April 27th, 1949 The Commission of The City of Bozeman met in regular session in the Commission Room, City Hall Building, Wednesday afternoon, April 21th, 1949 at 1:00 o'clock F. M. Those being present were Mayor Sorenson, Commissioner Lowe, Commissioner Healy, City Manager Henderson, City Attorney Lovelace and the Clerk, ~en the following prooeedings were had: I The minutes of the last regular session and of the adjourned meeting were read, and it was moved by Commissioner Healy, seconded by Commissioner Lowe, that the minutes be approved as read, and the motion was carried by the following Aye and No vote: those voting Aye being Mayor Sorenson, Commissioner Lowe and Commissioner Healy; those voting No, none. Sale of McCay House The Mane.ger stated this was the time and place set for the sale of the house on the property being purchased from K. J. Stimson. known as the "McCay House". He presented the affidavit of publication of the Notice of Sale, whereupon, it was moved by Commissioner Healy, seconded by Commissioner Lowe that the bids be opened and read. and the motion was carried by the following Aye and No vote: those voting Aye being Mayor Sorenson, Commissioner Healy and Commissioner Lowe; those voting No, none. The bid of Myron Westlake, being the only bid received, was opened and read, and found to be as follows z Purchase of the "McCay House" to be moved not later than July 1st, 1949 -- $615.00. It was moved by Commissioner Lowe, seconded by Commissioner Healy, that the offer be accepted subject to the payment of $515.00, and that the Mayor and Clerk be authorized to sign an agreement with Mr. Westlake in accordance therewith, and the motion was carried by the following; Aye and No vote: those voting Aye being Mayor Sorenson, Commissioner Lowe and Commissioner Healy; those voting No, none. I RegulAtion of Driveways The question of adopting new regulations pertaining to driveways across sidewalks was discussed. The Manager presented data received on the subject from the International City Managers' Association and from other cities. It was considered that further detailed study should be given to the question before any ordinance or proposal is brought before the Commission. Ordinance on "Hawkers" and ftJeddlers" A copy of the Butte ordinance licensing "Hawkers" and "Peddlers" was read. It was considered that a more stringent ordinance is needed for oontrol in Bozeman and the matter was referred to the City Attorney for study, for securing data from other cities, and for his reoommendations. Petition for Alley in Block C; Original Townsite A petition from property owners in Block C, Original Townsite of The City of Bozeman was presented and read. The petition requested that the City of Bozeman take the necessary steps for the opening of an alley in said Block C. Special problems involved in opening an alley in this block were discussed, and it was moved by Commissioner Lowe, seconded by Commissioner Healy, that the City Engineer prepare a plan and estimDted costs for opening such an alley and the motion was oarried by the f'ollowing Aye and No vote: those voting Aye being M~or Sorenson, Commissioner Healy and Commissioner Lowe; those voting I No, none. Reports The following reports were presented: Water Collector for April, 1949 Sanitary Inspector's Milk Count for March, 1949 It was moved by Commissioner Healy, seconded by Commissioner Lowe that the reports be accepted and ordered filed, and the motion was carried by the following Aye and No vote: those voting Aye being Mayor Sorenson, Commissioner Healy and Commissioner Lowe; those voting No, none. 2~4 Applications for City Licenses The following applications for City Licenses Were presented: Kessler Dairy Dean J. Moore Kenny's Motor Sales Ray Myers Texaco Service Bozeman Courier Belshaw for Tires College Drive Inn Miller's Chevron Service Bailey's Casto Cash Grocery Cosens Transfer & Storage Bozeman Electroplating Co. City Dye Works It was moved by Commissioner Healy, seconded by Commissioner Lowe that the applications be approved and the lioenses issued and the motion was carried by the following Aye and No vote: those voting Aye I being Mayor Sorenson. Commissioner Healy and Commissioner Lowe; those voting No, none. Proposal for Park or Playground in Normandy Addition The Manager stated that Mr. Verne Ballatyne has made inquiry as to whether or not the City of Bozeman would accept