May 4th, 1949 at 1:00 o'clock F. M. Those being present were Mayor Sorenson. Commissioner Lowe, Commissioner Healy. City Manager Henderson, City Attorney Lovelace and the Clerk. when the following prooeedings were had: I The minutes of the last regular session were read, and it was moved by Commissioner Lowe, seconded by Commissioner Healy, that the minutes be approved as read. and the motion was oarried by the following Aye and No vote: those voting Aye being Mayor Sorenson, Commissioner Lowe and Commissioner Healy; those voting No, none. Complaint on Traffic Enforcement -- M. F. Schauer Mr. M. P. Schauer appeared before the Commission to register complaint on what he contends is a practice of the Bozeman Police Department to attempt to fix responsibility in a vehicle accident. Mr. Sohauer had been involved in a minor aocident, he had called the Folice to report the accident and was later given a traffic ticket for "Improper Parking and Causing an Accident". Mr. Sohauer was informed that Police Officers do not fix responsibility for accidents. that their duty is to secure all possible information regarding an accident, to keep a detailed record and. where there is sufficient evidence to show that any person or persons may have caused an accident while in violation of the traf- fio ordinances, to make arrests for suoh violation. In the particular case on which Mr. Schauer made complaint, he was informed that it should first be heard before the Police Magistrate. Resolution No. 644 -- Intention to Create S. I. D. No. 355 The Manager stated that the City Attorney as instructed has prepared the Resolution of Intention I to create Special Improvement District No. 355, street improvements on West Alderson from Fifth Avenue to Ninth Avenue, West Dickerson Street from Third Avenue to Eighth Avenue, Story Street from Third Avenue to Sixth Avenue and Fifth Avenue from Koch to Story Street. He presented Resolution No. 644, entitled: A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF BOZEMAN DECLARING IT TO BE THE INTENTION OF THE CITY OF BOZEMAN TO CREATE A SPECIAL IMFROVEMENT DISTRICT TO BE KNOWN AS SPECIAL IMPROVEMENT DISTRICT NUMBER 355 OF THE CITY OF BOZEMAN FOR THE PURPOSE OF CONSTRUCTING CON- CRETE CURBS, STORM SEWERS AND PAVEMENT ON SOUTH FH'TH AVENUE FROM KOCH STREET TO STORY STREET; WEST STORY STREET F'ROM THIRD AVENUE TO SIXTH AVENUE; WEST DICKERSON STREET FROM THIRD AVENUE 10 EIGHTH AVENUE AND WEST ALDERSON STREET FROM FIFTH AVENUE TO NINTH AVENUE IN SAID CITY. It was moved by Commissioner Lowe, seconded by Commissioner Healy that the Resolution be passed and adopted and May 25th. 1949 be set as the date for the hearing of :protests, and the motion was carried by the following Aye and No vote: those voting Aye being Mayor Sorenson, Commissioner Lowe and Commissioner Healy; those voting No, none. Applications for City Licenses The following applications for City Licenses were presented: Dave Douma Cass Mattress George's Gas Co-op City Eleotric Blanding Froduce Sundown Auto Camp G. W. Harker I It was moved by Commissioner Lowe. seconded by Commissioner Healy that the applications be approved and the licenses issued and the motion was oarried by the following Aye and No vote: those voting Aye being Mayor Sorenson, Commissioner Lowe and Commissioner Healy; those voting No, none. Reports The following reports for the month of April, 1949 were presented, Librarian Recreation Director Cashier Fire Chief Sanitary Inspector Police Judge It was moved by Commissioner Healy, seconded by Commissioner Lowe that the reports be accepted ~~4R and ordered riled and the motion was carried by the following Aye and No vote: those voting Aye being Mayor Sorenson, Commissioner Lowe and Commissioner Healy; those voting No, none. Claims for the month Claims Nos. 5577 to 5790 inclusive were presented on the various funds as followsz Airport $ 4.60 Band 15.75 Cemetery 1,321.97' I Cemetery Suspense 205.00 Garbage 1,251.79 General 15, 059~32 Library 1,500.37' Fark 2,066.33 Parking Meter 18,936.30 Police Reserve 86.15 1'. Construction 14,30S.07 Water 4,474.50 Total -- $60,214.80 The Manager stated that he has audited these claims and finds them to be true and lawful claims against The City of Bozeman, and recommends that warrants be drawn for their payment. After examination of the claims in detail by the City Commission, it was moved by Commissioner Lowe. seconded by Commissioner Healy that the claims be a~Froved and warrants drawn for their payment and the motion was carried by the following Aye and No votez those voting Aye being Mayor Sorenson, Commissioner Lowe and Corrnnissioner Healy; those voting No, none. FIene for Froposed Alley in Block C Original Townsite A plat showing three possible plans for the proposed alley in Block C. Original Townsite was pre- sented. As each Flan would necessitate the oonstruction of a bridge over Bozeman Creek, and an estimate I of cost for tile bridge has not been made, it was decided upon the comFletion of an estimate of the cost of the bridge, the information as to the cost of opening this alley should then be given to the property owners in the block. Fetition -- Re Traff'ic Conditions The Chief of Folice presented a petition signed by approximately 100 oitizens protesting against traffic conditions. The petition referred particularly tOt (a) Excessive speeding in residential area, (b) Failure of vehicles to yield the right-of~way to pedestrians. The matter was discussed at length, and the Chief of Police was instructed to increase patrolling of residential streets and to instruct policemen to use more diligenoe in cars failing to yield right-of- way to pedestrians and to secure all possible publicity on the matter. Adjournment There being no further business to come before the Commission at this time, it was moved by Corrnnissloner Lowe, seconded by Commissioner Healy, that the meeting adjourn and the motion was carried by the following Aye and No vote; those voting Aye being Mayor Sorenson, Commissioner Healy and Commissioner Lawe; those voting No, none.
