The Commission of The City of Bozeman met in regular session in the Commission Room,
Ci ty Hall Buildtng, Wednesday afternoon, May 12th, 1948, at 1:00 o'clock P.M. Those
being present were Mayor Sorenson, Commissioner Lowe, Commissioner Healy, City Manager
Henderson, City Attorney Lovelace and the Clerk, when the following proceedings were had:
The minutes of the last regular session were read, and it was moved by Commissioner I
Healy, seconded by Commissioner Lowe that the minutes be approved as read, and th e mo-
tion was carried by the following Aye and No vo te; those voting Aye being Mayor Sorenson,
Commissioner Lowe and Commissioner Healy; those voting No, none.
Platting of Westlake Tract
A committee of owners of property on North Seventh Avenue composed of the following:
Otto Tschache, Herb Hoey, J. H. Newhall, together with their attorney W. W. Lessley were
present to discuss the pIa tting of a portion of wba t is commonly called the~ ~'Westlake
Tract". They stated that to continue Fifth Avenue from Peach Street north through the
tract would rerulre moving the "Button House" at a cost of approximately $2800.00. They
asked the Commission to consider a jog in Fifth Avenue either in Karp's Addition or on
the proposed plat, to avoid the cost of moving this house.
They were informed the t Mr. Wes tlake had previous ly proposed a pla t wi th a jog in
Fifth Avenue, and that his proposal had been disapproved. After consideration, it was
suggested that the cost of moving this house should be shared by the owners proportion-
ately to the amount of land which is being platted, and t~ committee agreed to see what
further can be done to effect such an arrangement. I
Complaint -- Property on Montana Avenue
Mr. Howard Cook, 325 Montana, appeared to enter a complaint regarding a building
on the property adjacent to his residence on the south. Mr. Cook was informed that the
matter would be investigated and proper steps taken to correct any conditions Which do
not conform with all City regulations.
Lease of Eagle's Parking Lot
The Manager stated that the City Attorney as instructed had prepared an amendment
to the lease with the Eagle's Lodge for their lot at the corner of Babcock Street and
Bozeman Avenue. Under the amended lease, the east fifty feet of the tract and an area
thirty-five feet square in the southwest corner of the tract would be eXCluded from the
area owned by the lodge and leased to the City. It was moved by Commissioner Healy,
seconded by Commissioner Lowe that the lease amendment be approved and the Mayor and the
Clerk be authorized to sign the same for The City of Bozeman and the motion was carried
by the following Aye and No vote; those voting Aye being Mayor Sorenson, Commissioner
Lowe and Commissioner Healy; those voting No, non e .
Communication I
A letter was read from the Manager of the local store of J. C. Penney Company to
the Fire Chief expressing gratitude to the Bozeman Fire Department for the swift and
efficient manner in which a fire was extinguished at his store.
Report
The report of the Cashier for the month of April, 1948 was presented. It was moved
by Commissioner Healy, seconded by Commissioner Lowe that the report be accepted and or-
dered filed and the motion was CArried by the following Aye and No vote; those voting
1.21.
Aye being Mayor Sorenson, Commissioner Lowe and Commissioner Healy; those voting No, none.
Applications for City Licenses
The followlng applications for City Licenses were presented:
Belshaw Service Station Larry White
It was moved by Commissioner Healy, seconded by Connniss ioner Lowe tha t the applica tions
be approved and the licenses issued and the motion was carried by the following Aye and
,I No vote; tho.se voting Aye being Mayor Sorenson, Commissioner Healy and Commissioner Lowe;
, those voting No, none.
Appointment of Recreational Director
The City Manager reported that the Board of Public Recreation recommends employment
of Arthur F. Bland jointly by the City and School Dis trict No. 7/;H! R~creation Director
at a salary of $4,100.00 per year. An employment contract, approved by 'the City Attorney,
between School District No.7, The City of Bozeman and Arthur F. Bland was presented. It
was moved by Commissioner Lowe, seconded by Commissioner Healy that the City Manager be
authorized to sign the contract for The Ci ty of Bozeman and the motion was carried by the
following Aye and No vote; those voting Aye being Mayor Sorenson, Commissioner Lowe and
COfimissioner Healy; those voting No, none.
Payment of Advnace to FWA
A resolution for City Officials to take all necessary steps for the return to the
U. S. Government of the monies in the amount of $9,375.00, advanced by FWA to assist in
the planning of the Sewage Treatment Plant (Project, Montana 24-P-56) was presented asfollows;
RESOLUTION
'1 WHEREAS The Ci ty of Bozeman, Montana herein called the "Applicant", has hereto-
fore entered into an agreement with the United States of America, herein called
the "Government", which prOVides that the Government will advance not to exceed
$18,750.00 to assist the Applicant in the planning of certain public work des-
cribed as Sewage Treatment Plant, Bozeman, Montana. (Mont. 24-P-56) and that
the monies so advanced shall be returned to the Government when construction of
the public work is first undertaken, and
WHEREAS pursuant to said agreement, the Applicant has received $8,375.00. and
of slJch sum has expended $9,375.00, which has achieved its purpose in expediting the
plan preparation, and
WHEREAS, no additional advance is needed,
NOW, THEREFORE, BE IT RESOLVED BV the City Commission of The City of Bozeman,
Montana, that the proper officials promptly take all necessary steps to return to
the Government all the monies it advanced to assist in the planning of the said
public work.
BE IT FURTHER RESOLVED that the Government be, and it is hereby released from
all obligations and all claims which the Applicant may have against the Government
in connection with said agreement.
BE IT FURTHER RESOLVED tha t the Governmen t be reques ted to release the Applicant
from the obligation of furnishing a set of the completed plans and specifications
and a report thereon as required by said agreement.
It was moved by Commissioner Lowe, seconded by Commissioner Healy that the resolution
be passed and the motion was carried by the fo llowing Aye and No vote; those voting Aye being
Mayor Sorenson, Commissioner Lowe and Commissioner Healy; those voting No, none.
Sale of SID No. 346 Bonds
I The Manager reported that the construction of the sanitary sewer in Special Improvement
District No. 346 was nearing completion, and that approximately $3,300.00 in SpeCial Im-
provement District No. 346 bonds should be advertised for sale in order to pay the con-
tractor. Whereupon, it was moved by Commissioner Healy, seconded by Commissioner Lowe that
the bonds be advertised for sale as provided by law, and the motion was carried by the fol-
lowing Aye and No vote; those voting Aye being Mayor Sorenson, Commissioner Lowe and Com-
missioner Healy; those voting No, none.

There being no further business to come before the Commission at this time, it was
moved by Commissioner Lowe, seconded by Commissioner Healy that the IDeeting adjourn and
the motion was carried by the following Aye end No vote; those voting Aye being Mayor
Sorenson, Commissioner Lowe and Commissioner Healy; those voting No, none.
