HomeMy WebLinkAbout1949-01-26 204 Bozeman, Montana January 26th, 1949 The Commission of The City of Bozeman met in regular session in the Commission Room, City Hall Building, Wednesday afternoon, January 26th. 1949 at 1:00 o'clock ~. M. Those being present were Mayor Sorenson, Commissioner Lowe, Commissioner Healy, City Manager Henderson, City Attorney Lovelace and the Clerk. when the following proceedings were had: The minutes of the last regular session were read, and it was moved by Commissioner Healy, seconded I by Conunissioner Lowe that the minutes be approved as read, and the motion was carried by the f'ollo'Wing Aye and No vote: those voting Aye being Mayor Sorenson, Corrnnissioner Lowe and Commissioner HeMY; those voting No, none. Chamber of' Conunerce Representative Present Mr. Heber Forter, Chairman of' the Committee on Civic Affairs, of the Bozeman Chamber of Commerce was present. He stated that his committee represents both the "Senior" and "Junior" Chambers and that it is his hope and plan that some member of his committee will attend each Commission meeting so that the Chamber of Commerce can keep in closer touch with City af'fairs and be better prepared to "Lend a hand" wherever possible. Mr. Forter was most cordially welcomed and urged to induce others to attend Conunis- sion meetings. Defaulted Bonds of' old S. I. Districts The City Manager called attention to the fact that, in Special Improvement Districts created prior to February 25th, 1929 when the Special Improvement District Revolving l<'und was established by State Law, there are approximately $37,000.00 of bonds outstanding which are in default and, f'rom a legal standloint, worthless. There are, in other S. r. D's. similarly established, cash balances totaling $3,872.98. He I discussed the possibility of using this cash and offering a p~ment of 10% of the face value of these I / defaul ted bonds to bond holders who WJ uld surrender their bonds for such payment. ,j The Manager pointed out that, while neither the City nor the property in the S. I. D's concerned have any legal obligation for the payment of' these bonds, they must be carried as outstanding on City records and those records are detrimental to present sale of S. I. D. bonds at advantageous rates. The City Attorney was instructed to examine the law to ascertain what uses might be made of cash balances left in an S. I. D. f'und af'ter all bond and interest obligations of the district have been paid. Salary of Chief & Ass't Chief of }'ire & Police Departments The City Manager asked f'or a clarif'ication of' policy relative to salaries of' Chiefs and Assistant Chiefs of the Folice and Fire Departments. Under existing Montana statutes a minimum salary is set for regular firemen and policenlen of $200.00 plus $1.00 per month for each year of service up to ten years. This City pays salaries to f'iremen and policemen above the minimum set by law and also pays the additional $1.00 par month per year of service except to the Chiefs and Assistant Chief's of the departments. The Manager explained that, if Chiefs and Assistant Chiefs were given increases of $1.00 per month as is given to other firemen and policemen. it would automatically increase the salary of' the Chiefs of the two departments and the Assistant Fire Chief $10.00 per month and the present salary of the folice Captain $3.00 per month. It was moved by Commissioner Lowe. seconded by Commissioner Healy, that the I policy as to pay increases for length of service should apply to all members of the police and fire departments and that the pay increases indicated under this policy are her~:qy_ _approved and the motion - - was carried by the f'ollowing Aye ffild No vote: those voting Aye being-Mayo':r:..SoxeJ!~on, Commissioner Lowe and Commissioner Healy; those votinE No, none. - Advertisement for Bids for Duml-i Truck The Manager presented and read a proposed call for bids for a dump tr..uck for the Street Department. - 205 It was moved by Corrnnissioner Lowe. seconded by Commissioner Healy that the Clerk of' the Co~nission be authorized to advertise this call for bids to be opened February 16th, 1949, and the motion was carried by the following Aye and No vote: those voting Aye being Mayor Sorenson. Commissioner Lowe and Commis- sioner Healy; those voting No. none. ReI-orts I The following reports were presented: Annual report of' the Chief of folice; Cemetery Board for the months of October. November and December, 1948. It was moved by Commissioner Healy. seconded by Gorrnnissioner Lowe that the reTorts be accel-ted and ordered filed and the motion was carried by the following Aye and No vote: those voting Aye being Mayor Sorenson, Commissioner Lowe and Commissioner Healy; those voting No. none. I Request for Deed & Contract to Masonic Tract to be Held in Gallatin Trust Bank A communication from the Board of Trustees of the Bozeman Lodge #18. A. F. & A. M. was read. The Communication request that the lease and option contract and deed for property at the corner of' Babeock and Tracy Avenue. now held in escrow by the CODUnercial National Bank, be transferred to the Gallatin Trust & Savings Bank for the convenience of the Trustees of this Lodge. It was moved by Commissioner Healy, seconded by Commissioner Lowe that this request be approved and that the City Attorney prepare the necessary amendment to the contract and the motion was carried by the following Aye and No vote: those voting Aye being Mayor Sorenson. Commissioner Lowe and Commissioner Healy; those voting No, none. furchese of Band Equipment The Manager stated that members of the Municipal Band have interviewed him relative to the City purchasing certain instruments for the band. They point out that certain instruments are usually owned by individual band members while others are owned by the Band. In the latter category are sousephone, mellophone and baritone horns. the base drum and music racks. To purchase all such equip- ment would require an investment of from $1.800.00 to $2,000.00. Band members recommend that part of this equipment be purchased this year with a view of purchasinG addi bond instruments during the next two or three years until the Band is f'ully equipped. -I It was moved by Commissioner Lowe, seconded by Commissioner Healy that the City Manager be authorized to purchase. f'rom money now available in the Band fund, instruments as recommended by the Band members at a cost of not to exceed $700.00 and the motion was carried by the f'ollowing Aye and No vote: those voting Aye being Mayor Sorenson. Commissioner Lowe and Corrunissioner Healy; those voting No, none. jOolice Chief and Folice Judge to Attend Treining School The Manager presented a prospectus of a conference or short term school to be held at the University of' California. Berkeley, California. from February 7th to 11th, 1949. One special course is offered for Police Judges and Frosecutors. Other Courses are offered for Traffic Officers. Af'ter - ~206 discussion it was moved by Commissioner Healy, seconded by Commissioner Lowe. that. it being in the public interest, Police Judge Johnson and Chief of Folice Haas be authorized to attend this school. that they be permitted to use a City car for transportation, and that their expenses incurred by such attendance be paid from the General Fund and the motion was cQrried by the following Aye and No vote: those voting Aye being Mayor Sorenson, Commissioner Lowe and Commissioner Healy; those voting No, none. Adjournment I 'fuere being no further business to come before the Commission at this time. it was moved by Commissioner Lowe, seconded by Commissioner Healy that the meeting adjourn and the motion was carried by the following Aye and No vote: those voting Aye being Mayor Sorenson, Commissioner Healy and Commissioner Lowe; those voting No, none.
