SUBJECT: Memorandum of Agreement with the Baxter Meadows Master Community Association Covering the Agreed Upon Terms and Conditions of Restoration for the Installation of a Storm Water Pond.

RECOMMENDATION: Approve and authorize the acting City Manager to sign the Memorandum of Agreement.
BACKGROUND: Attached is a copy of the partially executed Memorandum of Agreement
with the Baxter Meadows Master Community Association covering the agreed upon terms and conditions of restoration for the installation of a storm water pond. The design of Baxter Lane between Ferguson and Cottonwood is nearing completion. During
the design, it was determined that a new stormwater pond would need to be installed in the park
at the northwest corner of Baxter and Riata. Installation of the pond will require removal and replacement of the impacted underground sprinkler system and the removal of one existing pine tree. The Baxter Meadows Homeowners Association installed and has maintained the park since it was platted. This agreement stipulates that we will repair any damages to the sprinkler system
and pay $1,200 for the removal of the tree.
UNRESOLVED ISSUES: None
ALTERNATIVES: As suggested by the City Commission
FISCAL EFFECTS: $1,200 from the Street Impact Fee Fund.
