City Hall Building, February 15th, 1949, at 11;00 o'clock A. M. Those beine; present were Mayor Sorenson. Corrunis- sioner Lowe. Commissioner Healy. City Manager Henderson. and the Clerk. when the fo1lowine; proceedings were had: I Resolution Declaring Emergency due to Snow Storms The Manager stated that -th is special meeting had been called at the request of' the County Commis- sioners, to adopt a joint resolution declaring an emergency. because of recent severe snow storms which blocked ma.ny streets, and county roads, and asking f'or f'edera1 aid in clearing the blocked roads. 'J'he following joint resolution was presented and read: JOINT RESOLUTION -_. 'NJ-IEREAS , Chapter 170, Session Laws of 1943. State of Montana, makes provision for "upon the hal-pening of eny emergency, caused by ....storm....or for the immediete preservation of' order or of public health....or for the relief of a stricken community overtaken b~' a calamity.... the County Commissioners may, upon adoption, by unanimous vote of all members present at any meetin[!;, the time and place of which all members shall have had reasonable notice, of a Resolu- tion stating the facts constituting the emergenoy. and entering U,e same uron their minutes, made the expenditures. or incur the 1 iabili ties neoessary to me et sue}, emergency wi U~out further notice or hearing. "All emergency expenditures shall be made by the issuance of emergency warrants, drawn against the fund or funds properly chargeable with such expenditures... ". and . Wm;RF..AS. on the 14th day of February, A. D., 1949. the County Commissioners. duly assembled, passed a Resolution that there existed then an Gmergency within the scope of' the above law, because of recent severe storms, which have caused several County roeds to be blocked. and because of the need for immediate preservation of' order and J:-;ublic health; and V'iHEREAS, the County Roed Fund, for Gall atin County, Montana is exhausted for the puq,oses of' road clearing and meeting the emergency; and I WHEREAS. a very severe storm. which was in progress at the time of said meeting on February 14. A. D., 1949, and which storm is still raging and unabated; and vVPEREAS. County roads are. as of this date. in a muoh worse condition than they were at the time of passing said Resolution; and WHEREAS, the County Commissioners for Gallatin County, Montana. and the City Commission for the City of Bozeman. Montana have received and are receivinG a multitude of cells for relief, because practically every County road and state and f'ederal Highway in this locality is blocked to both the movement of motor powered vehioles and horse-drawn vehicles; and WHEREAS, the ilTlmedi8,te preservation of order and publ ic heal th is gravely endangered; and WHERE:AS . there are great numbers of' livestock breeders in this locality whose livestock is suffer- int: and there is a prosF,ect that the same will continue to suff'er, and undoubtedly the same will continue to suffer; and WHEREAS, we deem the inunediate preservation of order and of' public health to be now. on account of said road condition. an emergency problem; and WHEREAS, it is a fa.ct that we now do not have suffic ient f'unds or equipment to meet the emer- gency; and WHEREAS, it is the consensus of opinion of this joint Board meeting; that a great deal of heavy equipment will be necessary to relieve the r:resent emergency; and WHEREAS, we have been advised that aid from the Federal Government. through the State Highway Department is available, or possibly will be available and tha t aid through the State of Montana, is. or will Fossibly be available to relieve the emergency; and WHEREAS. the County of Gallatin, State of Montana, and the City Commission of Bozeman, Montana. are not in a position to make reimbursement for the relief' and removal of snow to relieve the I emergency; NOW THEREFORE, BE IT RESOLVED, 'That we, the Board of County Commissioners of' the County of Gallatin, State of Montana, and the City Commission of the City of Bozeman. Nontana, being duly assembled. all members being present and concurring in the deliberation. as required by State and Municipal Law, deem that a public emergency exists, as hereinabove set forth, and hereby request that all possible aid be requested and received. which in any way will be available through any State or }"ederal Agencies, which are in a pasi tion to give appropriate relief; And further that all County Officers and Of'f'ices be authorized to accept any such relief as may be necessary to meet the emergency af'oresaid, without further Notioe, and wi thout the City or County being obligated to reimburse said Agencies or Governments f'or such aid; BE IT RESOLVED That this Resolution be spread upon the Minutes of the County Commissioners for 212 the County of Gallatin, State of Montana, and upon the Minutes of' the City Commission, City Of'fices. Arter discus sion and consideration of the above resolution. it was moved by Commissioner Lowe, seconded by Commissioner Healy that the resolution be adopted and the motion was carr ied by the following; Aye and No vote; those voting Aye being Mayor Sorenson. Commissioner Lowe and Commissioner Hea ly; those voting No. none. Adjournment There being no further business to come before the Conunission e~t this time, it was moved by Commissioner Healy, seconded by Commissioner Lowe that the meeting adjourn and the moti.on was carried by the f'ollowing Aye and No vote: those voting Aye being Mayor Sorenson.
