November 17th. 1948. at 1;00 0' clock 1'. M. Those present were Mayor Sorenson. Commissioner Lowe, Commissioner Healy. City Manager Henderson. City Attorney Lovelace and the Clerk. when the following proceedings were had: The minutes of the last regular session were read. and it was moved by Commissioner Lowe. seconded (, by Commissioner Healy that the minutes be approved as read. and the motion was carried by the following Aye and No vote: those voting Aye being Mayor Sorenson. Commissioner Lowe and Commissioner Healy; those voting No. none. Reports The following reports for the month of October. 1948 were presented: Flumbing &: Gas Inspector Nursery School It was moved by Commissioner Healy. seconded by Commissioner Lawe that the reports be accepted and ordered filed and the motion was oarried by the following ~e and No vote: those voting Aye being Mayor Sorenson. Commissioner Lowe and Commissioner Healy; those voting No, none. Renewal of Hogan I'arking Lot Lease A communication was read from Rose Story Hogan aooepting a renewal of the lease agreement on the property at the northeast corner of Block F'. Original Townsite for a three-year period from the first day of August. 1948. Communication - State Board of Health A oommunication from H. B. Foote. of the State Board of Health. was read regarding a field investigation he made of the city's water supply on Ootober 28th. 1948. I House in Alley - Brady's Rearrangement A written proposal from E. F. Bunker. attorney for Dorothy L. Sheppard. owner of record of Lots "C" and "F" in Brady's Rearrangement of a portion of Babcock&: Davis Addition was presented. The proposal was in regard to a house situated on Lot C. as described above. which house encroaches on the alley between these lots. The proposal pointed out that this house has been buH t for many years. that it was in its present location ~en the plat of Brady's Rearrangement was accepted by the City. and that it is now impractical to change or move that part of it whioh is in the alley. The proposal was that the owner would deed three (3) feet from the west end of Lot F to the City if the City 'W;) uld deed three (3) feet of the alley at the east end of Lot C to the owner. that three (3) feet being the part of the alley on which the house encroaches. In discussion it was pointed out that Lot F is not directly east of Lot C and that the proposal as presented by Mr. Bunker would not provide a usable alley at this location. It was moved by Commissioner Healy. seconded by Commissioner Lowe. that the City Engineer be instructed to prepare a plan for re-location of the alley which plan, after study and approval by the City commi~~ion; could r ft ~ . - ~ ~ be presented to the property owners involved as a counter-proposal for the plan pres~nted by-Mr. I Bunker and the motion was carried by the following Aye and No vote: those voting Aye being Mayor Sorenson. Commissioner Lowe and Commissioner Healy; those voting No. none. Distribution of Advertising from the Air The matter of distributing advertising from the air was discussed. and it was moved by Commissioner Healy. seconded by Commissioner Lowe. that the City Attorney be instructed to look into the matter and to prepare an ordinance prohibiting distribution of advertising from the air over the Ci~ and the 187 motion was carried by the following Aye and No vote: those voting Aye being Mayor Sorenson. Commissioner Lowe and Commissioner Healy; those voting No. none. Claims The Manager presented claims of the Standard Construction Company for work in Special Improve- ment District No. 345. in the amount of $2.000.00. He stated that the bonds in this improvement ,.1 district have not been advertised for sale. The claim of the Standard Construction Company in the amount of $2.014.71 representing the 90-day reserve held in Special Improvement District No. 341 was also presented. The Manager stated that the claims are true and lawful olaims against The City of Bozeman and recommends that warrants be drawn for their payment. After examination of the claims by the City Commission. it was moved by Commissioner Lowe, seoonded by Commissioner Healy that the olaims be approved and warrants drawn for their payment at such time as there is money in the respeotive aooounts S.I.D. No. 341 of S. I. D. 345 anq/to pay said claims and the motion was carried by the following Aye and No vote: those voting Aye being Mayor Sorenson. Commissioner Lowe and Commissioner Healy; those voting No. none. Sale of S. I. D. No. 345 Bonds The Manager stated that, in order to pay the contractor for the work in Speoial lmprovement District No. 345. bonds of said district must be sold. State law requires that such bonds be adver- tised for sale. It was moved by Commissioner Lowe. seconded by Commissioner Healy that the Cle rk be authorized to advertise said bonds for sale and the motion was carried by the following Aye and No vote: those voting Aye being Mayor Sorenson. Commissioner Lowe and Commissioner Healy; those voting No. none. Sale of S. I. D. No. 347 Bonds I The Manager stated that no bids have been received for Special Improvement District No. 347 bonds. In view of the fact that these bonds have been advertised for sale. and no bids have been received. it was moved by Commissioner Healy. seconded by Commissioner Lowe that the Clerk be authorized to negotiate for the sale of these bonds at the best possible price within the limits as provided by law. and the motion was carried by the following Aye and No vote: those voting Aye being Mayor Sorenson. Commissioner Lowe and Commissioner Healy; those voting No, none. Manager & Chief of' Police to Billings The Manager requested authority for himself and Chief of Police A. N. Haas to visit Billings to confer with municipal authorities of that city and to use a car from the Bozeman folice Department as transportation on the trip. It being considered in the public interest. it was moved by Commissioner Healy. seconded by Commissioner Lowe. that the requested travel be authorized and that the expense involved be paid from the General Fund and the motion was carried by the following Aye and No vote: those voting Aye being Mayor Sorenson. Commissioner LOWe and Commissioner Healy; those voting No. none. Adjourrunent There being no further business to come before the Commission at this time, it was moved by Commissioner Lowe, seconded by Commissioner Healy that the meeting adjourn and the motion was carried I by the following Aye and No vote: those voting Aye being Mayor Sorenson.
