HomeMy WebLinkAbout1949-11-02 320 Bozeman, Montana November 2, 1949 The Commission of The City of Bozeman met in regular session in the Commission Room, City Hall Building, Wednesday afternoon, November 2nd, 1949 at 1:00 o'clock P. M. Those being present were Mayor Sorenson. Commissioner Lowe. Commissioner Healy, City Manager Henderson, City Attorney Lovelace and the Clerk, when the followinc proceedings were had: The minutes of' the hlst regular session were read, and it W8.S moved by Commissioner Lowe, I seconded by Comilli ssioner Healy, that the minutes be approved as read and the motion was carri ed by the following Aye and No vote: those voting Aye being; Mayor Sorenson, Commissioner Lowe and Commissioner Healy. those voting No, none. Public Hearing S. I. D. 359 The Manager stated that this was the time and place set for the hearing of protests to the creation of Special Improvement District No. 359. sanitary sewer on North Black Avenue from Cottonwood to Tamarack Street. He presented the affidavit of publication of the Notice and the Clerk's mailing certificate that all property owners have been notified. He stated that no protests have been filed and no ODe is present to protest, wher,~upoD, it was moved by Commissioner Healy, seconded by Commissioner Lowe that the City Attorney be instructed to prepare the resolutior. creating the di.strict and the City Engineer be instructed to prepare the pllms and specifications for bidding, and the motion was carried by the following Aye and No vote: those voting Aye beine; Mayor Sorenson, Commissioner Lowe and Corrunissioner Healy, those voting; No, none. Extension of 'l'ime for Sewer Connection A communication from Mrs. I'. C. Poynter, requesting an extension of time in which to make the sewer connection at 414 Montana was Ii resented and read; she stated that this connection will be made I in the S:pring 0 f 1950 or before. After consideration. it was moved by Commissioner Healy, seconded by Corrnnissione r Lowe, that an extensi on of six months be granted and the motion was carried by the followin[ Aye and No vote: those votin!j Aye being Mayor Sorenson. Commissioner Lowe and Commi ssioner Healy, those voting No, none. Application for City License The apllication for slot machine licenses for five machines for the Kegler's Club was presented. It was moved by Commissioner Healy. seconded by COIranissioner Lowe, that the arplication be 81.. proved and the license issued and the motion was carried by the following Aye and No vote: those voting Aye being Mayor Sorenson, Commissioner Lowe and Commissioner Healy, those voting No, none. Acijustments on Sewer Rental -- Gallatin Laundry. Linfield's Studio M. J. O'Connell. representing the Gallatin Laundry. was present to discuss the sewer rental being lcaid by the organization, and requested an adjustment on this charge. He stated that three toilets are connected to the sanitary sewer and all other waste from the laundry is put into the storm sewer, and not treated at tile sewage tr~atment plant. It was Iointed out that. while not all the waste from the laundry is put into the sanitary sewer, the City does take care of the waste from the laundry through either the sanitary sewer or the storm sewer system. I After cons idera tion by the Corrunission. it was moved by Cornnissioner Healy, seconded by Commissioner Lowe, tha t the basis of sewer rental for the Galla tin Laundry be 40% of thei r averac;e bill for the four winter months over a period of three years. and the motion was carried by the following Aye and No vote: those voting Aye being Mayor Sorenson, Commissioner Lowe and Commissioner Healy, those voting No, none. The matter of the sewer charge for Linfield's Studio, 109 South Willson. was discussed. It was shown that the average bill for water used during the four winter months is $4.88, while the average bill for the entire year is $4.42. because the w1nter months are the months which he does most of his 321 business. It was stated that the sewer rental is figured on the four winter months as these are con- sidered the months that the minimum amount of water is used by the consumer. After consideration, it was moved by Commissioner Lowe, seconded by Commissioner Healy, that the sewer rental for linfield's Studio, 109 S. Willson be determined on the average yearly usage and the motion was carried by the following Aye and No vote: those voting Aye being Mayor Sorenson, Commissioner Lowe and Commissioner He~y, those I voting No, none. Sale of Bonds S. I. D. 358 The Manager stated that this was the time and place set for the sale of the bonds of Special Improve- ment District No. 358. He