HomeMy WebLinkAbout1949-06-29 266 Bozeman, Montana June 29th, 1949 The Commission of the City of Bozeman met in regular session in the Commission Room, City Hall Building, Wednesday afternoon, June 29th, 1949 at 1:00 0' clock F. M. Those being present were Mayor Sorenson, Commissioner Lowe, Corrnnissioner Healy. City Manager Henderson, City Atto rney Lovelace and the Clerk, when the following proceedings were hadt The minutes of the last regular session were read, and it was moved by Commissioner Healy. seconded I by Commissioner Lowe, that the minutes be afproved as read, and the motion was carried by tile following Aye and No votet those voting Aye being Mayor Sorenson, Commissioner Lowe end Commissioner Healy; those voting No, none. Public Hearing S. I. D. 350 The Manager stated that this is the time and place set for the hearing of protests to the creation of Special Improvement District No. 350, paving on College Street from Eighth Avenue to Eleventh Avenue. He presented the affidavit of the publication of the Notice to Proper~ Owners and the Clerk's Mailing Certificate that all property owners have been notified. The written protest of Fred ~. Liquin. represent- ing 24.16% of the property owners was presented. City Manager Henderson stated that E. A. Feterson, Attorney for Mr. Fred B. Liquin, had verbally withdrawn this protest. It was moved by Commissioner Lowe. seconded by Commissioner Healy, that the protests be overruled as insufficient in law and in fact and the City Attorney be instrwted to prepare a resolution creating Special Improvement District No. 350. and the motion was carried by the following Aye end No vote: those voting Aye being Mayor Sorenson, Commis- sioner Lowe and Commissioner Healy; those voting No, none. Resolution No. 651 -- Creeting S. I. D. No. 350 The Manager stated that the City Attorney as instructed has prepared the resolution creating I Special Improvement District No. 350. He presented Resolution No. 651, entitled: A RESOLUTION OF THE CITY COMMISSION OF THE CI'l'Y OF BOZEMAN CREATING A SPECIAL IMPROVEMENT DISTRICT TO BE IrnOWN AS SlECIAL IMFROVEMENT DISTRIC T NUMBER 350 OF THE CITY OF BOZEMAN FOR THE PURFOSE OF' CONSTRUCTING CONCRETE CURBS AND ASFHALTIC PAVEMENT ON WEST COLLEGE STREETF'ROM EIGHTH AVENUE TO ELEVEN TH AVENUE. It was moved by Commissioner Healy, seconded by Commissioner Lowe, that the resolution be passed and adopted and the Clerk of the City Commission be authorized to call for bids on Special Improvement District Bonds covering the estimated cost to the property owner and The City of Bozeman in the amount of $6,300.00, end the motion was carried by the following Aye and No vote: those votinC Aye being Mayor Sorenson, Commissioner Lowe and Commissioner Healy; those voting No, none. Bids for S. I. D. No. 355 and 356 The Manager stated that this was the time and place set for the opening of bids for S~ecial Improve- ment Districts No. 355 and 356. He presented the affidavit of publication of the Notice to Bidders, where- upon, it was moved by Commissioner Healy, seconded by Commissioner Lowe, that the bids be opened and read and the motion was carried by the following Aye and No vote: those voting Aye being Mayor Sorenson, Commissioner Lowe and Commi8s~oner Healy; those voting No, none. The following bids were opened: S. I. D. 355 S. I. D. 356 I Standard Construction Company, Bozeman $ 50,557.00 $ 9,079.40 Blacktop Construction Company. Billings 43,295.40 7,827.20 The bids were referred to the Ci~ Engineer for tabulation and verification. After cheoking, the City Engineer called attention to various errors in oomputation and extension of figures in each of' the bids al so, to the fact that no date for completion of the contract was shown on the bid of the Blacktop Construction Company. After consideration of the bids submitted, it was moved by Commissioner Lowe, seconded by Commis- sioner Healy. that all bids be rejected as being ambiguous, inaccurate and incomplete, that the certified 267 checks accompanying these bidS be returned to the bidders, that specifications and instructions to bidders on these projects be clarified to insure a bidder must specify a completion date if he is awarded a contract and that the Clerk of the City Commission be instructed to readvertise for the proposed work in these district~ for bids to be opened July 13, 194~ and the motion was carried by the following Aye and No vote: those voting Aye being Mayor Sorenson, Commissioner Lowe and Commissioner I Healy; those voting No, none. Bids for S. I. D. No. 357 The Manager stated that this was the time and place set f'or the opening of' bids for the construc- tion of Special Improvement District No. 367, Sanitary Sewer on Beall Street from Third Avenue to Fifth Avenue. He presented the affidavit of publication of the Notice to Bidders, whereupon, it was moved by Commissioner Healy, seconded by Commissioner Lowe, that the bids be opened and read. and the motion was carried by the following Aye and No vote: those voting Aye being Mayor Sorenson, Commissioner Lowe and Commissioner Healy; those voting No, none. The f'ollowing bids were opened and read: Standard Construction Company, Bozeman $I,748.00 Edens and Lee, Bozeman 1,901.00 It was moved by Commissioner Healy, seconded by Commissioner Lowe, that the bid of the Standard Construction Company, in the amount of $1,748.00, be accepted and the Clerk of the Commission be authorized to advertise for the sale of S. I. D. bonds to cover the cost of the district and the motion was carried by the following Aye and No vote: those voting Aye being Mayor Sorenson, Commissioner Lowe and Commissioner Healy; those voting No, none. Extension of Time to Complete Heating Contract at Fool A letter from Frank Trunk, contractor for the installation of the heating equipment for the I swimming pool, was read asking for an extension of time for the completion of his contract because the heat exchanger and motorized valves have not arrived. Mr. Trunk was present and stated that immediate shipment has been promised on these two items and they can be installed witilin two days after arrival. He stated f'urther he would make every effort to expedite shipment on this equipment. After consideration by the City Commission, it was moved by Commissioner Healy, seconded by Commissioner Lowe, that an extension of' ten days be granted Mr. Frank Trunk for the completion of his contract and the motion was carried by the f'ollowing Aye and No vote: those voting Aye being Mayor Sorenson, Commissioner Lowe and Commissioner Healy; those voting No, none. Gift for Folice Protective Association A communication from Dr. A. Stanley Rogers of Newhall, California to Chief' of Police Haas was read offering '26.00 for the Folice Protective Association in appreciation of kindness in handling an accident involving Dr. Rogers. It was moved by Commissioner Healy. seconded by Commissioner Lowe, that the City Commission approve acceptance of this $25.00 for the Police frotective Association, and the motion was carried by the f'ollowing Aye and No vote: those voting Aye being Mayor Sorenson. Commissioner Lowe and Commissioner Healy; those voting No. none. Contract -- Morrison Engineering Company I A contract with the Morrison Engineering Company, for engineering services in connection with a preliminary survey and study of the water distribution and supply system of the City of Bozeman and recommendations for their f'uture expansion and improvemen~was presented. The City Manager explained that this contract f'ollows previous discussion of this matter with the Commission with added provisions that should the City desire to oontinue employment of the Morrison Engineering-Company as consulting and supervising engineers in any work proposed in their preliminary survey, credit on a pro rata basis would be given for the fee paid to the firm for their preliminary survey. It was moved by Commissioner Lowe, seconded by Commissioner Healy, that the Mayor end the Clerk 268 of the Commission be authorized to sign the contra.ct for the City of Illozeman, and the motion was carried by the following Aye and No vote: those voting Aye being Mayor Sorenson, Commissioner Lowe and Commis- sioner Healy; those voting No, none. Agreement U. S. G. S. A Cooperative Agreement between The City of Bozeman and the United States Geological Survey for the operation of' the gaging station and investigation of surface water resources of the Ea.st Gallatin River was presented. This agreement being similar to agreements in fonner years, it was moved by Corrnnissioner Healy, I seconded by Commissioner Lowe, that the Mayor and the Clerk of the Commission be authorized to sign the agreement for The City of Bozeman, and the motion was carried by the following Aye and No votet those voting Aye being Mayor Sorenson. Commissioner Lowe and Commissioner Healy; those voting No, none. Fire lProtection for Fictsweet Foods, Inc. In connection with tile proposed agreement between City of Bozeman and Fictsweet Foods, Inc. for furnishing fire protection at the plant of this firm, the City Attorney reported that the law is ambig- uous relative to a city furnishing fire protection outside its corporate limits. The City Attorney was instructed to attempt to secure a clarif'ication of applicable laws through the County Atto rney and from the Attorney General of the State of Montana and to inform officials of Fictsweet Foods, Inc. of the progress and results of his research. Status of laving Districts The City Manager read the City Engineer's estimate of' work completed in Special Improvement Districts 349. 351, 353. 354. stating that 30% of the excavation work is completed, storm sewers are installed together with the manholes; that this is only a small portion of the work to be done in these districts and approximately 50 days of the 90 days for the completion of the contract have elal,sed. After discus- sion, it was moved by Commissioner Healy, seconded by Commissioner Lowe, that the Ci~y Engineer contact I Mr. R. J. Studer of the Blacktop Construction Company prior to the next regular meeting and get a definite statement from him outlining his plens for the completion of these improvement districts, and the motion was oarried by the following Aye and No vote: those voting Aye being Mayor Sorenson, Commissioner Lowe and Commissioner Healy; those voting No, none. Adjournment There being no further business to come before the Commission at this time, it was moved by Commis. sioner Healy, seconded by Commissioner Lowe, that the meeting adjourn and the motion was carried by the following Aye and No vote: those voting Aye being Mayor Sorenson, Corrnnissioner Healy and Commissioner Lowe; those voting No, none.
