HomeMy WebLinkAbout1948-09-01 160 Bozeman, Montana September 1, 1948 The Commission of The City of Bozeman met in regular session in the Commission Room, City Hall Building, Wednesde.y afternoon, September I, 1948, at 1;00 0' clock f. M. Those being present were Mayor Sorenson, Commissioner Lowe, Commissioner Healy, City Manager Henderson, City Attorney Lovelace, and the Clerk, when the following proceedings were had: The minutes of the last regular session were read, and it waS moved by Commissioner Healy, I seconded by Commissioner Lowe that the minutes be approved as read, and the motion was carried by the following Aye and No vote: those voting Aye being Mayor Sorenson, Commissioner Lowe and Commissioner Healy; those voting No, none. Continuation Certificates - Gas Fitter's & Plumbing Bond~McCay Hardware Co. & Montana Air Conditioning The continuation certifioates of the Montana Air Conditioning and the McCay Hardware Company for Gas F'itter's bond and for Plumbing bond were presented. The certifioates were approved as to fo~ by the Ci~ Attorney. whereupon, it was moved by Commissioner Lowe. seconded by Commissioner Healy that the certificates be approved and accepted end the motion was carried by the following Aye and No vote: those voting Aye being Mayor Sorenson, Commdssioner Lowe and Commissioner Healy; those voting No, none. Traffic Near Hawthorne School The Manager reported that the Chief of Folice has made an investigation of the traffic conditions near the Hawthorne School and stated that the traffic did not warrant stop signs on all the corners at the school, but that additional warning signs of uniform size would be installed. Resolution No. 629 -- Intention to Create S. I. D. No. 349 The Manager stated that the City Attorney as instructed has prepared the resolution of intention I to create Special Improvement District No. 349, the paving of College Street with an oil mix mat from Fourth Avenue to Eighth Avenue. He presented Resolution No. 629. entitled: A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF BOZEMAN DECLARING IT TO BE THE INTENTION OF THE CITY OF BOZEMAN TO CREATE A SIreIAL IMI'ROVEMENT DISTRICT TO BE KNOWN AS SPECIAL IMPROVEMENT DISTRICT NUMBER 349 OF THE CITY OF BOZEMAN FOR THE PURPOSE OF' CONSTRUCTING AND INSTALLING AN (OIL MAT} FAVED SURFACE ON EXISTING GRAVEL BASE .AND WHERE NO CURBS NOW EXIST TO INSTALL CONCRETE CURBS ON WEST COLLEGE STREET BETWEEN THE WEST LINE OF FOURTH AVENUE SOUTH AND THE EAST LINE OF EIGHTH AVENUE SOUTH, IN SAID CITY. It was moved by Commissioner Lowe. seconded by Commissioner Healy that the resolution be passed and adopted and September 22nd, 1948 be set as the date for the hearing of protests and the motion was carried by the following Aye and No. vote: those voting Aye being Mayor Sorenson. Commissioner Lowe and Commissioner Healy; those TotiJ~ No. none. Dwelling on East Olive in Fire Zone No. 2 The Manager stated that Mr. Ingo.lph Johnson has made application for a building permit for a dwelling at 415 East Olive Street located in Fire Zone No.. 2, and stated that the building code required a ten-foot side yard and construction of 1 hour fire resistant material. The application of Mr. Johnson shows a twenty-foot side yard on either side of the dwelling and construction of wood I siding. The City Manager recommended that in view of the larger side yard than is required in Fire Zone No.2, that the building permit be issued, whereupon. it was moved by Commissioner Healy, seconded by Commissioner Lowe that the application be approved and the buildinE inspector be instructed to issue the permit for the construction of the dwelling and the motion was carried by the following Aye and No vote: those voting Aye being Mayor Sorenson, Commissioner Lowe and Commissioner Healy; those voting No, none. 1.61 Bids for Heating Units & Insulation of Buildings at City Yards The Manager stated this was the time and place set for the opening of bids for the insulation of one storage building and installation of heating units in two buildings located in the City Yards. He presented the affidavit of publication of the Notice to Bidders, whereupon it was moved I by Commissioner Lowe, seconded by Commissioner Healy that the bids be opened and the motion was carried by the following Aye and No vote: those voting Aye beinE Mayor Sorenson, Commissioner Lowe and Commissioner Healy; those voting No, none. The following bids were thereupon opened and read: Insulation Bid Bid~? Heating Ipstallation F. L. Dye Company . 