The regular meeting of the City Commission, April 20th, having been adjourned to this date. the
City Commission met in adjourned session in the Commission Room, City Hall Building. Friday afternoon,
April 22nd. 1949 at 5:00 o'clock F. M. Jresent were Mayor Sorenson, Commissioner Lowe, Commissioner
Healy, City Manager Henderson, City Attorney Lovelace and the Clerk when the following proceedings
were had to-wit: I
Consideration of Bids and Awarding of Contract for S. I. D.s 349, 351, 353, 354
Bids having been received and opened at the regular meeting on April 20th for street improvements
in Special Improvement Districts 349, 351, 353 and 354 and those bids having been submitted to the City
Engineer, the City Attorney and the City Manager for tabulation, detailed check and investigation,
consideration of the bids was resumed at this time.
Two bids were received for the work proposed in each of these districts. Tabulation of those bids
as shown in the Commission Minutes of April 20th was found to be correct and the Blacktop Construction
Company. Billings, Montana was found to be the low bidder in each case. The Blacktop Construction
Company had submitted a bid bond with their bids instead of a certified check as specified in Section
5232 Revised Codes of Montana, 1935 and question arose as to whether or not a bid bond constituted
sufficient guarantee as required by law. The City Manager stated that he had checked with some other
Montana oi ties and found that it was common practioe to accept such bid bonds. It was pointed out that
in this case the bid of the Blacktop Construction Company was $12.477.50 under the next lower bid. It
was further pointed out that investigation shows that this is a reliable company. capable of doing the
proposed work in accordance with the specifications. It was considered that acceptance of the bid of
the Blacktop Construction Company would be to the best interests of the City of Bozeman and to the I
property owners in the proposed districts and would be in accordance with the intent of the law.
After discussion of all details of the proposition, it was moved by Commissioner Lowe, seconded
by Commissioner Healy. that the bid of the Blacktop Construction Company. in the amount of $7,903.40,
for installation of the proposed street improvements in Special Improvement District No. 349 of the
City of Bozeman be and is hereby accepted subjeot to the following provisions:
(a) That the Blacktop Construotion Company enter into a contract with the City of Bozeman
as provided by the specifications and as set forth in their bid submitted on April 20th.
(b) The Blacktop Construction Company furnish an aoceptable performance bond to guarantee
their satisfactory completion of the proposed work.
(c) That payment to the Blacktop Construction Company for the proposed work be made from
funds derived from the sale of Special Improvement District bonds to be issued by the
City of Bozeman against Special Improvement District No. 349
and the motion was carried by the following Aye and No vote: those voting Aye being Mayor Sorenson,
Commissioner Lowe and Commissioner Healy; those voting No, none.
It was moved by Commissioner Healy, seconded by Commissioner Lowe, that the bid of the Blacktop
Construction Company, in the amount of $45,744.10, for installation of the proposed street improvements
in Special Improvement District No. 351 of the City of Bozeman be and is hereby accepted subject to the
following provisions: I
(a) That the RIa. cktop Construction Company enter into a contract with the City of Bozeman
as provided by the specifications and as set forth in their bid submitted on April 20th.
(b) The Blacktop Construotion Company furnish an acceptable performance bond to guarantee
their satisfactory oompletion of the proposed work. ~~~...~~~
(c) That payment to the Blaoktop Construction Company for the proposed wQ~k. _Q~ made from
funds derived f'rom the sale of Special Improvement District bonds to be issued by the
City of Bozeman against Special Improvement District No. 351
and the motion was carried by the following Aye and No vote: those voting Aye being Mayor Sorenson,
Commissioner Lowe and Commissioner Healy; those voting No. none.

