HomeMy WebLinkAbout1948-08-25 157 Bozeman, Montana August 25, 1948 The Commission of The City of Bozeman met in regular session in the Commission Room, City Hall Building, Wednesday afternoon, August 25th, 1948, at 1:00 otclock P. M. Those being present were Mayor Sorenson, Commissioner Lowe, Commissioner Healy. City Manager Henderson, City Attorney Lovelace, I and the Clerk, when the following proceedings were had: The minutes of the last regular session and of the special meeting held Tuesday evening, August 24th, 1948 were read. and it was moved by Commissioner Lowe, seoonded by Commissioner Healy that the minutes be approved as read, and the motion was carried by the following Aye and No vote: those voting ~e being Mayor Sorenson, Commissioner Lowe and Commissioner Healy; those voting No, none. Application for City License The application of Hubert McIntyre for a one-half year City License was presented. It was moved by Commissioner Lowe. seconded by Commissioner Healy that the application be approved and the lioense issued and the motion was carried by the following Aye and No vote: those voting Aye being Mayor Sorenson, Commissioner Lowe and Commissioner Healy; those voting No. none. Ordinance No. 747 -- Final Passage The Manager stated that this was the time and place set for the final passage and adoption of the annual Appropriation Ordinance. He presented the affidavits of publication of the Notice of Public Hearing and also the Appropriation Ordinance. and stated that no protests had been filed and no one was present to protest, whereupon he presented Ordinance No. 747, entitled: .AN ORDINANCE AFPROFRIATING MONIES FOR EXPENDITURES DEEMED NECESSARY AND IN ACCORDANCE WITH EUDGETORY REQUIREMENTS FOR MAINTENANCE ETC., OF THE MUNICIFAL GOVERNMENT OF THE I CITY OF BOZEMAN, MONTANA FOR THE FISCAL YEAR ENDING JUNE 30, 1949. It was moved by Commissioner Lowe, seconded by Commissioner Healy that the Ordinance be finally passed and adopted and the motion was oarried by the following Aye and No vote: those voting Aye being Mayor Sorenson, Commissioner Lowe and Commissioner Healy; those voting No, none. Transfer of Funds The Manager stated that Ordinanoe No. 747, the Appropriation Ordinanoe. provided for the transfer of $28,000.00 from the Water Fund to the General Fund, and presented a claim providing for this .I transfer. After examination of the claim it was moved by Commissioner Healy, seconded by Commissioner Lowe that the claim be allowed and a warrant drawn for its payment and the motion was carried by the following Aye and No vote: those voting Aye being Mayor Sorenson, Commissioner Lowe and Commissioner Healy; those voting No, none. Rlilports The following reports for the month of July, 1948 were presented: Ci ty Eng ineer Director of Finance It was moved by Commissioner Healy, seconded by Commissioner Lowe that the reports be accepted and ordered filed and the motion was carried by the following Aye and No vote: those voting Aye being I Mayor Sorenson, Commissioner Lowe and Commissioner Healy; those voting No, none. Gravel for Sewage Flant The Manager r"'flo a communicai;ion from Burns & McDonnell. Consulting Engineers for the Sewage Disposal Flant, which stated that, after testing a sample of gravel from the Belgrade pit. they tem it aborder line" gravel and would prefer material of better quality. Mr. Quinnell, Resident Engineer, stated that he has check with engineers of the State Highway CommiSSion, with the Montana representative of' the Portland Cement Association, with engineers at 1.58 Montana State College, and with other well qualified authorities on gravel aggregate. While general opinion of these authorities rated "Helena" gravel high, in no case did he find where accurate tests had been made of Helena gravel to compare with the tests which Burns & McDonnell had had made of' "Belgrade" gravel. Mr. Quinnell pointed out that having tests made of "Helena" gravel would take considerable time and would seriously delay work now in progress at the Sewage Treatment Flant. It was also pointed out that Belgrade is much the closest source of supply for gravel and securing the I material from Helena or other distant points would involve additional cost of several thousand dollars for the contractor. After careful consideration of' Mr. Quinnell's recommendations and, in view of the statement from Burns & McDonnell that use of Belgrade aggregate would be permitted if "fines" are removed from it in accordance with their specifications, it was moved by Commissioner Lowe, seconded by Commissioner Healy, that Fred Quinnell be authorized to permit the contractors to use "Belgrade" gravel in the construction of the Sewage Treatment Plant on condition tJ:a t" fines" are removed from it to meet Burns & McDonnell's specifications and that Mr. Quinnell will have frequent tests made to insure that the material does meet those specifications and the motion was carried by the following Aye and No vote: those voting Aye being Mayor Sorenson, Commissioner Lowe, and Commissioner Healy; those voting No.. none. Resolution No. 625 -- Final Fassage The Manager stated that this was the time and