stated the State Highwa.y Commission plans to install equipment for cleaning and wash- ing road equipment, and have asked for a sewer connection for the floor drain in one of their buildings I on North Rouse Avenue. It wa.s decided that it would be unsatisfactory to connect a drain of this kind to the sanitary sewer and there is no storm sewer at or near the location. A suggested plan is to run a storm sewer from the building to Bozeman Creek. It was decided that such an installation will be approved provided a proper sump is built in the floor of the building and necessary precautions taken so that quantities of oil or grease would not be emptied into the proposed sewer and create an unsani- tary or unsatisfactory condition along Bozeman Creek below the outlet of the sewer. Resignation of Mrs. Jesse Bradley from Recreation Board The written resignation of' Mrs. Jesse Bradley 8.S a member of the Recreation Board was presented and read. It was moved by Commissioner Healy, seconded by Commissioner Lowe, that the resignation be accepted, and the appointment to fill this vacancy be deferred until a later meeting and the motion was carried by the following Aye and No vote: those voting Aye being Mayor Sorenson, Commissioner Lowe and Commissioner Healy; those voting No, none.
