HomeMy WebLinkAbout1948-08-04 t48 Bozeman, Montana - August 4th, 1948 The Commission of The City of Bozeman met in regular session in the Commission Room, City Hall Building, Wednesday afternoon, August 4th, 1948, at 1:00 o'clock P.M. Those being present were Mayor Sorenson, Commissioner Lowe, Commissioner Healy, City Manager Henderson, City Attorney Lovelace and the Clerk when the following proceedings were had: The minutes of the last regular session were read, and it was moved by Commissioner I Healy, seconded by Commissioner Lowe that the minutes be approved as read, and the motion was carried by the following Aye and No vote; those voting Aye being Mayor Sorenson, Com- missioner Lowe and Commissioner Healy;those voting No, none. Reports The following reports for themonth of July, 1948 were presented: Employment Office Police Judge Librarian Building Inspector Water Collector Fire Chief Sanitary Inspector Recreation Director Police Chief It was moved by Commissioner Healy, seconded by Commissioner Lowe that the reports be accepted and ordered filed and the motion was carried by the following Aye and No vote; those voting Aye being Mayor Sorenson, Commissioner Lowe and Commissioner Healy; those voting No, none. Applications for City Licenses The following applications for City Licenses were presented: Idaho Pole Company Alf red J. Isaac The Foodsicle It was moved by Commissioner Lowe, seconded by Commissioner Healy that the applications be approved and the licenses issued and the motion was carried by the following Aye and No I vote; those voting Aye being Mayor Sorenson, Commissioner Lowe and Commissioner Healy; those voting No, none. O.R.C. Request to Erect Sidewalk Sign Major Miller, Unit Instructor, Organized Reserve Corp, presented a request through the City Manager, to set a sidewalk sign in front of the O.R.C. office on West Main Street; this sign to be similar to that used by the U.S. Army Recruiting Service and to be in ac- cordance with the sketch of the proposed sign furnished with the request. It was moved by Commissioner Healy, seconded by Commissioner Lowe that the request be granted and the motlonwas carried by the following Aye and No vote: those voting Aye being Mayor Sorenson, Commissioner Lowe and Commissioner Healy; those voting No, none. Claims for the Month Claims Nos. 3711 to 3941 inclusive were presented on the various funds as follows: General $ 17,666.17 Band 1,515.65 Water 5,120.,7 SDS Construction 9,473. 7 Library 565.70 I Park 3,748.94 Cemetery 2,209.57. Parking Meter 690.13 Garbage 2r.38 ~ .- . - - " W-H Tax 1,3 5.20 Police Reserve 1,5 6.15 - ~ ~ - ~ Cemetery Suspense 32.00 ' S.l.D. 753.01 Total $ 44,985.94 The Manager stated that he has audited these claims and finds 'them to be true and lawful claims against The City of Bozeman and recommends that warrants-.be drawn for their 1.49 payment. After examination of the claims in detail by the City Commission, it was moved by Commissioner Healy, seconded by Commissioner Lowe that the claims be approved and war~ rants drawn for their payment and the motion was carried by the following Aye and No vote; those voting Aye being Mayor Sorenson, Commissioner Healy and Commissioner Lowe;those voting No, none. I Communication -- Public service Commission Re Sewer Rates ACP~dunication from the Public Service Commission was read, quoti~g an opinion from the Attorney-General to the effect that the Public Service Commission has no authority to approve rates for sewer rentals, and they are therefore cancelling their action of February 21st, 1948, approving the sewer rates of the City of Bozeman. Eliminating Chlorine Contact Chamber Mr. H. B. Foote, of the State Board of Health, Dean Cobleigh, Dr. A. D. Brewer and Fred Quinnell were present to discuss matters pertaining to the sewage treatment plant. The particumr point in question was the elimination of the chlorine contact chamber. It was explained that this chlorine contact chamber had been eliminated from the present contract because estimates now indicate that there will not be sufficient money > in the construction fund to meet the entire cost of the plant in accordance with present plans. Elimination of the chlorine contact chamber cuts the present general contract $9,375.00. The need for some procedure or some structure to provide not less than a fifteen-minute retention period for the