a gift of two lots, a tract approximately 120' by 123' in size, in Normandy Rearrange- ment of West Side Addition, to be used for park or playground purposes. The Manager was instructed to inform Mr. Ballantyne that, before any answer could be given on his proposal, the City would want to know exact looation of the proposed tract and that such a gift would not be accepted with any restriction other than that the traot would be used for park or playground purposes. Agreement for Maintaining Ditch at Airport The City Manager presented an agreement prepared between Gallatin County and The City of Bozeman as the first party and E. L. and Fannie Trent as the second party, dated April 27th, 1949. The agreement is relative to relocation of a fence by the First Party and the maintenance of an irrigation ditoh by the Second Party at Gallatin Field, the City-County ~irport, near Belgrade. Montana. After discussion. the following resolution was moved by Commissioner Healy, seconded by Commissioner Lowe: That the Agreement as written end offered to the City Conunission for oonsideration be apt-roved; and I That the Mayor and the Clerk of the Commission be authorized to sign the agreement on behalf of The City of Bozeman, and the motion was carried by the following Aye and No vote: those voting Aye being Mayor Sorenson, Commissioner Healy and Commissioner Lowe; those voting No, none. Contract for S. I. D. 349, 351, 353 and 354 The contract between the City of Bozeman and the Blaoktop Construction Company, Billings, Montana for the construotion of street improvement in Special Improvement Distriot Nos. 349, 351. 353 and 354 was presented. The contraot was approved as to form by the City Attorney, whereupon, it was moved by Commissioner Healy, seoonded by Commissioner Lowe, that the Mayor and the Clerk of the City Commission be authorized to sign the oontract for the City of Bozeman, and the certified checks be returned to the unsuccessful bidder and the motion was oarried by the following Aye and No vote: those voting Aye being Mayor Sorenson, Commissioner Healy and Comr~ssioner Lowe; those voting No, none. Bonds for S. I. D. 349, 351, 353 and 354 Performance bonds of the Blacktop Construction Company, Billings, Montana for the construction of Speoial Improvement District No. 349, No. 351, No. 363 and No. 364 were presented. The bonds were approved as to form by the City Attorney. whereupon, it was moved by Commissioner Healy, seconded by Commissioner Lowe that the bonds be accepted and approved and the motion was carried by the following I Aye and No vote: those voting Aye being Mayor Sorenson, Commissioner Healy and Commissioner Lowe; those voting No, none. Sale of Bonds S. I. D. No. 349, 351, 353 and 364 The Manager stated that, in order to pay the contractor for work to be done in Special Improvement District Nos. 349, 351, 353 and 364, improvement district bonds in the approximate amount of estimated cost of work in each of these districts should be sold. It was thereupon moved by Commissioner Lowe, 245 seconded by Commissioner Healy, that the Clerk of the City Commission be authorized to advertise for the sale of these bonds and the motion was carried by the following Aye and No vote: those voting Aye being Mayor Sorenson, Commissioner Healy and Commissioner Lowe; those voting No, none. Examination of Depository Bonds The Manager stated that this is the appropriate time for the City Commission to make the annual audit I of'the depository bonds held by the Direotor of Finanoe as security for the City's funds deposited in banks in Bozeman. Thereupon the Commissioners verified the Custodian's Receipts of' the Derository Bonds and it was moved by Commissioner Lowe, seconded by Commissioner Healy, that. the Depository Bonds being found sufficient to oover the City's deposits, the report be approved and incorporated in full in the minutes of this meeting and the motion was oarried by the following Aye and No vote: those votinc Aye being Mayor Sorenson, Commissioner Healy and Commissioner Lowe; those voting No, none. Adjournment There being no further business to come before the Commission at this time, it was moved by 246 Commissioner Lowe, seconded by Commissioner Healy, that the meeting adjourn and the motion was carried by the following Aye and No vote: those voting Aye being Mayor Sorenson, Commissioner Healy and Commissioner Lowe; those voting No, none.
