April 13th, 1949
The Commission of The City of Bozaman met in regular session in the Commission Room, City Hall
Building, Wednesday afternoon, April 13th, 1949 at 1:00 o'clock f. M. Those being present were
Mayor Sorenson, Commissioner Lowe, Commissioner Healy, City Manager Henderson, City Attorney Lovelace
and the Cle rk, when the following proceedings were had,
The minutes of the last regular session were read, and it was moved by Commissioner Healy, seconded I
by Commissioner Lowe that the minutes be approved as read, and the motion was carried by the following
Aye and No vote: those voting Aye being Mayor Sorenson, Commissioner Lowe and Commissioner Healy; those
voting No, none.
Reports
The following reports for the month of March, 1949 were presented;
Plumbing Examiner Building Inspector Cemetery Board Nursery School
It was moved by Commissioner Healy, seconded by Commissioner Lowe that the reports be accepted
and ordered filed and the motion was carried by the following Aye and No vote: those voting Aye being
Mayor Soranson, Commissioner Lowe and Commissioner Healy; those voting No, none.
Applications for City Licenses
The following applications for City Licenses were presented:

It was moved by Commissioner Lowe, seconded by Commissioner Healy that the applications be
approved and the licenses issued and the motion was carried by the following Aye and No vote: those I
voting Aye being Mayor Sorenson, Commissioner Lawe and Commissioner Healy; those voting No, none.
Bond -- Director of Finance
The bond of L. G. Shadoan, as Director of F'inmce, in the amount of $20,000.00 was presented.
The bond was approved a8 to form by the City Attorney, whereupon, it was moved by Commissioner Healy,
~ seoonded by Commissioner Lowe that the bond be accepted and ordered filed and the motion was carried
by the following Aye and No vote: those voting Aye being Mayor Sorenson, Commissioner Lowe and
Commissioner Healy; those voting No. none.
Report on Water and Sewer Meeting
City Manager Henderson reported to the Commission on the Sewer and Water Works meeting which he
attended in Great Fells, April 7th to 9th, 1949.
Froposal to Use McCay House Rejected
Mr. Larry Wilson and Jake Tiedema representing the Gallatin Farm Bureau and Hague C~llister
representing the Bozeman Chamber of Commerce were present regarding a proposal by the Far.m Bureau to
use the "McCay House" by the Farm Bureau as suggested at the last meeting of the Commission. City
Manager Henderson explained the City Commission has given much consideration to this proposal, and I
presented what, in the opinion of the City Commission, were the advantages and disadvantages of such
a proposal. The advantages being the need for public rest rooms. the convenience and excellent loca-
tion of the MoCay House, the opportunity of the City to co-operate with 100 a.1 organizations, present
building would necessitate a lower initial investment, ani the City would not have to pay for the
cost of operation and maintenance under such a plan as presented.
The following disadvantages were oonsidered:
Would not carry out the purpose for which property was purchased.

Need for "off street" parking is increasing.
Building is old and should not be used permanently.
Could not sub-lease property except as provided in City's lease, and then only
for a limited period.
Use of ground as a Farking Lot would be limited out of proportion to the area
actually taken up by the house.
Leasing of the building, rent free, would be using the sale price of the build-
I. ing for other than public use.
. Utilizing house for office space would be in competition with owners of rental
properties.
Leasing to the Farm Bureau would be assigning public property for private use.
Cost of' remodeling, operation and maintenance for a short period would be a
poor proposition for the Farm Bureau.
City has no legal right to enter into proposed contract, and a protest from
taxpayers might prevent City from oarrying out such a contract.
The City Commission stated they wished to co-operate in every way possible in providing such a
place for public use, but consideration of the advantages and disadvantage made it be impractical f'or
the City to enter into such a contract and concluded the lots should be used for the purpose for which
they were purChased, and it was moved by Commissioner Lowe, seconded by Commissioner Healy that the
proposal be rejected, and the City Manager be authorized to dispose of the house on the "McCay Froperty"
at the earliest possible date, and the motion was carried by the following Aye and No vote: those
voting Aye being Mayor Sorenson, Commissioner Lowe and Commissioner Healy; those voting No, none.
Appointment of Sewage }lant Operator
The Manager announced the appointment of Douglas Anderson as the operator and caretaker at the
Sewage Treatment Plant. It was moved by Commissioner Lowe, seconded by Commissioner Healy that the
.1 appointment be aFproved and the motion was carried by the following Aye and No vote: those voting Aye
being Mayor Sorenson, Commissioner Lowe and Commissioner Healy; those voting No, none.
Ordinance No. 750 -- Licensing Slot Machines
The ordinance providing for the licensing of slot machines held over from the last regular
meeting was again considered. City Manager presented No. 750, entitled:
AN ORDINANCE OF THE CITY OF BOZEMAN,. MONTANA, RELATING TO AND REGULATING THE LICENSING
OF SLOT MACHINES i'OSSESSED, USED, OFERATED, KEPT OR MAINTAINED roR USE OR OPERATION BY
RELIGIOUS. }i'RATERN.AL, CHARITABLE OR NONPROFIT ORGANIZATIONS WITHIN THE CORfORATE LIMITS
OF THE CITY 01" BOZEMAN, MONTANA; PROHIBlTING MINORS FROM FLAYING SLOT MACHINES OR
LOITERING ABOUT THE PREMISES WHERE A SLOT MACHINE IS KEPT OR OPERATED, AND PIVVIDING
I'ENALTIES FOR THE VIOLATION OF THIS ORDINANCE.
It was moved by Commissioner Lowe, seconded by Commissioner Healy that the Ordinance be passed
and adopted and the motion was carried by the following Aye and No vote: those voting Aye being Mayor
Sorenson, Commissioner Lowe and Commissioner Healy; those voting No, none.
Adjourmnent
There being no further business to come before the Commission at this time, it was moved by
Commissioner Lowe, seconded by Commissioner Healy, that the meeting adjourn and the motion was carried
by the following Aye end No votet those voting Aye being Mayor Sorenson, Commissioner Healy and
