HomeMy WebLinkAbout1948-09-22 16H Bozeman, Montana September 22nd, 1948 The Commission of The City of Bozeman met in regular session in the Commission Room, City Hall Building, Wednesday afternoon, September 22, 1948, at 1:00 o'clock f. M. those being present were Mayor Sorenson, Commissioner Lowe, Commissioner Healy, City Manager Henderson, City Attorney Lovelace, and the Clerk, when the following proceedings were had: -I The minutes of the last regular session were read, and it was moved by Commissioner Lowe, seconded by Commissioner Healy that the minutes be approved as read, and the motion was carried by the following Aye and No vote: those voting Aye being Mayor Sorenson, Commissioner Lowe and Commissioner Healy; those voting No, none. Resolution No. 632 -- Final Fassage The Manager stated that this was the time and place set for the final passage end adoption of the resolution levying the assessment for the construction of Special Improvement District No. 344 (water mains in the west part of the City). He presented the affidavit of publica.tion of the Notice and stated that no protests have been filed and no one is present to protest. He presented Resolution No. 632, entitled: A RESOLU'rION OF THE COMMISSION OF THE CITY OF BOZEMAN, MONTANA LEVYING AND ASSESSING A SFECIAL ASSESSMENT OF TAXES UPON ALL THE FROI'ERTY IN SFECIAL IMPROVEMENT DISTRICT NO. 344 IN THE CITY OF BOZEMAN, COUNTY OF GALLATIN, STATE OF' MONTANA, TO DEFRAY THE COS T OF CONSTRliCTING AND MAKING THE IMl'OOVE1'1Fl-l'I'S WI'l'FIN SAID SFECIAL IMPROVEMENT DISTRICT NO. 344. It wau moved by COlUJUisdoner Healy, seconded by Commissioner Lowe that the resolution be finally passed and adopted end the motion was carried by the following Aye and No vote: those voting Aye being Mayor Sorenson, Commissioner LOWe and Commissioner Healy; those voting No, none. I Resolution No. 633 -- Final Passage The Manager stated this was the time and place set for the final passage of the resolution levying the assessment for the construction of Special Improvement District No. 346 (sanitary . sewer in the northwest part of the City). He presented the affidavit of publication of the Notice end stated that no protests have been filed and no one is present to protest. He presented Resolution No. 633, entitled: A RESOLl:TION OF THE COMMISSION OF THE CITY Of' BOZEMAN, MONTANA, LEVYING .AND ASSESSING A SFECIAL ASSESSMENT OF TAXES UFON ALL THE IJROPERTY IN SPECIAL IMFROVEMENT DISTRICT NO. 346 IN TIlE CITY OF BOZEMAN, COUNTY OF GALLATIN, STATE OF' MONTANA, TO DEFRAY THE COS T OF CONSTRUCTING AND MAKING THE IMJ':OOVEMENTS WITHIN SAID SPECIAL IMFROVEMENT DISTRICT NO. 346. It was moved by Commissioner Lowe, seconded by Commissioner Healy that the resolution be finally passed and adopted and the motion was carried by the following Aye and No vote: those voting Aye being Mayor Sorenson, Commissioner Lowe and Commissioner Healy; those voting No, none. Public Hearing -. Creation S. I. D. No. 349 The Manager stated that this was the time and place set for hearing protests to the creation of Special Improvement District No. 349, pavine; of College Street from Fourth to Eighth Avenue with an oil mat paving. He presented the affidavit of publication of the Notice and the Clerk's mailing certificete that all property ownerS have been notified. No protests having been filed and I no one being present to protest, Resolution No. 634, creating said Special Improvement District No. 349 was presented entitled: A RESOLUTION OF THE CITY COMMISSION OF THE CITY QF B02EMA.N. CREATING A SPECIAL IMJ'ROVEMENT DISTRICT TO BE KNOWN AS SPECIAL IMPROVEMENT DISTR1CT-N'OMBER'349 OF THE CITY OF BOZEMAN FOR THE Pl'RFOSE OF' CONSTRUCTING AND INSTALLING -AN _.(-El"!r.-M.A.'~) FAVED SURFACE ON EXISTING GRAVEL BASE AND WHERE NO CURBS NOW EXIST, TO INSTALL- CONCRETE CURBS ON WEST COLLEGE STREET BETWEEN THE WEST LINE OF FOURTH AVENUE SOUTH .AND THE EAsT LINE OF EIGHTH AVENUE SOUTH, IN SAID CITY. 169 It was moved by Commissioner Healy, seconded by Commissioner Lowe that the resolution be passed and adopted a,nd the motion was carried by the following Aye and No vote: those voting Aye being Mayor Sorenson, Commissioner Lowe and Commissioner He~y; those voting No, none. froposal to fave College Street - 8th to 11th A proposal for rebuilding paving on West College Street between Eighth Avenue and Eleventh I Avenue was considered. Correspondence with the State Highway Engineer was reviewed wherein the State Highway Commission proposes to rebuild this street on condition that the City pay twenty-five percent of the cost. The City Manager reported on a meeting of property owners adjacent to College Street which indicated favorable reaction toward the proposal. The matter of the City paying for that part of the new paving which would be within street intersections was considered. It was moved by Commissioner Healy, seconded by Commissioner Lowe that the City Attorney be instructed to prepare a resolution of intention to create a Special Improvement District to provide for re-paving College Street between Eighth Avenue and Eleventh Avenue under the following conditions: 1. 