The Commission of The City of Bozeman met in re~llar session in the Commission Room,
City Hall Building, Wednesday afternoon, June 2nd, 1948, at 1:00 o'clock P.M. Thos e being
present were Mayor Sorenson, Commissioner Lowe, Commissioner Healy, Ci ty Mana ger Hend arson,
City Attorney Lovelace, and the Clerk, when the following proceedings were had to-wit:
The rninu tes of the la s t regular session were read, and it was moved by Commissioner
Rea ly, seconded by Commissioner Lowe the t the minutes be approved as read, a nd the motion I
was carried by the following Aye and Po vote; those vot-~ng rlye being Mayor Sorenson, Com-
missioner Lowe And Commissioner Healyj those vot ing No, none.
Bids for Sewage Treatment Plant
The Manager stated that this was the time and place set for the opening of bids for
the construction of the sewage treatment plant. He presented the affidavit of publication
of the Notice to Bidders, whereupon, it was moved by Commis sioner Healy, seconded by Com-
mIssioner Lowe that the bids be opened and read, and the motion was carried by the follow-
ing Aye and No vote; those voting Aye being Mayor Sorenson, Commissioner Lowe and Commis-
sioner Healy; those voting No, non e .
The following bids were thereupon opened and read:
Dalakow-Underseth Construction Co., Helena $ 248,500.00
Haggerty-Messmer Company Bozeman 221,000.00
Riedesel Cons tru.C tion Company Billings 258,000.00
There being no ~uestions from the bidders, it was moved by Commissioner Lowe, seconded
by Commissioner Healy that the bids be referred to Mr. Allan Wymore, Engineer from Burns &
McDonnell and Mr. Fred Quinnell, Resident Engineer of The City of Bozeman for tabulation,
analysis and their recommenda tions and the motion was carried by the fo llowing Aye and I
Novo t e ; those voting Aye being Mayor Sorenson, Commissioner Lowe and Commissioner Healy;
those voting No, none.
Firemen's Claims for Laying Concrete Floor
The Manager called attention to claims filed by City .Firemen for labor on laying a
concrete floor in the rear of the Fire Hall. In the proposal made by the firemen to do
this work, it was understood that they would be paid for their work but a point in ques-
tion arises as to whether or not firemen during hours when they are on regular duty as
firemen, can legally be paid for performing additional duties. It was moved by Commis-
sioner Lowe, seconded by Comrniss1.oner Healy that the question be referred to the City
A ttorne y, tha t , if there is nothing in the law to prohibit pa~Tment, the claims be included
with the regular monthly claims to be approved for payment, and that future policy shall
be that personnel employed by the City of Bozeman on regular monthly' salary shall not be
employed by the City for work other than their normal duties except in cases of emergency
and the motion was carried by the following Aye and No vo te; tho se vo tlng Aye being Mayor

Housing for Oregon Flood Victims I
Mr. Tom Ellis, Secretary of the ChBmber of Con1merce appeared before the Commis s ion
to discuss the possibility of aid to victims of the dtsasterous floods at Portland, Oregon.
He stated that Montana State College now has vacant dormitories which will house 250 persons
and that other temporary housing is a va ila ble in Boz eman. It was agreed that Mayor Soren-
son would send a telegram to the Mayor of Portland, Oregon, to offer temporary housing
and every other possible aid to the flood victims.

Agreement with U.S.G.S.
Copies of the co-operative agreement for surface-water investigations in the East
Gallatin River between the United states Geological Survey and The City of Bozeman were
presented. This agreement being a renewal of the present agreement, it was moved by Com-
missioner Healy, seconded by Commissioner Lowe that the City Manager be authorized to sign
I the agreement for The City of Bozeman, and the motion was carried by the following Aye
and No vote; those voting Aye being Mayor Sorenson, Commissioner Healy and Commissioner
Lowe; thos e va ting No, non e.
Application for City License
The application of R. G. Smith for a city license was presented. It was moved b~T
Commissioner Lowe, seconded b: Commissioner Healy that the application be approved and the
license issued, and the motion was carried by the following Aye and No vote; those voting
Aye being Mayor Sorenson, Commissioner Healy and Commissioner Lowe; those voting No, none.
Claims for the Month
Claims Nos. 3261 to 3455 inclusive were presented on the various funds as fo llows :

The Manager stated that he has audited these claims and finds them to be true and
lawful claims against The Ci ty of' Bozeman and recommends the t warrants be drawn for their
pa ymen t . After examination of the claims in detail by the City Commissioners, it was
moved by Commissioner Healy, seconded by Commissioner Lowe tha t the claims be approved
and warrants drawn for their payment and the motion was carried by the following Aye and
No vo te; those voting i-\,ye beIng Mayor Sorenson, Commissioner Lowe and Commissioner Healy,
those voting No, none.

