M. Those LeinL I,resent were Mayor Sorenson, Commissioner Lowe, Commissioner Healy, City Manager Henderson, City Attorney Lovelace and the Clerk, when the following proceedings were had: I The minutes of the last regular session were read, and it was moved by Commissioner Healy, seconded by Conunissioner Lowe, that the minutes be afproved as read and the motion was carried by the following Aye and No vote: those voting Aye being Mayor Sorenson, Commissioner Lowe and Commissioner Healy; those voting No, none. Advertising on Parking Meter fosts A. E. Beethem and Mr. Harr, representin& Beetham Sales Co., Fortland, Oregon, appeared before the Commission with a profosal to sell advertising signs to be mounted on parking meter posts. They prol-,osed to have a local representative who woulc sell the advertising, service the signs, make all collections, and pay the City 15% of the gross income. They estimated the. t they could sell advertising under such a plan that would bring an income of from t200.OO to $350.00 per month to the City. After consideration by the City Commission the gentlemen were informed that this City would not be interested in their proposal at this time. Bids for folice-Sheriff' Radio Equipment At l:30 1'. M. the meeting was recessed and the Commission Dllit in joint session with the 00unty Commissioners in the Gallatin County court house to open bids on radio equipment in accordance with a joint agreement made between the City Commissioners and the County Commissioners on September 7, 1949. I The fbllowing bids were received and opened: Motorola, Inc. $4,506.00 Packard-Bell 4,717.75 Federal 4,738.00 The bids were referred to Sheriff Rice and Chief of Folice Haas for checking, tabulation and for their recommenda tion. The City Commission resumed their regular meeting i.n the Commission Room, C1 ty Hall Building; at 2:30 r. M. Bids for S. 1. D. No. 358 The Manager stated this was the time and place set for the opening of bids for the COnstruction of Special Improvement District No. 358, storm sewer in the fi rst alley south of Main Street between Tracy Avenue and Bozeman Avenue. The Manager Fresented the aff'idavit of publication of the Notice to Bidders, whereupon it was moved by Commissioner Lowe, seconded by Commissioner Healy, that the bids be opened and read and the motion was carried by the following Aye and No vote: those voting Aye being Mayor Sorenson, Commiss ioner Lowe and Commissioner Healy; those voting No, none. Bids of the Blacktop Construction Company and Standard Construction Company were thereupon opened and read. It was moved by Commissioner Healy, seconded by Commissioner Lowe, that the bids be referred I to the City Engineer for tabulation anc checking, and the motion was carried by the following Aye and No vote: those voting Aye being Mayor Sorenson, Commissioner Lowe and Commissioner Healy; those votinG No, none. The City Engineer reported that after checking end tabulating the bids they were found to be as follows: Blacktop Construction Company, Bill ings $3,l46.70 Standard Construction Company, 30zeman 3,311.70 The City Engineer also reported that specifications on this project required that bids be accompanied by a certified check or other acceptable bid securi ty in an amount of not less than 10~;; of the total bid. 306 The bid of the Blacktop Construct.ion Company was accompanied by a certified check of only $150.00 and $10.00 in cash and therefore did not comply with the specifications. Consideration was given to rejection of all bids but. in view of the lateness of the season, the importance of constructing the sewer before winter, and the small difference in the bids, it was moved by Commissioner Lowe, seconded by Commissioner Healy, that the bid of the Blackt.op Construction Co. be rejected because of the insufficiency of their bid security and their bid security be returned, that I the bid of the Standard Construction Co. be accepted, and that the Clerk of the Commission be authorized to advertise for the sale of bonds of Special Improvement District No. 358 and the motion was carried by the following Aye and No vote: those voting Aye being Mayor Sorenson, Commissioner Lowe and Commis- sioner Healy; those voting No, none. Wi thdrawal of Offer of Block for :Park Purposes The following communication was read from '{ern Ballantyne withdrawing his offer of Block 20, Normandy Rearrangement of West Side Addition, to the City of Bozeman for park, recreational and educa- tional purposes: September 28, 1949 Honorable Mayor and City Commission Ci ty of Bozeman Gen tlemen: Reference is mRde to my offer of August 3rd to donate to the City Block 20 of the Normandy Rearrangement for park purposes under certain specified conditions. In consideration of the fact that the Commission 118S not accepted these conditions, this is to notify the Commiss ion of the wi thdrawa.1 of the offer as of this date. Studar of the Blacktop Construction Company, was