'fhe paving; will be done by or under the direction of the Montana State Highway Commission. 2. The Montana State Highway Commission will pay 75% of the cost of the new paving. 3. Of the rema.1ning 25% of the cost of the new paving, The City of Bozeman will pay a percentage equal to the percentage which the area of paving within street intersections of the new paving represents of the entire area of the new paving. 4. The balance of the 25% of the cost of the new paving will be assessed on an area basis against property situated within one-half block north and south from street to be paved. 5. Assessments against property included in the district will be made payable in ten equal annual payments, and the motion was oarried by the following Aye and No vote. those voting Aye being Mayor Sorenson, I Commissioner Lowe and Commissioner Healy; those voting No, none. Liability Insur~lce for Motorized Vehicles The City Manager reported quotation of the Truck Insurance Exchange of $350.00 annual premium for liability and property damage insurance on the city's motorized equipment and a quotation from the Bozeman Insurance Association of $982.00 for the same coverage. Insurance is now carried by the Truck Insurance Exchange and will be renewed with that company. Application for City License The application of R. O. Feagins for a one-hal f year city license was presented. It was moved by Commissioner Lowe, seconded by Commissioner Healy that the application be approved and the license issued and the motion was carried by the following Aye and No vote: those voting Aye being Mayor Sorenson, Commissioner Lowe and Commissioner Healy; those voting No, none. Gas and Plumbing Bond -- Cissel & Anderson The gas fitter's bond in the amount of $2,000.00 and the plumbing bond in the amount of $500.00 for Cissel & Anderson were presented. The bonds were approved as to form by the City Attorney, whereupon, it was moved by Commissioner Lowe, seconded by Commissioner Healy that the bonds be approved and accepted and the motion was carried by the following Aye and No vote: those voting Aye I being Mayor Sorenson, Commissioner Lowe and Commissioner Healy; those voting No, none. Petition to Fave - Rouse, Babcock & Olive A petition of property owners was presented requesting that a special improvement district be created to pave Rouse Avenue from Main Street to Olive; Babcock Street from Bozeman A'.'enue to Church Avenue and Olive Street from Lindley to Church Avenue. It was moved by Commissioner Lowe, seconded by Commissioner Healy that the City Engineer be instructed to prepare the necessary estimates of cost and the City Attorney be instructed to prepare the resolution of intention to create the district 170 and the motion was carried by the following Aye and No vote: those voting Aye bein~ Mayor Sorenson. Commissioner Lowe and Commissioner Healy; those voting No. none. Fetition to fave - 13th. 12th &: Koch A petition of property owners was presented requesting that a special improvement district be created to provide for paving on Thirteenth Avenue from College to Koch Street; on Koch Street from 12th to 13th and on 12th Avenue from Koch to Story Street. It was moved by Commissioner Healy. I seconded by Commissioner Lowe that the City Engineer be instructed to prepare the necessary estimates of cost and the City Attorney be instructed to prepare the resolution of intention to create the district and the motion was carried by the followinZ Aye and No vote: those voting; Aye being Mayor Sorenson. Commissioner Lowe and Conunissioner Healy; those votin~ No. none. Flatting of Westlake Tract Mr. W. W. Less ley appeared before the Commiss ion and presented a proposed plat of property along Seventh Avenue north of Durston Road. He stated that all necessary signatures be secured by Saturday. SeFtember 25th. 1948. and action on the proposed plat was deferred until the next regular meeting. Offer of Stimson Accepted The offer of K. J. & Jean Stimson to lease to the City of Bozeman with an option to purchase. