The Commission of TIle City of Bo zeman met in regular session in the Commissi on Room, City Hall
BuildinE. Wednesday afternoon, February 16th, 1949 at 1:00 o'clock F. M. Those bein~ present were Mayor
Sorenson, Con~issioner Lowe. Commissioner Healy. City M&nager Henderson, City Attorney Lovelace and the
Clerk, when the following proceedings were had:

Resolution Accertinb CAA Grant Agreement
'The following Resolution was introduced by Commissioner Healy:

AGREEMENT RECEIVED FROM THE ADMINISTRATOR. CIVIL AERONAUTICS, UN I TED STATES 0 F AlV!ERIC A.
FOR THE DEVELOfMENT OF THE GALLATIN FIELD AIRPORT, BOZEMAN, MONTANA.
Pe It Resolved By The City Commission Of Bozeman. Montana.
Section I. That 'The City of Bozeman, Montana, by and through its City Commission, shall
enter into a Grant Agreement f'or the Gallatin Field Airport and that such
agreement shall be as set forth hereinbelow.
Section 2. That the Mayor of The City of' Bozeman be, and he is hereby authori zed and
directed to execute said Grant Agreement in sextuplet on behalf of The City
of Bozeman and the Clerk of the Ci ty Corrunission is hereby authorized and directed to
impress the Official Seal of The City of' Bozeman, Montana, thereon and to attest said
execution.
Section 3. That the City Commission hereby specifically ratifies and adopts e.11 state-
ments, representations, warranties. covenants and agreements contained in
the l'roject Application.

referred to as the "Co-sponsors")
FROM : The Uniteo States of' American (acting throuEh the Administrator of' Civil
Aeronautics. herein referred to as the "Administrator")
WBEREAS, the Co-sponsors have submitted to the Administrator a Project Application
dated September 8, 1948, for a grant of' Federal funds for a project f'or development of
the Gallatin Field Airport (herein called the "Airrort), together 'With plans and speci-
fications for such project. which Froject Al'plication. as approved by the Administrator
is hereby incorporated herein and made a part hereof'; and
V'mERf~AS . the Administrator has approved e. project for development of the Airport (herein
called the "iroject") consistine: of the following described airport development:
Grade. drain and pave apron and N/S taxiway; construct segmented circle marker
and relocate existin('; wind indicators. temporarily relocate existing electrical
reg~ulating equipment; install taxiway guidance liChts,
all as more particularly described in the survey map and plans and sFecifications incor-
porated in the said Project AI,plication:
I NOW THEREFORE, pursuant to and f'or the purposes of' carrying out the lrovisions of the
Federal Airport Act (60 Stat. 170; Pub. Law 377, 79th Congress). and in consideration of
(a) the Co-sponsor's adoption and ratification of the representations end assuranCeS con-
tained in said Froject Application. and their acceptance of this Offer. as hereinafter
provided, and (b). the benefits to accrue to the United States and the public from the
accomplishment of the Froject and the operation and maintenance of' the Airport. as herein
provided.
THE ADMINISTRATOR, FOR MD ON BEHALF OF THE lJNITED STATES, HER~BY OFFERS AND AGREES to pay.
as the United States' share of' costs incurred in accoffiplishinc the project. 53.53 rercentum
of all allowable project costs, subject to the following terms and conditions:
1. The maximum obligation of the United States rayable under this Offer shall be ~p36.846.00.

2. The Co-sponsors shall
(a) begin accomplishment of' the froject wi thin a. reasonable time after acceptance
of this Offer. and
(b) carry out &rJd complete the Project in accordance wi th the terms of this Offer.
and the Federal Airport Act and the Regulations promulgated thereunder by the
Administrator of Civil Aeronautics in effect on the date ')f this Offer, which
Act and Regulations are incorporated herein and made a part hereof', and
(c) carry out and complete the Project in accordance with the plans and sFecifica- I
tions incorporated herein es they may be revised or modified with the aI-provel
of the Administrator or his duly authorized representatives.
3. The Co-sponsors shall oporate and ms.intain the AirF,ort as lrovided in the froject
Application incorporated herein.
4. Any misrepresentacion or omission of a material fact by the Co-sponsors concerning
the ]l'roject or the Co-sponsors' authority or ability to carry out the obligations
assumed by the Co-sponsors in accepting this Offer shall terminate the obligation
of the United States, and it is understood and aGreed by the Co-sponsors in accept-
ing this Offer that if a material f'act has been misrel-resented or omi tted by the
Co-sponsors. the Administrator on behalf of the United States may recover all Grant
payments made.
5. The Administrator reserves the right to amend or wi thdraw this Offer at any time
prior to its acceptance by the Co-sponsors.
6. This Offer shall expire and the United States shall not be obI igated to pay any of
the allowable costs of' the Froject unless this Offer has been accepted by the
Co-sponsors within 60 days from the above date of Off'er or such longer time as may
be prescribed by the Administrator in writing.
Acceptance of this Offer shall be evidenced by execution of this instrument by the County
of Gallatin. Montana. and the City of Bozeman, Montana, as Co-sponsors, as hereinafter
provided. and said Offer when so accepted shall comprise a Grant Agreement constituting
the obligations and rights of the United States on the one part, and the County of Gallatin,
Montana, and the City of Bozeman, Montana, jointly and severally. on the other part, with
respect to the accomI,lishment of the projects and the operation and maintenance of the
Gallatin }'leld Airport. Such Grant Agreement shall become effective upon the Co-sponsors'
acceptance of this offer and shall remain in full force and ef'f'ect throughout the useful
life of the f'acilities developed under the project but in any event not to exoeed twenty
years from the date of said acceptance. I

