HomeMy WebLinkAbout1949-06-08 ~~59 Bozeman, Montana June 8, 1949 The Commission of The City of Bozeman met in regular session in the Commission Room, City Hall Building, Wednesday afternoon, June 8th. 1949 at 1:00 o'clock P. M. Those being present were Mayor Sorenson, Commissioner Lowe, Commissioner Healy, City Manager Henderson, and the Clerk when the follow- ing proceedings were had to-wit: I The minutes of the last regular session were read, and it was moved by Commissioner Healy, seconded by Commissioner Lowe, that the minutes be approved as read, and the motion was carried by the f'ollowing Aye and No votet those voting Aye being Mayor Sorenson. Commissioner Lowe end Commissioner Healy; those voting No. none. Bids for Buildings at City Yards The Manager stated this was the time and place set for opening bids for two prefabricated steel buildings at the City Yards. He presented the affidavit of publication of the Notice to Bidders, where- upon, it was moved by Commissioner Lowe, seconded by Commissioner Healy that the bids be opened and read and the motion was carried by the following Afe and No vote: those voting Aye being Mayor Sorenson, Commissioner Lowe and Commissioner Healy; those voting No, none. The following bids Were opened and read: Erwin-Newman Armco Butler Mesker Blaw-Knox U. S. F. Unit Unit Unit Unit Unit Unit Ray Anderson e - 11.888.34 - - 15,261.76 14.643.36 Haggerty-Messmer 14.500.00 13,690.00 - 13,400.00 - - I. M. Johnson - - - - 14,917.00 - Allsop & Roys 14,299.00 13,104.00 12,836.00 12,772.00 - - The bid of Ray Anderson also stated that a deduction of $240.00 would be made if a performance bond . is omitted. It was moved by Commissioner Lowe, seconded by Commissioner Healy, that the bid of Ray I Anderson for an Armco Unit be aocepted without a performance bond making a net bid of $11.648.34, and the motion was carried by the following Aye and No vote: those voting Aye being Mayor Sorenson, Commissioner Lowe and Commissioner Healy; those voting No, none. Public Hearing -- S. I. D. 356 The Manager stated that this was the time and place set for the hearing of protests to the creation of Special Improvement District No. 356. paving on Fourth Avenue from Cleveland to Arthur Street and on Arthur Street from Fourth to Fifth Avenue. He presented the affidavit of publication of the Notice to Froperty Owners. and the Clerk's mailing certificate that all property owners have been notified. The written protests of 39.47% of the area of the property in the district were presented and read. Owners of property in the proposed district were present and each of them was given an opportunity to present his arguments either for or against the district. After full consideration of the protests filed. it was moved by Commissioner Lowe. seconded by Commissioner Healy, that the protests be overruled as insufficient in law and fact and the City Attorney be instruoted to prepare a resolution creating the district and the motion was carried by the following Aye and No vote: those voting Aye being Mayor Sorenson, Commissioner Lowe and Commissioner Healy; those voting No, none. I Resolution No. 649 -- Creating S. I. D. 356 The Manager stated that the City Attorney as instructed has prepared the resolution creating Special Improvement Distriot No. 356. He presented Resolution No. 649, entitled: A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF BOZEMAN CREATING A SPECIAL IMPROVEMENT DISTRICT TO BE KNOWN AS SFECIAL IMFROVEMENT DISTRICT NUMBER 356 OF THE CITY OF BOZEMAN liOR THE FURPOSE OF CONSTRUCTING CONCRETE CURBS AND BITUMINOUS PAVEMENT ON SOUTH FOlRTH AVENUE FROM CLEVELAND STREET TO ARTHUR STREET AND ON ARTHUR STREET FROM SOUTH FOURTH AVENUE 10 SOUTH FIFTH AVENUE IN SA! D CITY. It was moved by Commissioner Lowe, seconded by Commissioner Healy that the resolution be passed and adopted and June 29th, 1949 be set as the date for the opening of bids and the motion was carried ~60 by the following Aye and No vote: those voting Aye being Mayor Sorenson. Commissioner Healy and Commissioner Lowe; those voting No, none. Resolution No. 648 -- Creating S. I. D. No. 357 The Manager stated that the City Attorney as instructed has prepared the resolution creating Special Improvement Distriot No. 357. installation of a sanitary sewer on Beall Street from Third Avenue to Fifth Avenue. He presented Resolution No. 648, entitled: A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF BOZEMAN CREATING A SPECIAL IMFROVEMENT DISTRICT I TO BE KNOWN AS SPECIAL IMFROVEMENT DISTRICT NUMBER 357 OF THE CITY OF BOZEMAN FOR THE FURFOSE OF CONSTRUCTING AND INSTALLING A SANITARY SEWER ON WEST BEAU. STREET BETWEEN THIRD AVENUE AND FIFTH AVENUE IN SAID CITY. It was moved by Commissioner Healy, seconded by Commissioner Lowe that the resolution be passed and adopted and June 29th, 1949 be set as the date for the opening of bids and the motion was carried by the