The Co~nission of The City of Bozeman met in regular session in the Commission Room. City Hall
Building. Wednesday af~ernoon, May 25th. 1949 at 1:00 o'clock F. M. Those being present were Mayor
Sorenson, Commissioner Lowe, Commissioner Healy. City Manager Henderson, City Attorney Lovelace and
the Clerk, when the following; proceedings were had:
The minutes of the last regular session were read, and it was moved by Commissioner Healy. seconded 1.-
by Commissioner Lowe. that the minutes be approved as read, and the motion was carried by the following

Aye and No vote: those voting Aye being Mayor Sorenson, Commissioner Lowe and Commissioner Healy; those
voting No. none.
Public Hearing -- S. I. D. No. 355
The Manager stated that this was the time and place set for the public hearing of protests to the
creation of' Special Improvement District No. 355. paving on Fifth Avenue from Kooh to Story Street; Story
Street from Third Avenue to Sixth Avenue; Dickerson Street from Third Avenue to Eighth Avenue and
Alderson Street from Fifth Avenue to Ninth Avenue. He presented the affidavit of Fublication of the
Notice and the Clerk's mailing certificate that all property owners of record have been notified. The
written protests of 5.68% of the property owners were Fresented. Mr. Floyd Wood, Harry Wilson, R. A.
Young, Ray Anderson and Mr. and Mrs. Roy D. Houser were present at the hearing. Questions as to cost of
paving, credit for existing ilnprovements and the possibility of doing the work another year were answered
by the City Manager and City Engineer. After further discussion, it was moved by Commissioner Lowe,
seconded by Commissioner Healy that the protests be overruled as insuff'icient in law and fact. that the
City Attorney be instructed to prepare the resolution creating the district, and the motion was carried
by the following Aye and No vote: those voting Aye being Mayor Sorenson, Commissioner Lowe and I
Commissioner Healy; those voting No, none.
Resolution No. 647 -- Creating S. I. D. 355
The Manager stated that the City Attorney as instructed has prepared the resolution creating
Special Improvement District No. 355. He presented Resolution No. 647. entitled:
A RESOLUTION OF THE CITY COMMISSION OF THE CITY 01" BOZEMAN CREATING A SFECIAL IMFROVEMENT DISTRICT
TO BE KNOWN AS SFECIAL B1FROVEMENT DISTRICT NUMBER 355 OF THE CITY OF BOZEMAN FOR THE 1r?URFOSE OF
CONSTRUCTING CONCRETE CURBS, STORM SEWERS AND i'AVEMENT ON SOUTH FIFTH AVENUE FROM KOCH STREET TO
STORY STREET; WEST STORY STREET FROM THIRD AVENUE 'ID SIXTH AVENUE; WEST DICKERSON STREET FROM
THIRD AVENUE TO EIGHTH AVENUE, AND WEST ALDERSON STREET FROM FIFTH AVENUE TO NINTH AVENUE IN SAID
CITY.
It was moved by Commissioner Lowe, seconded by Commissioner Healy that the resolution be passed and
adopted and June 29th, 1949 be set as the date for the opening of bids, and the motion was carried by the
following Aye and No vote: those voting Aye being Mayor Sorenson, Commissioner,L9weand Commissioner
Healy; those voting No, none.
Miscellaneous Walk & Curb, 1949
The City Engineer, under the provisions of Section 5244 R. C. Montana 1935. relating to the con-
struction of' Walks and Curbs without the f'ormation of a special improvement district and the provisions
and authority of Seotion 5039.64 R. C. Montana 1935, and the provisions of Ordinance No. 561 of' The I
City of Bozeman, having submitted his report for 1949 of inspection of walks and curbs in the City and
his recommendations in detail with reference to needed repairs and new installation; ~nd the City
Manager having stated that he has checked on the report and made personal inspection as to the repairs
and installations thereby recommended, and recommends the adoption of the report as made.
It was moved by Commissioner Healy. seconded by Commissioner Lowe that the report of the City
Engineer as to the repair and installation of Miscellaneous Walks and Curbs for 1949 be, and the same
is hereby acoepted, approved, adopted and ordered filed. Said report of the City Engineer is hereby