place set for the hearing of protests to the final adoption of the resolution levying the assessment for the maintenance of parkings for the year 1948. He presented the affidavit of publication of the Notice.. and stated that no one was present to protest and no protests have been filed, whereupon, he presented Resolution No. 625, entitledz I A RESOLUTION OF THE COMMISSION OF THE CITY OF BOZEMAN, LEVYING AND ASSESSING A SPECIAL ASSESSMENT OF TAXES uPON ALL THE FROi'ERTY IN SPECIAL IMPIDVEMENT DISTRICTS OF THE CITY OF BOZEMAN, COUNTY OF GALLATIN, STATE OF MONTAliJA, FUR THE MAINTENANCE OF PARKINGS TO DEFRAY THE COST OF MAINTAINING THE fARKINGS WITHIN SAID SFECIAL IMi'ROVEMENTDISTRICTS OF THE CI'lY OF BOZEMAN FOR THE YEAR 1948. It was moved by Commissioner Lowe, seoonded qy Commissioner Healy that the resolution be finally passed and adopted and the motion was carried by the following Aye and No vote: those voting Aye being Mayor Sorenson, Commissioner Lowe and Commissioner Healy; those voting No, none. Resolution No. 626 -- Final fassage The Manager stated that this was the time and place set for the public hearing on the adoption of the resolution levying the assessment for the special lighting districts in the City for the year 1948. He presented the affidavit of publication of the Notice, and stated that no one was present to protest and no protests have been filed. He presented Resolution No. 626, entitledz A RESOLUTION OF THE COMMISSION OF THE CITY OF BOZEMAN, M:>NTANA, LEVYING .AND ASSESSING LIGHTING DISTRICT MAINTENANCE .AND ELECTRlCAL CURRENT COSTS FOR SPECIAL IMPl10VEMENT LIGHTING DISTRICTS NUMBERS 100, 284.. 288, 289, 290, 295 and 300 OF THE CITY OF BOZEMAN, FURSUANT TO THE FROVISIONS OF SECTION 5266 R.C.M., 1935. It was moved by Commissioner Healy, seconded by Commissioner Lowe that the resolution be finally passed and adopted and the motion was carried by the following Aye and No vote: those voting Aye being Mayor Sorenson, Commissioner Lowe and Commissioner Healy; those voting No, none. I Resolution No. 627 -- Snow Assessment The Manager stated that the resolution levying assessments in the amount of $85.14 for hand removal of snow for the year 1947-48 had been prepared. He presented Resolution No. 627.. entitled: A RESOLUTION OF THE COMMISSION OF THE CITY OF BOZEMAN, LEVYING AND ASSESSING A SFECIAL ASSESSMmT OF TAXES UFON CERTAIN FROFERTIES IN THE CITY OF BOZEMAN, COUNTY OF GALLATIN, STATE OF MONTANA, TO DEFRAY THE COST OF REMOVAL OF SNOW FOR THE YEAR 1947-48 PURSUANT ro PROVISIONS OF ORDINANCE NO. 502, ENTITLED: "AN ORDINANCE PROVIDING FOR THE REMOVAL OF SNOW FBOM THE SIDEWALKS IN THE CITY OF BOZEMAN ANDREPEALmG ORDINANCE NO. 385, ENTITLED: 'AN ORDmANCE FROVIDING FOR THE REMOVAL OF SNOW AND ICE, DIRT, FILTH, AND OTHER OBSTRUCTIONS FROM SIDEWALKS ON MAIN STREET BETWEEN WALLACE AVENUE AND FOURTH AVENUE IN THE CITY OF BOZEMAN'". 159 It was moved by Commissioner Healy, seoonded by Commissioner Lowe that the resolution be pro- visionally adopted and September 1, 1948 be set as the date for hearing protests and the motion was oarried by the following Aye and No vote: those voting Aye being Mayor Sorenson, Cownissioner Lowe and Commissioner Healy; those voting No, none. Petition for Faving Distriot I Mr. R. D. Lanphear presented a petition of property owners, requesting that a speoial improvement distriot be oreated to provide for paving on Lamme Street from Church to Rouse Avenue and on Rouse Avenue from Lamme to the first alley north of :Main Street. It was moved by Commissioner Lowe, seconded by Commissioner Healy that the City Engineer prepare estimates of cost for the proposed district and the motion was carried by the following Aye and No vote: those voting Aye being Mayor Sorenson, Commissioner Lowe and Commissioner Healy; those voting No, none. fetition for Traffic Signs Near Hawthorne School Mr. R. D. Lanphear also presented a petition of approximately 60 signers of property owners and parents of children attending the Hawthorne School, requesting that control lights or stop signals be installed near this school for the protection of the children crossing the streets. It was decided that the matter would be disoussed with the members of the School Board and also the Chief of Polioe before action is taken. Improvement on College Street -- 8th to 11th The City Manager reported that Mr. Fred Brown, Resident Engineer for the State Highway Department had reported that the estimated cost for the improvements of College Street from Eighth to Eleventh Avenue is approximately $19,140.03; that under the federal aid projeot the cost to be paid by the City I property owners would be approximately $4,786.00. It was decided to get the reaction of the property owners involved before an attempt is made to create a Special Improvement Distriot. Adjournment There being no further business to come before the Commission at this time, it was moved by Commissioner Lowe, seconded by Commissioner Healy that the meeting adjourn and the motion was carried by the following Aye and No vote: those voting Aye being Mayor Sorenson, Commissioner Lowe and Commissioner Healy; those voting No, none.