It was moved By Commissioner Lowe, seconded by Commissioner Healy, that the bid of the Blacktop
Construction Company, in the amount of $20,244.40, for installation of the proposed street improvements
in Special Improvement District No. 353 of the City of Bozeman be and is hereby accepted subject to the
following provisions:
(a) That the Blacktop Construction Company enter into a contract with the City of Bozeman
as provided by the specif'ications and as set forth in their bid submitted on April 20th.
I (b) The Blacktop Construction Company furnish an acceptable performance bond to guarantee
their satisfactory completion of the ~ro~osed work.

funds derived from the sale of Special Improvement District bonds to be issued by the
City of Bozeman against Special Improvement District No. 353

Commissioner Lowe and Commissioner Healy; those voting No, none.
It was moved by Commissioner Healy, seconded by Commissioner Lowe, that the bid of the Blacktop
Construction Company, in the amount of $20.174.80, for installation of the proposed street improvements
in Special Improvement District No. 354 of the City of Bozeman be and is hereby aocepted subject to the
following provisions:
(a} That the Blaoktop Construction Company enter into a contract with the City of Bozeman
as provided by the specifications and as set forth in their bid submitted on April 20th.
(b) The Blacktop Construotion Company furnish an acceptable performance bond to guarantee
their satisfactory completion of the proposed work.
(c) That payment to the Blacktop Construction Company for the proposed work be made from
funds derived from the sale of Special Improvement District bonds to be issued by the
City of Bozeman against Special Improvement Distriot ~o. 354
and the motion was carried by the following Aye and No vote: those voting Aye being Mayor Sorenson,
Commissioner Lowe and Commissioner Healy; those voting No, none.
I Feti tion for Street Improvements, Alderson Street
A petition for paving Alderson Street was presented from interested property owners, requesting
that a Special Improvement District be created for paving Alderson Street between 5th Avenue and 9th
Avenue.
Fetition having been presented on Maroh 30th to establish Special Improvement Districts for paving
on Story Street, 5th Avenue and Dickerson Street and it being considered that the paving proposed under
the Alderson Street petition and that proposed in the petitions presented on March 30th oould advantageously
be included in one Speoial Improvement District, it was moved by Commissioner Healy, seconded by
Commissioner Lowe that this petition be referred to the City En~ineer and the City Attorney. that the
City Engineer be instructed to prepare an estimate of cost and that based on the Engineer's estimate that
the City Attorney be instructed to prepare a Resolution of Intention to create one Special Improvement
Distriot to inolude proposed street improvements on 5th Avenue between story and Koch Streets, on Story
Street between 3rd AvenUe and 6th Avenue, on Dickerson Street between 3rd AVenue and 8th Avenue, and
on Alderson Street between 5th Avenue and 9th Avenue. and the motion was oarried by the following Aye
and No vote: those voting Aye being Mayor Sorenson. Commissioner Healy and Commissioner Lowe; those
I voting No, none.
Claim, Chicago fump Company
The claim of the Chicago Fump Company in the amount of $1,025.10 was presented. Th e Manager
stated that this claim was for payment for two sludge pumps furnished by the Chioago Pump Company for
the City Sewage Disposal Plant, which pumps were received in December, 1948. Under the terms of the
contraot with Chioago Pump Company. payment for equipment was agreed to be made within 30 days from date
of receipt of the equipment, subject toa 15% reserve to be held until the equipment was installed.
Payment f'or this particular equipment had not heretofore been made because the Chicago lump Company

had not filed a claim for the amount due them. The Manager stated that this is a true and lawful
claim against the City of Bozeman, and that it is past due, and he recommended that a warrant be drawn
for its payment. It was moved by Commissioner Healy, seconded by Commissioner Lowe, that the claim
be approved g,nd a warrant against the S. D. S. Construction Fund be drawn for its payment, and the motion
was carried by the following Aye and No vote: those voting Aye being Mayor Sorenson, Commissioner
Healy and Commissioner Lowe; those voting No. none. I
Adjournment
There being no further business to come before the Commission at this time, it was moved by
Commissioner Lowe, seconded by Commissioner Healy, that the meeting adjourn and the motion was carried
by the following Aye and No vote: those voting Aye being Mayor Sorenson, Commissioner Healy and
Commissioner Lowe; those voting No, none.