1,480.00 1,633.95 WIn. C. rowell & Walter Savage 2,217.00 1,557.95 G. L. Anderson 3,363.50 1,611.50 Ray Anderson 1,549.00 no bid After consideration of the bids as submitted, it was shown that the bid of F. L. Dye Company was the low bid, whereupon, it was moved by Commissioner Lowe, seconded by Commissioner Healy that the contract be awarded to the F. L. Dye Company and the motion was carried by the following Aye and No vote: those voting Aye being Mayor Sorenson, Commissioner Lowe and Commissioner Healy; those voting No, none. Reports I The following reports for the month of August, 1948 were presented: Water Collector Fire Chief Folice Judge Librarian It was moved by Commissioner Healy, seconded by Commissioner Lowe that the reports be accepted I and ordered filed and the motion was carried by the following Aye and No vote: those voting; Aye being Mayor Sorenson, Commissioner Lowe and Commissioner Healy; those voting; No, none. Application for City License The application of the College D~ive Inn for a City License was presented. It was moved by Commissioner Healy, seconded by Commissioner Lowe that the application be approved and the license issued and the motion was carried by the following Aye and No vote: those voting; Aye being Mayor Sorenson, Commissioner Lowe and Commissioner Healy; those voting No, none. Final Passage Resolution No. 627 - Snow Removal The Manager stated that this was the time and place set for the hearing of protests to Resolution No. 627, assessing cost of removal of snow by hand shovelling for the year 1947-1948. He presented the affidavit of publication of the Notice to property owners and stated that no one was present to protest and no protests have been filed. It was thereupon, moved by Commissioner Healy, seconded by Commissioner Lowe that Resolution No. 627, entitled: A RESOLUTION OF TEE COMMISSION OF THE CITY OF BOZEMAN, LEVYING AND ASSESSING A SFECIAL ASSESSMENT OF TAXES UFON CERTAIN FROi'ERTIES IN THE CITY OF BOZmAN, COUNTY OF GALLATIN, STATE OF MONT.ANA, TO DEFRAY THE COST OF RmOVAL OF SNOW FOR THE YEAR 1947-48 PURSU.ANT TO FROVISIONS OF ORDINANCE NO. 502, ENTITLED: "AN ORDINANCE l'ROVIDINGFOR THE REMOVAL OF SNOW FOOM THE SIDEWALKS IN THE CITY OF BOZEMAN AND REl'E.ALING ORDINANCE NO. 385, EN~ ITLED: I.AN ORDINANCE l'ROVIDINGFOR THE I REMOVAL OF SNOW AND ICE, DIRT, FILTH, AND OTHER OBSTRUCTIONS FROM SIDEWALKS ON MAIN STREET BETWEEN WALLACE AVENUE AND FOURTH AVENUE IN THE CITY OF BOZEMAN I". be finally passed and adopted and the motion was carried by the following Aye and No vote: those voting Aye being Mayor Sorenson, Commissioner Lowe and Commissioner Healy; those voting No, none. Resolution No. 628 -- Sprinkling Assessment The Manager stated that the resolution levying the assessment for street sprinkling in the amount of $1,238.97 has been prepared. He presented Resolution No. 628, entitled: 162 A RESOLUTION OF THE COMMISSION OF THE CITY OF BOZEMAN LEVYING AND ASSESSING A SPECIAL ASSESSME:NT OF TAXES 'Ui'ON ALL THE PROJPERTY IN STREET SPRINKLING DISTRICTS OF THE CITY OF BOZEMAN, COUNTY OF GALLATIN, STATE OF MONT.ANA, TO DEFRAY SEVENTY-FIVE FERCENT OF THE COST OF SPRINKLING STREETS W1THIN SAID STREET SPRINKLING DISTRICTS OF THE CITY OF BOZEMAN FOR THE YEAR 1948. It was moved by Commissioner Lowe, seconded by Commissioner Healy that the resolution be pro- visionally passed and September 8th, 1948 be set as the date for the hearing of protests and the motion was carried by the following Aye and No vote: those voting Aye being Mayor Sorenson, I Commissioner Lowe and Commissioner Healy; those voting No, none. Resolution No. 630 -- Weed Cutting The Manager stated that the resolution levying the assessment for the removal of weeds for the year 1948 in the amount of $507.11 has been prepared. He presented Resolution No. 630, entitled: A RESOLUTION OF' THE COMMISSION OF' THE CITY OF BOZEMAN, LEVYING AND ASSESSING A SPECIAL ASSESSMENT OF TAXES UFON CERTAIN FROPERTIES IN THE CITY OF' BOZEMAN, COUNTY OF GALLATIN, STATE OF' MONTANA, TO DEFRAY THE COST OF EXTERMINATION .AND REMOVAL OF NOXIOUS WEEDS FOR THE YEAR 1948. PURSUANT TO THE FROVISIONS OF ORDINANCE NO. 428; ENTITLED: "AN ORDINANCE DEFINING .AND FROVIDING FOR THE FllNISHMENT AND ABATEMENT OF CERTAIN NUISANCES." It was moved by Commissioner Healy, seconded by Commissioner Lowe that the resolution be provisionally passed and September 8th, 1948 be set as the date for the hearing of protests and the motion was carried by the following Aye and No vote: those voting Aye being Mayor Sorenson, Commissioner Lowe and Commissioner Healy; those voting No, none. Adjournment There being no further business to oome before the Commission at this time, it was moved by Commissioner Lowe, seconded by Commissioner Healy that the meeting adjourn and the motion was carried by the following Aye and No vote: those voting Aye being Meyor Sorenson, Commissioner Lowe and Commissioner Healy; those voting No, none.
