The Commission of The City of Bozeman met in regular session in the Commission Room. City Hall Building.
Wednesday afternoon. November 3rd,1948.at 1&00 o'clock f.M. Those present were Mayor Sorenson. Commissioner
Lowe. Commissioner Healy. City Manager Henderson. Ci~ Attorney Lovelace and the Clerk. when the following
proceedings were had:
I The minutes of the last regular session were read. and it was moved by Commissioner Healy. seconded
by Commissioner Lowe that the minutes be approved as read. and the motion was carried by the following Aye
and No vote; those voting Aye being Mayor Sorenson, Commissioner Lowe and Commissioner Healy; those
voting No. none.
Performance Bond -- Chicago Pump Company
The Manager stated that 15% of the purchase price of equipment for the sewage treatment plant purchased
from the Chicago J'ump Company is being withheld as per agreement until the equipment is installed and in
working order. The Chicago Pump Company makes written request to substitute a performance bond as a guarantee
on this equipment in lieu of this 15% which shows as an outstanding account against the City. Since this
account is now several months old and no definite information is available as to when the equipment will
be installed. it was moved by Commissioner Healy, seconded by Commissioner Lowe that the Chicago rump
Company be allowed to furnish an acceptable performance bond in lieu of the 15% balance of their account
which is being withheld and the motion was oarried by the following Aye and No vote; those voting Aye
being Mayor Sorenson. Commissioner Lowe and Commissioner Healy; those voting No. none.
Leave of Absence -- Sick Leave
Mr. John McCrosson. Fire Chief, appeared before the Commission in regard to claims for firemen who
I have worked during sick leaves of Homer Fisher and George Gillette. The Manager stated that claims were
filed for pay for days off of these men on sick leave and he had disapproved the claims for pay for those
days. Fire Chief McCrosson suggested that because of their long and faithful service. these men on sick
leave be paid their regular salary for two months ~i1e on leave of absence due to sickness. It was
pointed out that this policy had not been followed in similar cases in other departments; that a policy
has been established allowing a maximum of two weeks sick leave for regular employees. and it was de-
cided that there is no reason, at this tina. for a change in this policy.
Claims for the Month
Claims Nos. 4407 to 4600 inclusive were presented on the various funds as follows:

I The Manager stated that he has audited thses olaims and finds them to be true and lawful claims
against The City of Bozeman and recommends that warrants be dram. for their payment. After examination
of the claims in detail by the City Commission. it was moved by Commissioner Healy. seconded by Conmtis-
sioner Lowe that the claims be approved and warrants drawn for their payment and the motion was carried
by the following Aye and No vote; those voting Aye being Mayor Sorenson. Commissioner Lowe and Commissioner
Healy; those voting No. none.
Reports
The following reports for the month of October. 1948 were presented:

It was moved by Commissioner Healy. seconded by Commissioner Lowe that the reports be accepted and
ordered filed and the motion was carried by the following Aye and No vote; those voting Aye being Mayor
Sorenson. Commissioner Lowe. and Commissioner Healy; those voting No. none.
Agreement for Sewer Main Installation 9i;,1 Karp's Addition
An agreement between John Karp and The 'City of Bozeman was presented. The agreement provided that I
Mr. Karp will build. entirely at his expense. a sewer in North Fourth Avenue from Villard Street to
Durston Road. The sewer will be builtin accordance with city specifications and under the supervision
and subject to the approval of the City Engineer. Upon its completion and acceptance. the sewer will
become a part of the sewer system end be the property of The City of Bozeman. Mr. Karp is the owner of
all property fronting on F'ourth Avenue in those blocks where the sewer is to be installed. The ag re a-
mant further states that the School Board of the Christian Reformed Church. owners of lots in Block 5.
Karp's Addition. in consideration of $250.00 paid to Mr. Karp to apply on the cost of this sewer. shall
have the privilege of connecting school buildings to the said sewer.
The agreement having been prepared and approved by the City Attorney. it was moved by Commissioner
Lowe. seconded by Commissioner Healy the. t it be accepted. and the Mayor and the Clerk be authorized to
sign the agreement for The City of Bozeman and the motion was carried by the following Aye and No vote;
those voting Aye being Mayor Sorenson, Commissioner Lowe and Commissioner Healy; those voting No. none.
Sewer & Water Assessment on Portion of Block 20. Butte Addition
The Manager stated that Mr. Lester Thompson is the owner of all the portion of Block 20. Butte
Addition. lying south of the G.M.St.F. & F. Ry. Company right-of-way. The location of this property is
such that Lots 13 to 16 only abut on Willson Avenue. The portion of lots 1 to 12 inolusive owned by Mr. I
Thompson are cut off by the railway right-of-way and are of low value. Sewer and water mains have been
installed on Willson Avenue under S.I.D. No. 34l. The eost of the installation is assessed on an area
basis. and the total assessment against all the property owned by Mr. Thompson is $1.066.85. Mr. Thomp-
son has made request. through his attorney. that this assessment be divided and it appears that the
purpose of division would be to default in payment of the assessment against the portion of the property
which is of low val ue. The question arises as to whether or not the City should or can prevent such a
division of assessment and the matter was referred to the City Attorney for an opinion.
Adjournment
There being no further business to come before the Conunission at this time. it was moved by Com-
missioner Lowe. seconded by Commissioner Healy that the meeting adjourn and the motion was carried ~
the following Aye and No vote; those voting Aye being Mayor Sorenson. Commissioner Lowe and Commissioner
Healy; those voting No. none.
