The Commission of the City of Bozeman met in regular session in the Commission Room, City Hall
Building, Wednesday afternoon, July 6th, 1949 at 1;00 o'clock F. M. Those being present were Mayor
Sorenson. Commissioner Lowe, Commissioner He&y, City Manager Henderson, City Attorney Lovelace and
the Clerk, when the following proceedings were had:
I The minutes of the last regular session were read, and it was moved by Corrwissioner Healy, seconded
by Commissioner Lowe, that the minutes be approved as read, and the motion was carried by the following
Aye and No vote; those voting Aye being Mayor Sorenson, Commissioner Lowe and Commissioner Healy; those
voting No, none.
Status of Faving Districts
Mr. R. J. Studar, of the Blacktop Construction Company, was present to report on the status of
paving distriots for which he has the contracts and on plans for their completion.
He stated that he is moving a gravel crushing plant in from Billings, required storm sewers have
been installed, excavation is proceeding rapidly, placing of curb fOMns has been started, and laying of
the base gravel will immediately follow the excavation. He estimated that, within one month, the jobs
would be practically completed.
Bond of Chief of' Folice
The bond of A. N. Haas, Chief of folice, in the amount of' $2,000.00 was I-resented. The bond was
approved as to form by the City Attorney, whereupon it was moved by Commissioner Healy, seconded by
Commissioner Lowe, that the bond be accepted and approved and the motion was carried by the following
Aye and No votet those voting Aye being Mayor Sorenson, Commissioner Lowe and Commissioner Healy; those
I voting No, none.
Claims for the Month
Claims Nos. 6023 to 6258 inc. were presented on the various funds as follows:

The Manager stated that he has audited these claims and finds them to be true and lawful claims
against the City of Bozeman. After examination of the claims in detail by the City Commission, it was
moved by Commissioner Lowe, seconded by Commissioner Sorenson, that the claims be approved and warrants
drawn for their payment, and the motion was carried by the following Aye and No vote; those voting Aye
I being Mayor Sorenson, Commissioner Healy and Commissioner Lowe; those voting No, none.
Annual Audit
The Manager read a communication from Douglas Wilson, Ferris & Company, Great Falls, Montana, stat-
ing they would make the annual audit of the City of Bozeman records at a rate of $35.00 per day, and
estimated that it would require 15 to 20 days to complete. It was moved by Commissioner Lowe, seconded
by Commissioner Healy. that Douglas Wilson, Ferris & Company be employed to make the annual audit and
the motion was oarried by the following Aye and No vote: those voting Aye being Mayor Sorenson. Commis-
sioner Healy and Commissioner Lowe; those voting No, none.

Swimming Fool Heating Contract
Mr. Frank Trunk was present and stated that the heat exchanger for the heating equipment at the
swirrnning pool has been shipped, but the motorized val ves are a special type and have to be manufactured
and no definite information as to their shipping date is available.
letition to Close Garfield Street East of Willson Avenue
A petition of property owners requesting that Garfield Street east of Willson Avenue to the City I
Limits be closed was presented and read. After consideration. it was moved by Commissioner Lowe,
seconded by Commissioner Healy, that the petition be denied and the motion was carried by the following
Aye and No vote: those voting Aye being Mayor Sorenson, Commissioner Healy and Commissioner Lowe; those
voting No, none.
Request for Water & Sewer Connections
A communication from Lee Smith, owner of four cabins and one house on the west side of Fifteenth
Avenue. requesting connection to the city water and sewer systems, was presented and read. This property
is outside the City. After discussion, it was decided that, if Mr. Smith is permitted to connect to the
water and sewer systems, an assessment in proportion to the area of the property to be serviced and the
cost of the installation of' the sewer and water mains should be paid by Mr. Smith. The City Engineer
was instructed to prepare an estimate. to be presented to the Commission. of the amount which should be
paid by Mr. Smith.
Applications for City Licenses
The following applications for Ci~ Licenses were presented:

approved and the licenses issued and the motion was carried by the following Aye and No vote: those

It was moved by Commissioner Lowe, seconded by Commissioner Healy, that the reports be accepted
and ordered filed and the motion was carried by the following Aye and No vote: those voting Aye being
Mayor Sorenson. Commissioner Healy and Commissioner Lowe; those voting No, none.
Resolution No. 652 Ret Improvement College street 8th to 11th Avenue
The Manager stated in order for the State Highway Commission to obtain Federal Aid for the improve-
ments on College Street from Eighth Avenue to Eleventh Avenue it is required that the City of Bozeman
adopt a resolution agreeing with the State Highway Commission and the Bureau of Fublic Roads that it
will not permit encroachments on the right-of-way of said street, will not adopt ordinances fixing the
speed limit under 25 miles per hour, and will not allow erection of signs or signals giving preference
to local routes which intersect College Street. He presented Corrnnission Resol ution No. 652. entitled: .1

MENTS AND TRAFFIC REGULAT IONS ON U. S. HIGHWAY 191 WITHIN THE CITY LIMITS OF THE CITY OF
BOZEMAN .
It was moved by Commissioner Healy. seconded by Commissioner Lowe, that the resolution be passed and
adopted and the motion was carri.ed by the following Aye and No votel those voting Aye being Mayor
Sorenson, Commissioner Lowe and Commissioner Healy; those voting No, none.

Fire Frotection for Jictsweet Foods, Inc.
The matter of fire protection for the plant of i'ictsweet Foods. Inc. was discussed. The Manager
reported that Mr. Roy Spain of that organization had stated that. to serve their needs, it would only
be necessar;r for Fictsweet to have permission to connect their automatic fire alarm system to the
City's fire alarm system. The City Attorney was instructed to prepare a request from J'ictsweet Foods.
I Inc., to the City of' Bozeman to allow them to connect their f'ire alarm system to the City's alarm
system; this request to set forth that granting of this privilege will not obligate the City of Bozeman
in any way, will not incur any liability on the part of the City for a fire that might occur at the
plant, and will relieve the City of any liability for any fire which might occur at this plant.

There being no further business to come before the Commission at this time, it was moved by Commis-
sioner Lowe, seconded by Commissioner Healy, that the meeting adjourn and the motion was carried by the
f'ollowing Aye and No votet those voting Aye being Mayor Sorenson, Commissioner Healy and Commissioner
Lowe; those voting No, none.