Addi tional hre h[;hti.ng Equipment
I Mr. Hague Callister, of the Chamber of Commerce, was present and stated that since tIJe recent
fire at the Nurses' Home, several peorle have droPFed in to the Chamber Office and discus sed the
need for additional fire fighting equipment f'or the City. He stated that these inquiries would be
referred to the proper corrunittee and he had brought this infonnation to the Com.rnission so that the
City would have knowledge of the corrnnittee's workings.
During the discussion that followed, it was pointed out that this matter of additional fire
equipment has been given consideration by the COIl1l!lission and they had discussed tLe cost of addi-
tional equipment in proportion to the properties to be served, the financing of the purchasing and
housing such equipment and also that the Board of Fire Underwriters has not stated that the rurchase
of' additional fire equipment would make any reduction in the fire insurance rates within the City.
Sale of' Studebaker }'ire Truck
The Manager stated that the Town of Hysham has made inquiry regarding the I,urcha.se of' used
fire equipment from the City. The Manager stated that the Studebaker truck was obsolete and did not
serve any practical purpose. and could be disl,osed of. It was moved by Commissioner Lowe. seconc'.ed
by Commissioner Healy the. t the City Manager be authorized to dispose of the Studebaker F'ire Truck
at the best obtainable price, and the motion was carri ed by the follOWinG Aye and No vote: those
I voting Aye being Mayor Sorenson, Commissioner Healy, and Commissioner Lowe; those voting No. none.
Request for Authority to Erect a Museum in Lindley Park
Mr. Roy Border of the Gallatin fioneer l-1useum Association was I;resent and presented a wri tten
request from the organi zation for authority to erect a Museum in Lindley Park f'acing Main Street
and east of Buttonwood Avenue. It was moved by Commissioner Healy. seconded by Commissioner Lowe
that this request be afrroved subject to completed plans and srecifications being Fresented to and
arproved by the City Commission and that accer,table plans also be presented for the operation and
maintenance of the building, and the motion was carried by the f'ollowing Aye and No vote: those
votinG Aye being Mayor Sorenson. Commissioner Lowe and Commissioner Healy; those voting No. none.
Blowing Fire Siren for Curfew
The Manager stated that he had received several requests relative to necessity of blowing; the
Fire Siren as a CurfeVI signa.l at IO:OO F. M. eech night. It vms explai ned that as a part of regula r
fire department routine it was necessary to test the siren once each day and blowing it at 10tOO
i'. M. served the dual purpose of testing the siren and sounding the curfew signal.
Bids for Truck
The Manager stated that this was the time and rlace set for the opening of bids for a truck for
I the street department. He presented the af'fidavit of publication Notice to Bidders. whereupon. it
was moved by COIlUllissioner Healy, seconded by Commissioner Lowe that the bids be opened and the
motion was carried by the following Aye and No vote: those voting Aye being Mayor Sorenson. Commis-
sioner Lowe and Commissioner Healy; those voting No, none.

It was moved by Commissioner Healy. seconded by Conunissioner Lowe that the truck bids be tabulated
for comparison and action deferred until the next regular meeting of the Commission and the motion was
carried by the f'ollowing Aye and No vote: those voting Aye beinG Mayor Sorenson, Commissioner Lowe and
Commissioner Healy; those voting No. none.
Recreation Board Recommendation to Hlat Swimrnini: :Fool
The City Manager reported that at a special meetint; of the Recreation Board held on February 14th.
1949, it was recommended the t the City Commiss ion provide facilities for heating the water in the
swimming pool if funds are available and that the f'acilities be installed prior to the 1949 season; and
if funds are not avai lable in park funds this year, the Commission take whatever steps are necessary
to increase the park fund sufficiently to make this improvement. It was stated that the approximate
cost of such an improvement would be Rpproxima.tely $6.300.00 I
After consideration by the City Commission, they went on record as favoring such an improvement,
but after examination of the park f'und balances. it was their opinion that unless other park operations
were drastically curtailed that it would not be possible to spend $6.000.00 for this improvement during
the current fiscal year, but funds in the amount of $3.000.00 could be made available for this project.
The Commission considers it inadvisable to rIan increased tax levy in the next f'iscal year to provi.de
funds for this special project but expressed the view that as soon as suf'f'icient surplus can be buH t
up in the k'ark fund the project should be undertaken.
