The Commission of The City of Bozeman met in regular session in the Commission Room, City Hall Build-
ing, Wednesday afternoon, October 19th, 1949 at 1:00 o'clock P. M. Those being present were Mayor
Sorenson, Commissioner Lowe, Commissioner Healy, City Manager Henderson, City Attorney Lovelace and the
Clerk, when the following proceedinEs were had:
The minutes of the last regular session were read, and it was moved by Commissioner Lowe, seconded I
by Commissioner Healy, that the minutes be approved as read and the motion was carried by the following
Aye and No vote: those voting Aye being Mayor Sorenson, Commissioner Lowe and Commissioner Healy, those
voting No, none.
Resolution No. 661 -- Final Passage
The Manager stated that this was the time and place set for the hearing of protests to the final
passage and adoption of Resolution No. 66l, levying the assessment for the disposal of garbage for the
year 1949. He presented the affidavit of publication of the }lotice, and stated that no protests have
been filed and no one is present to protest. He presented Resolution No. 66l, entitled:

It was moved by Commissioner Healy, seconded by COlrunissioner Lowe, that the resolution be finally
passed and adopted and the motion was carried by the following Aye and No vote: those voting Aye being
Mayor Sorenson, Commissioner Lowe and Commissioner Healy; those voting No, none.
Resolution No. 662 -- Final Passage
The Manager stated this was the time and place set for the hearing of protests to the final passage I
and adoption of Resolution No. 662, levying the assessment for the construction of Special Improvement
District No. 345, water main on North Tracy and Tamarack Street. He presented the affidavit of publica-
tion of the Notice, and stated tlmt no protests have been filed and no one is present to protest. He
presented Resolution No. 662 entitled:

The Manager stated that this was the time and place set for tt e hearing of protests to the final

347, water mains on North Fourth, North Fifth and Durston Road. He presented the affidavit of publica-
tion of the Notice, and stated that no protests have been filed and no one is present to protest. He

Resolution No. 665 -- Final Fassage
The Manager stated that this was the time and place set for the hearing of protests to the final

It was moved by Commissioner Lowe, seconded by Commissioner Healy, the. t the resolution be finally

I Sewer Connection for Culligan Soft Water Service
The matter of a sewer connection for the Culligan Soft Water Service, 815 West Main Street, Was
again discussed. The Manager read a communication from D. E. Hagemann, City Controller of the City of
Billings, giving the average use of water for a similar plant in Billings as 27,000 cubic feet per month,
and stating this plant has not given any trouble and there has been no harm to the sanitary sewer in the
waste material from this plant. After discussion it was decided that before a sewer connection is made
for the Culligan Soft Water Service that an agreement be made between the City of Bozeman and Mr. Duaine
Straiton covering the following points:
1. That the City reserves the right to 11mi t the amount of water or waste put into the SeWer
system.
2. That an approved floor sump be installed.
3. That, if at any time in the future a storm sewer is installed that would serve this build-
ing, the floor and roof drains shall be disconnected from the sanitary sewer and connected
to the storm sewer at the expense of the owner.
4. The owner of this l,roperty having had a well drilled and it being assumed that
it is the intention to use water from this well to supplement the City water supply,
detailed I-lans for any connection between this well and the City water sUPfly
must be presented to and approved by the City of Bozeman before such connection
is made.
5. That if water f'rom the well on this property is used and discharged into the City's sewer, the
I well must be equipped with a meter, at the owner's expense, so that the amount of well water
may be measured as a basis for charging sewer rental.
After discussion, it was n~ved by Commissioner Lowe, seconded by Commissioner Healy, that subject
to Mr. Straiton signing an agreement covering the above points that permission be granted to connect to
the sanitary sewer, and the motion was carried by the following Aye and No vote: those voting Aye being
Mayor Sorenson, Commissioner Lowe and Commissioner Healy; those voting No, none.
Reports
The report of the Chief of ~olice for the month of September, 1949 was presented. It was moved by

Commissioner Healy, seconded by Commissioner Lowe, that the report be accepted and ordered filed and
the motion was carried by the following Aye and No vote: those voting Aye being Mayor Sorenson, Commis-
sioner Lowe and Commissioner Healy; those voting No, none.
Appointment of Henry Gay to iolice COlnmission
The City Manager announced the re-appointment of Henry M. Gay as a member of the F01ice Commission
for a three year term ending May 1, 1952. It was moved by Commissioner Lowe, seconded by Cornmissioner
Healy, that the appointment be approved and the motion was carried by the following Aye and No vote: I
those voting Aye being Mayor Sorenson, Commissioner Lowe and Commissioner Healy; those voting No, none.
Bond of Standard Construction Company for S. I. D. No. 358
The bond of the Standard Construction Company for the construction of Special Improvement District
No. 358 was presented. The bond was approved as to form by the City Attorney, whereupon, i1; was moved
by Commissioner Lowe, seconded by Commissioner Healy, that the bond be accepted and aI-proved and the
motion was carried by the following Aye and No vote: those voting Aye being Mayor Sorenson, Commissioner
Lowe and Commissioner Healy; those voting No, none.
Widening Babcock Street between Tracy and Willson Avenues
The Manager reported that the cost of widening Babcock Street between Willson and Tracy Avenues
during December of 1949 was ap~roximately $2,750.00. This would not include cost of lumber for con-
crete forms as that lumber was re-used for other purposes.
Furnishing Water Service and Sewer Connection to Unplatted Froperty
The question has coroo up on numerous occasions as to what action should be taken on requests from
owners of property adjacent to the City Limits to conrect their properties to the City's water and
sewer systems. The question was discussed at length and the Commission agreed on the following policy:
1. The City is opposed to extending water or sewer service to any property outside the City I
Limits.
2. Under exceptional circumstances owners of property outside the City Limits may be allowed
to connect to the City water and sewer system provided they pay an amount proportionate as
to the size of their property to what owners' property within the City would be required to
pay for having sewer and water mains extended to serve their property.
3. No connectiOn with the City's water or sewer system shall be made to any property outside
the City Limits of Bozeman without the approval of the City Commission.

There being no further business to come before the Commission at this time, it was moved by Comrnis-
sioner Lowe, seconded by Commissioner Healy, that the meeting adjourn and the motion was carried by
the following Aye and No vote: those voting Aye being Mayor Sorenson, Commissioner Lowe and Commissioner