presented the affidavit of publication of the Notice of the Sale, and stated that no written bids have been received, whereupon, the Mayor called for oral bids. The following bi ds were then heard: Fred M. Brown par 6% interest H. Howell par 5.5% interest Fred M. Brown par 5.5% interest with 251 premium Frank Mes smer par 5.5% interest with 501 premium Fred M. Brown par 5.5% interest with $1.00 premium H. Howell par 5% interest Fred Brown par 5% interest with 251 premium H. Howell par 4.9% interest Fred M. Brown par 4.9% interest with 25i premium. There being no further bids it was moved by Commissioner Lowe, seconded by Commissioner Healy, that the bi. d of Fred M. Brown, of par, 4.9% interest with a 251 premi urn on each $100.00 bond be accepted and the motion was carried by the followine; Aye and No vote: those voting Aye being Mayor Sorenson, Conunis- sioner Lowe and Commissioner Healy, those voting No, none. Development of Ball Field at Fairgrounds I H. T. Forter, and Homer E. .Anderson, of a flanning co:nmittee for the Gallatin County Fairgrounds, were present and presented a J-;lan for development of an area within the Fairgrounds which could be used as a recreational area for Softball, Football and other events. They proposed that the City share with the Gallatin County High School and the Gallatin County Fai r Board in the COg t of eradins and level5ng the tract at this time to have it ready for seeding in the sJ:ring. Their rroposed l>lan, when com}leted, would make it possible to eliminate the present City Ball i'ark and the High School football field on North Grand Avenue. The estimate of cost of work proposed to be done this fall would be $1,500.00 or less. It was moved by Corrunissioner Lowe, seconed by Commissioner Healy, that this City go on record favor- ing par hcipation in the proposed project but that no definite commitment for e:xpendi ture of funds be made until investigation is made to make sure that the City would be within its legal rights in making such e:XF,endi ture and until acce:ptable 1:-lans for the operation and maintenance of the project are F-,resented and the motion was carried by the fbllowing Aye and No vote: those voting Aye being Mayor Sorenson, Commissioner Lowe and Commissioner Healy, those voting No, none. Rental of Land at Dump Grounds The Manaber stated tbat Luke Brown desires to rent the.t l,art of' the dty owned tract, known as the City Dump Grounds, which lies :north and east of the Bast Gallatin River. The tract whicfj Mr. Brown I desires to rent contains aH_,roximately 25 acres and Mr. Brown owns land adjoining it on the south. After consideration, it was moved by Commissioner Healy, seconded by Commissioner Lowe, that the City Manager be authorized to rent this land to Luke Brown on a year to year basis for $25.0() per year, and the motion was carried by the following; Aye and No Yote: those voting Aye being ~$yor Sorenson, Commissioner Lowe and Commissioner Healy, those voting No, none. Re}iorts The followinE reIJorts for the month of October. 1949 were presented: Librerian Fire Chief folice Chief Sanitary Inspector folice Judge 322 and the Cemetery Board report for the month of September, 1949. It was rnoved by Conuniss ioner Hea ly, seconded by Commissioner Lowe. that the reports be accerted and ordered filed and the motion was carried b;l the following Aye end No vote: those voting Aye being Mayor Sorenson, Comwissioner Lowe and Commissioner Healy, those voting No, none. Retirement - Mr. Fred ~uinnell The Manager stated that Mr. Fred ,""uinnell has comfleted his work as Resident Eng;ineer at the City's I Sewat;e Treetment 1"1 en t. Mr. ~uinnell has accrued vacation due him. he is making apflication for retire- ment effective November 21, 1949 under the l.ublic Employees Retirement System, and he will be on raid vacB.tion from November 1st to November 20th, 1949. Mr. Q.uinnell eXIJects to continue to live in Bozeman after his retirement and will be available at any time for consultation and advice. After examination of the cle~ims in detail by the Ci ty Commission, it was moved by Commissioner Healy, seconded by Commissioner Lowe, that the claims be aIproved and warrants drawn for their Fayment, and the motion was carried by the following; Aye and No vote: those voting Aye being Mayor Sorenson. Commissioner Lowe and Commissioner Healy, those voting No, none. Adjournment There being no further business to come before the Commission at this time, it was moved by Commis- sioner Lowe, seconded by Commissioner Healy, the. t the meeting adjourn and the motion was carried by the following Aye and No vote: those voting; Aye being MRyor Sorenson.