following Aye and No vote: those voting Aye being Mayor Sorenson. Commissioner Lowe and Commissioner Healy; those voting No, none. Request to Park Car to be Given Away at Roundup Mr. Hal Wheat, President of the Jr. Chamber of Commerce, was present to ask permission to park a large truck, on Which is loaded a car to be given away at the annual "Jaycee Roundup", on side streets in parking metered areas. Mr. Wheat waS assured of the Commission's desire to cooperate with the Jaycees in their staging of the Roundup or any other community activity and was informed that no special permit would be required for parking this truck as proposed. Request to Drop Advertising from Airplane Mr. E. W. Jennings, representing the Bozeman Chamber of Commerce, appeared to ask permission to do banner advertising and drop fictitious dollar bills from an airplane to advertise the Chamber's sponsored "Dollar Days. in Bozeman. The Commission stated they have no objeotion to the Chamber doing this type I of advertising for this particular event and the City Manager stated that, as the Director of Public Safety, he would issue a per.mit upon written request from the Bozeman Chamber of Commeroe. Claims Claims Nos. 5887 to 6022 inclusive were presented on the various funds as follows: Band $ 552.00 Cemetery 108.33 Cemetery Suspense 30.00 Garbage 319.22 General 4,531.11 Library 526.98 Park 868.06 F. L. & }. 20,013.25 Parking Meter 418.46 Police Reserve 86.15 SDS Construction 71.53 SID (170) 59.18 W-H Tax 1,066.50 Water 2,836.48 . 31..1493.25 The Manager stated that he has audited these claims and finds them to be true and lawful claims against The City of Bozeman and recommends that warrants be drawn for their payment. After examination of the claims in detail by the City Commission, it was moved by Commissioner Healy.. seconded by Commis- sioner Lowe, that the claims be approved and warrants drawn for their payment and the motion was carried I by the following Aye and No vote: those voting Aye being Mayor Sorenson, Conunissioner Lowe and Commissioner Healy; those voting No.. none. Reports The following reports for the month of May, 1949 were presented: Recreation Director Building Inspector Engineer Chief of Fol ice Cashier It was moved by Commissioner Healy, seconded by Commissioner Lowe that the reports be accepted and :261 ordered filed and the motion was carried by the following ~e and No vote: those voting Aye being Mayor Sorenson, Commissioner Lowe and Commissioner Healy; those voting No, none. Resolution of Intention to Create S. I. D. 360 The Manager stated that the City Attorney as instructed has prepared the resolution of intention to oreate Speoial Improvement Distriot No. 360, paving on College Street from Eighth AVenue to Eleventh I Avenue, along the lines discussed on September 22nd, 1948. He presented Resolution No. 660, entitled; A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF BOZEMAN DECLARING IT TO BE THE INTENTION OF THE CITY OF BOZlWAN TO CREATE A SFECIAL IMFROVEMENT DISTRICT TO BE KNOWN Af3 SPECIAL IMF:ROVE- MENT DISTRICT NUMBER 360 OF THE CITY OF BOZEMAN FOR THE PURPOSE OF CONSTRUCTING CONCRETE CURBS AND ASPHALTIC PAVEMENT ON WEST COLLEGE STREET liROM EIGHTH AVENUE TO ELEVlmTH AVENUE. It was moved by Commissioner Lowe, seconded by Commissioner Healy, that the Resolution be passed and adopted and June 29th, 1949 be set as the date for the hearing of protests and the motion was carried by the following Aye and No vote: those voting Aye being Mayor Sorenson, Commissioner Lowe and Commissioner Healy; those voting No, none. Plans for Improvement and Expansion of Water System In accordance with previous disoussions with the Comndssion. the Ma.n~er reported that he had had a conference with John Morrison, of the Morrison Engineering Co., Helena, regarding having a survey made of the water supply and distribution system of Bozeman and over-all plans made for future improve- ment and expansion of the system. Mr. Morrison has indicated that engineering costs of such a survey and planning would not exceed $3,000.00 and that his firm would undertake the work on a cost-plus basis not to eXCeed that figure. Motion was made by Commissioner Healy, seconded by Commissioner Lowe, that the City Manager negotiate an agreement with the Morrison Engineering Company, subject to the approval of the City Commission, for the performance of this engineering workaad the motion was carried I by the following Aye and No vote: those voting Aye being Mayor Sorenson, Commissioner LOWe and Commissioner Healy; those voting No, none. Adjournment There being no further business to come before the Commission at this time, it was moved by Commis- sioner Lowe, seconded by Commissioner Healy, that the meeting adjourn and the motion was carried by the following Aye and No vote: those voting Aye being Mayor Sorenson, Commissioner Healy and Commissioner Lowe; those voting No, none.