Bond of Police Judge
The continuation certificate of the bond of Lloyd M. Johnson, Police Judge, in the
amount of $1,000.00 was presented. The certificate was approved as to form by the City
Attorney, whereupon, it was moved by Commissioner Lo'." e, seconded by Commissioner Healy that
the continuation certificate be accepted and approved and the motion was carried by the
following Aye and No vote; those voting Aye being Mayor Sorenson, Commissioner Lowe and
Commissioner Healy; those voting No, none.

Appointment of Don Bennett to Airport Board
Mayor Sorenson announced the appointment of Don Bennett as the City's member to the
Galla tin Field Board for a three year term ending .Jul~T 30th, 1951. It was moved by Commis-
sioner Lowe, seconded by Commissioner Healy that the appointment be approved and themotion
was carried by the following Aye and No vote.: those voting Aye being Mayor Sorenson, Com-
missioner Healy and Commissioner Lowe; those voting No, none. I
Communication -- Roads on State Property
A communication from Fred W. Schilling, City Attorney, Missoula, Montana was read,
giving information on what the City of Missoula does in maintaining and improving streets
on the campus of the University of Montana.
Examlnstion of Depository Bonds
The City Commissioners proceeded to check the Custodian's Receipts for Depository
Bonds to cover the City's deposits in the various city banks. It was moved by COn1rnis-
sioner Healy, seconded by Commissioner Lowe that the bonds being found sufficient that
the list be entered in full on the minutes and the motion was carried by the following

This is to certify that we, the Commission of The City of Bozeman in compliance with
the provisions of Section 4767, Political Code, R.C.M. 1921, as amended by Chapter 49,
Laws of 1929, and as amended by Chapter 23, Extraordinary Session Law of 1933-34, have this
day examined the receipts of the Federal Reserve Bank of Minneapolis for the Depository
Bonds held by the Director of Finance as above listed as security for the deposits of
City Funds held by the several banks of Bozeman and find them to be as above stated.

Resolution No. 622 -- Creating S.I.D. No. 347
The Manager stated that the City Attorney as instructed had prepared the Resolu tion
creating Special Improvement District No. 347, for the installation of water mains on North
Fourth, North Fifth, Durston Road and Villard Street. Resolution No. 622, was presented
entitled:

IMPROVEMENT DISTRICT TO BE KNOWN AND DESIGNATED AS "SPECIAL IMPROVEMENT DISTRICT
mTMBER 347" OF SAID CITY, PURSUANT TO COMMISSION RESOLUTION NO. 621 OF SAID CITY
DECLARING TIm INTENTION OF SAID COMMISSION TO CREATE SAID SPECIAL IMPROVE~ENT
DISTRICT NO. 347 FOR THE USES AND PTffiPOSES SET FORTH AND DETAILED IN SAID COM-
MISSION RESOLUTIOH NO. 621 ON FILE IN THE OFFICE OF THE CLERK OF SAID CITY COM-

It was moved by Commissioner Healy, seconded by Commissioner Lowe that the protests
filed having been insufficien t, said protest be overruled and that Resolution No. 622 be
passed and adopted and the motion was carried by the following Aye and No vote; those voting
Aye being Mayor Sorenson, Commissioner Lowe and Commissioner Healy; those voting No, none.
Bid for Sewage Plant accepted
Mr. Wymore and Mr. Quinnell re turned to the mee ting and s ta ted tha t they had completed
their tabulation and analysis of the bids on the Sewage Treatment Plant. Mr. Wymore, speak-
ing as the representative of Burns & McDonnell, ConslJl ting Engineers, stated that Haggerty-
Messmer Company are the low bidders, that their bid bas been examined in detail and is an
acceptable bid, that the plant can be built at this bid price and the to tal cos t kept wi th-
in funds available for the project, and tha t the experience and s tanding of the members of
the firm of Haggerty-Messmer Company shows them well qualified to execute the work under
I ttis con tra ct. He recommended that the bid of Haggerty-Messmer Company be accepted and
Mr. Q,uinnell concurrod wi th the recommenda tion. It was moved by Commissioner Lowe, se conded
by Commissioner Healy that the bid of Haggerty-Messmer Company be accepted subject to the
City reserving the right to make such changes or deductions as are authorized by the plans
and specifications and as stated and agreed to in the bid submitted and the motion was
carried by the following Aye and No vote; those voting Aye being Mayor Sorenson, Cornmissloner
Lowe and Commissioner Healy; those vo ting No, non e.