effluent from the clarifier was discussed in detail, ,and the use of one of the City' a present settling basins for this purpose was I considered. Mr. Foote stated that eliminating the chlorine contact chamber from the present con- tract was done without the approval of the State Board of Health; that continued daily use of the present settling tanks would not be approved; and that plans for a lesser structure than the originally planned chlorine contact chamber or for some method of sec,~ing the required fifteen-minute retention period of the plant effluent should be developed and submitted to the state Board of Health for approval without delay. He stated further that, to the best of his knowledge, all other construction now under way at the Sewage Treatment Plant is in accordance with plans approved by the State Board of Health. It was agreed that this matter would be taken up with Burns and McDonnell within one week, that the urgency of this situation would be impressed on them and that they would be requested to submit, with the least possible delay, recommendations or plans for some lesser structure than originally platu'.i.ed for the chlorine contact chamber or for some alternate method of securing the required fifteen-minute retention period for the plant effluent. I V-J Day Celebration The Manager stated that the American Legion haa requested permission to conduct a street dance, to have the weekly band concert on Main Street instead of at Bogert's Grove, and to show outdoor movies on South Bozeman Avenue, August 12th, 1948, V-J Day. He stated this would necessitate the closing of Main Street and Bozeman Avenue during this celebration from 8:00 P.M. to 11 P.M. The Commission expressed approval permitting such celebration by the American Legion for V-J Day. 150 Ordinance No. 747 -- Appropriation Ordinance The Manager stated that the appropriation ordinance for the fiscal year ending June 30th, 1949 had been prepared, and presented Ordinance No. 747, entitled: AN ORDINANCE APPROPRIATING MONIES FOR EXPENDITURES DEEMED NECESSARY AND IN ACCORDNACE WITH BUDGETaRY REQUIREMENTS FOR MAINTENANCE ETC., OF THE MUNICIPAL GOVERNMENT OF THE CITY OF BOZEMAN, MONTANA FOR THE FISCAL YEAR ENDING JUNE 30, 1949. It was moved by Commissioner Lowe, seoonded by Commissioner Healy that the Ordinance I be provisionally adopted and August 11th, 1948 be set as the date for public hearing and motion was carried by the following Aye and No vote; those voting Aye being Mayor Sorenson, Commissioner Lowe and Commissioner Healy;those voting No, none. Ordinance No. 74.8 -- Salary Ordinance The Manager stated that the annual salary ordinance setting the salaries of the City Manager, the Heads of the Departments and the employees of the City Commission had been prepared. He presented Ordinance No. 748, entitled: AN ORDINANCE OF THE GI'rY OF BOZEMAN, MOnrrANA FIXING THE MONTHLY SALARY AND OFFICIAL BOND OF THE CITY MANAGER, THE HEADS OF DEPARTMEN'rS, AND THE EM- PLOYEES OF THE CI'rY COltMISSION AS RE~UIRED BY LAW. It was moved by Commissioner Healy, seconded by Commissioner Lowe that the ordinance be passed and adopted and the motion was carried by the following Aye and No vote; those voting Aye being Mayor Sorenson, Commissioner Lowe and Commissioner Healy;those voting No, none. Resolutio~ No. 623 -- Tax Levy The Manager stated that the resolution setting the tax levy for the fiscal year end- ing June 30th, 1949 had been prepared. He presented Resolution No. 623, entitled: I A RESOLUTION OF THE COMMISSION OF THE CITY OF BOZEMAN DETERMINING THE AMOUNT OF CPI'Y TAXES FOR ALL PURPOSES, GENERAL AND SPECIAL TO BE LEVIED AND ASSESSED ON TAXABLE PROPERTY IN THE CITY OF BOZEMAN, STATE OF MONTANA, FOR THE FISCAL YEAR ENDING JUNE 30th, 1949. It was moved by Commissioner Healy, seconded by Commissioner Lowe that the resolution be passed and adopted and the motion was carried by the following Aye and No vote; those voting Aye being Mayor Sorenson, Commissioner Lowe and Commissioner Healy;those voting No, none. Adjournment There being no further business to come before the Commission at this time, it was moved by Commissioner Lowe, seconded by Commissioner Healy that the meeting adjourn and the motion was carried by the following Aye and No vote; those voting Aye being Mayor Sorenson, Commismoner Healy and Commissioner Lowe; those voting No, none.