adopted, referred to, and made a part of this minute entry by such adoption and reference for the purpose
of designating and identifying the streets and avenues on which such new installations and rer-airs are to
be made and such new installations or repairs are hereby ordered to be made under and pursuant to the
provisions of Sections 5039.64 and 5244 R. C. Montana 1935, and Ordinance No. 561 of The City of Bozeman;
and the City Manager is hereby instructed to give, or cause to be given, to each owner or the agent of'
-.1 such owner, or either, of the property along which such new installation or repair is to be made, written
or printed notice of' such order, as required by the provisions of said Section 5244 R. C. Montana 1935 and
of Ordinance No. 561 of The City of Bozeman. and such new installations or repairs are hereby ordered to
be made within thirty days from the date of' such notice, and the motion was carried by the following Aye
and No vote: those voting Aye being Mayor Sorenson, Commissioner Lowe and Commissioner Healy; those
voting No, none.
Liability Insurance f'or Bogert's lark, South Side lark and Swimming Pool
Insurance policies covering liability of the City at Bogert's Fark, the South Side Park, and the
Swimming Fool were ~resented. The policies were approved as to form by the City Attorney. It was moved
by Commissioner Healy, seconded by Commissioner Lowe, the the liability insurance policies be approved
and renewed and the motion was carried by the following Aye and No vote: those voting Aye being Mayor
Sorenson, Commissioner Lowe and Commissioner Healy; those voting No. none.
Driveway to Lot on 7th & Babcock
The Manager brought to the attention of the City Commission the request of Stanley Lemon to install
a driveway to the vacant lot at the corner of' South Seventh Avenue and Babcock Street.
Cle.im of WestinGhouse Electric SUIJply
I Claim No. 5791 of the Westinghouse Electric Supply in the amount of $302.28. with a discount of
$5.75 if paid within ten days, was presented. The claim was apfroved by the City Manager, whereupon it
was moved by Commissioner Lowe, seconded by Commissioner Healy. that the claim be approved and a warrant
drawn f'or its payment. and the motion was carried by the f'ollowing Aye and No vote: those votinb Aye
being Mayor Sorenson, Commissioner Lowe and Commissioner lIealy; those voting; No" none.
Application for Slot Machine License
The application of the Bozeman Country Club for a slot machine license was presented. It was
announced that the application was not complete because the state license has not been issued to them.
It was moved by Commissioner Healy, seconded by Commissioner Lowe. that application be approved and the
license issued subject to the applicant f'irst securing a proper state license. and the motion was carried
by the f'ollovd. ng Aye and No votet thOSe voting Aye being Mayor Sorenson, Commissioner Lowe and Commis-
sioner Healy; those voting No, none.
Flat of Westlake's First Addition
The Manager presented a plat of land between Fifth Avenue and Third Avenue and north of Durston Road.
to be known as Westlake's First Addition. The plat named the street extending from Third Avenue West
as Feach Street, and it was pointed out that the correct and legal name of this street is Durston Road.

Request of Jaycees to use Parking Stalls on Main Street
The request of the Junior Chamber of Commerce to use parking stalls on Main Street to display a
car to be given away during; their annual rodeo was tabled.

Delegate to Municipal League Meeting
The Manager stated the Montana Municipal League is to meet in Glendive. Montana. June 17th and 18th.
1949. It was moved by Commissioner Healy, seconded by Commissioner Lowe. that it being in the public
interest, the attendance of the City Manager and any members of the City Commission who can attend this
meeting be authorized. and their expenses be paid from the General Fund. and the motion was carried
by the followinc Aye and No vote: those voting Aye being Mayor Sorenson. Commissioner Healy and I
CorrMissioner Lowe; those voting No, none.
Left Hand Turns on Main Street, at Tracy, Willson & Black
The matter of prohibiting left hand turns at the intersections of'Main and Tracy, Main and Willson
and Main and Black Avenue was discussed. It was decided that publicity should be given this proposed
traff'ic regulation before it is included in a new traffic ordinance.
Adjournment
There beID(; no further business to come before the Commission at this time, it was moved by
Commissioner Lowe. seconded by Commissioner Healy, that the meeting adjourn and the motion was carried
by the following Aye and No votet those voting Aye being Mayor Sorenson. Commissioner Healy and
