The Commission of The City of Bozeman met in regular session in the Commission Room, City Hall
Building, Wednesday afternoon. August 18th. 1948, at 1:00 o'clock F. M. Those being present were
Mayor Sorenson. Commissioner Lowe. Commissioner Healy. City Manager Henderson, City Attorney Lovelace.
I and the Clerk, when the following proceedings were had:
The minutes of the last regular session were read. and it was moved by Commissioner Lowe. seconded
by Commissioner Healy that the minutes be approved as read. and the motion was carried by the following
Aye and No vote: those voting Aye being Mayor Sorenson. Commissioner Lowe and Commissioner Healy;
those voting No. none.
Fublic Hearing S. I.D. No. 348
The Manager stated that this was the time and place set for public hearing on the creation of
Special Improvement District No. 348, paving in the west part of the City. He presented the affidavit
of publication of the Notice and the Clerk's Mailing Certificate that all property owners of record
had been notified. The written protests from property owners and certain written withdrawals of some
of the same protests were also presented. After checking the protests and withdrawals the City
Engineer reported the net protests represented 46% of the area of the property in the proposed district.
Many property owners were present and improvements construoted by Special Improvement Districts were
discussed.
After hearing those present. and consideration of the protests filed. it was moved by Commissioner
Lowe, seconded by Commissioner Healy that the protests be sustained and the motion was carried by the
I following Aye and No vote: those voting Aye being Mayor Sorenson. Commissioner Lowe and Commissioner
Healy; those voting No, none.
Final Fayment of S. I. D. No. 341 Construction
The Manager stated that the contractor has completed the construction of Special Improvement
District No. 341, and presented claim No. 3942. covering the final payment less the usual 90-day
reserve. After examination of the claim, it was moved by Commissioner Healy, seconded by Commissioner
Lowe that the claim be approved and a warrant drawn for its payment and the motion was carried by the
following Aye and No vote: those voting Aye being Mayor Sorenson, Commissioner Lowe and Commissioner
Healy; those voting No, none.
CFA Report
The report of J. B. Mayland and B. A.Risley, CPA's of the annual audit for the year ending
June 30th, 1948 was presented to the Commission for study.
Resolution No. 625 -- Maintenance Assessment
The Manager stated that the resolution levying an assessment in the amount of $6,092.32 for the
maintenance of parkings in the various parking maintenance districts for the year 1948 had been
prepared. He presented Resolution No. 625, entitled:

It was moved by Commissioner Healy, seconded by Commissioner Lowe that the resolution be provi-
sionally passed and August 25th, 1948 be set as the date for public hearing and the motion was carried
by the following .Aye and No vote: those voting ~e being Mayor Sorenson, Commissioner Lowe and
Commissioner Healy; those voting No. none.

Resolution No. 626 -- Lighting Assessment
The Manager stated that the resolution levying the assessment in the amount of .1,687.45 for the
maintenance of the special lighting districts in the City had been prepared. He presented Resolution
No. 626, entitled:
A RESOLUTION OF THE COMMISSION OF THE CITY OF BOZEMAN, MONTANA, LEVYING AND ASSESSING LIGHTING
DISTRICT MAINTENANCE AND ELECTRICAL CURRENT COSTS FOR SfECIAL IMPROVEMENT LIGHTING DISTRICTS I
NUMBERS 100, 284, 288, 289, 290, 295 and 300 OF THE CITY OF BOZEMAN, FURSUANT TO THE fROVISIONS
OF SECTION 5266 R.C.M., 1936.
It was moved by Commissioner Lowe, seconded by Commissioner Healy that the resolution be provi-
sionally adopted and August 25th, 1948 be set as the date for the hearing of protests and the motion
was carried by the following Aye and No vote: those voting Aye being Mayor Sorenson, Commissioner
Lowe and Commissioner Healy; those voting No, none.
Mystic Lake Dam ReF airs
The Manager read a communication from the State Water Conservation Board, giving recommendations
for maintenance and repair work that should be done at Mystic Lake Dam. He stated that the letter
would be taken up with the shareholders.
Fetition for SID on West College
A petition of property owners requesting that a Special Improvement District be oreated to provide
an oil-mix mat on West College Street from Fourth Avenue to Eighth Avenue was presented. It was moved
by Commissioner Lowe, seconded by Commissioner Healy that the City Attorney be instructed to prepare a
resolution of intention to create the district and the motion was carried by the following Aye and No
vote: those voting Aye being Mayor Sorenson, Commissioner Lowe and Commissioner Healy; those voting
No, none. I
Sewer Rentals Adjusted
The Manager presented the following list of water users where an unusual oondition has oaused
the charge for the sewer rental to be out of proportion to the average amount of water consumed and
recommended that the following adjustments for sewer rental be made:

After consideration, it was moved by Commissioner Healy, seconded by Commissioner Lowe that the
adjustment be made according to the recommendations and the motion was carried by the 10110wing Aye
and No vote: those voting Aye being Mayor Sorenson, Commissioner Lowe and Commissioner Healy; those
voting No, none.
Application for S~ecial Beer License
The application of the VFW Fost #903 for a special three-day beer lioens8 to sell beer at the City
Soft Ball Fark during the state Soft Ball Tournament was presented. In considering the application, I
it was thought that issuing a license to sell beer at a City recreation park would set a precedent
which could not be allowed in other similar requests and it was thought inadvisable to approve the
application, whereupon, it was moved by Commissioner Healy, seconded by Commissioner Lowe that the
application be denied and the motion was carried by the following Aye and No vote: those voting Aye
being Mayor Sorenson, Commissioner Lowe and Commissioner Healy; those voting No, none.

Parking on South Willson
The Manager stated that inquiry had been made by Mr. H. L. Casey regarding the changing of the
parking on South Willson between Main and Babcook Streets. He stated that Mr. Casey favored the angle
parking on the east side of Willson Avenue. It was pointed out that beoause of the jog in Willson
I Avenue at Baboook Street, it would be in the publio interest to have parallel parking on the east
side of Willson and angle parking on the west side of Willson between Main and Baboook Streets, and
it was agreed that the parking strips on the streets should be ohanged as planned.
Quit Claim Deed to Vacate Strip on North Willson
A quite claim deed to a strip of land on North Willson, as vaoated by Ordinanoe No. 669. was
presented. It was stated that George Brandt, owner of Lots 21-24, Block 2, Beall' sThird Addition
has requested a quit claim deed to the vacated strip abutting his property. City Attorney Lovelaoe
stated that the deed was in order, whereupon, it was moved by Commissioner Healy, seconded by Commissioner
Lowe that the Mayor and the Cle rk of the Commission be authorized to sign the deed for the City of
Bozeman, and the motion was oarried by the following Aye and No vote: those voting Aye being Mayor
Sorenson, Commissioner Lowe and Commissioner Healy; those voting No, none.
Adjourwnent
There being no further business to come before the Commission at this time, it was moved by
Commissioner Lowe, seconded by Commissioner Healy that the meeting adjourn and the motion was carried
by the following Aye and No vote: those voting Aye being Mayor Sorenson, Commissioner Lowe and
Commissioner Healy; those voting No, none.