present to report on the progress of the paving in Special Improvement Districts now under construction. He stated that shortage in gravel, which he had crushed for base coarse, rejection in chips which he contemplated in using and other matters beyond his control had delayed the completion of District Nos. 349, 351, 353 and 354 longer than he had eXFected but that he definitely would have th.'Jse districts completed within ten days. He also pointed out that there was some question 8.S to what should be considered the official completion date as specified in the contract on these districts. After discussion by the Conunission and on agreement with Mr. Studer, it was moved by Gonunissioner Healy, seconded by Commissioner Lowe, that October 8, 1949 would be accepted as the fine.1 completion date on each of the above listed Special Improvement Districts and that penal- ties would be imposed on the contractor in accordance with the contract for each day after October 8, 1949 when each or any of these contracts remains uncompleted and the motion was carried by the following Aye and No vote ~ those voting Aye being W~yor Sorenson, COIlunissioner Lowe and Conunissioner Healy; those voting; No, none. I fublic Hearing Lighting Districts The Manager stated this was the time and f18 ce set for the hearing of protests to levying; the assessment for lighting maintenance for tile various lighting districts for the year 1949. He Ixesented the affidavit of publication of the Notice, and stated the. t no protests have been filed and no one is present to protest. FURSUANT TO THE FROVISIONS OF' SECTIONS 5266 R. c. M., 1935. 307 It was moved by Conunissioner Healy, seconded by COlTunissioner Lowe, that the resolution be finally passed a.nd adopted and the motion was carried by the following Aye and No vote: those votinr; Aye being Mayor Sorenson, Commissioner Lowe and Commissioner Healy; those voting No, none. Fublic Hearing for Sprinkling Assessment The Manager stated this was the time and place set for the public hearing of protests to the levy- ing the assessment for the sprinkling assessment for the year 1949. He presented the affidavit of publica- I tion of the Notice, and s_tated that no protests have been filed and no one is present to protest. He presented Resolution No. 659, entitled: A RESOLUTION OF THE COMMISSION OF THE CITY OF BOZ~,~AN LEVYING AND ASSESSING A SFECIAL ASSESSIvIENT OF TAXES UPON ALL THE FROFERTY IN STREET SFRINKLING DISTRICTS OF THE CITY OF BOZEMAN, COUNTY OF GALLATIN, STATE OF' MONTANA, ro DEFRAY SEVENTY-FIVE PERCENT OF TIIE COST OF SIRINKLING STREETS WITHIN SAID STREET SfRINKLING DISTRICTS OF TI-IE CITY OF EOZEMAK FOR TIlE YEAR 1949. It was moved by Corrunissioner Lowe, seconded by Corrunissl.oner Healy. that the resolution be finally passed and adopted and the motion was carried by the following Aye and No vote: those voting Aye being Mayor Sorenson, COPl.'1lissioner Lowe and Commissioner Healy; those voting No, none. Housing froject The Manager stated that he had wri tten to the Seattle office of the Federal Housing Authority, and had been informed by telephone that a representative would not be in Bozeman until December of this year, b'ilt the City of Anaconda. has recently set up a housing project and the necessar;y information could be obtained from that City. It was moved by Commissioner Healy, seconded by Commissioner Lowe, that it being in the public interest that the City Manager be authorized to visit the City of Anaconda to get information on the establishing a housing project for the City of Bozeman, and the motion was carried by the following Aye and No vote: those votinG Aye being Mayor Sorenson, Commissioner Lowe and Commis- I sioner Healy; those voting No, none. furchase of Radio Equipment A letter from A. N. Haas, Chief of Police and C. E. Rice, Sheriff of Gallatin County, was read in which it was recommended that the bid of Motorola, Inc., be accepted for furnishing radio equipment to the Ci ty of Bozeman and Gallatin County, for Four Thousand Five Hundred Six and no/100 Dollars ($4, 506.00) , in accordance wi th their detailed proposal submitted to the County Corrunissioners of Gallatin County on tLis date. It was moved by Commissioner Lowe, seconded by Commissioner Healy, that the County Conunissioners of Gallatin County be authorized to accept the bid of Motorola, Inc., and that The City of Bozeman pay direct to Motorola, Inc. , the sum of One Thousand Nine Hundred Ninety and 50/100 Dollars when the equip- ment has been installed in accordance with the joint agreement made between the County Commissioners of Gallatin County and the City Commission on September 7th, 1949 and in accordance with the specifications under which the bid of Motorola, Inc., was submitted on this date, and the motion was carried by the following Aye and No vote: those voting Aye being Mayor Sorenson, Corrunissioner Lowe and Corrunissioner Healy; those voting No, none.
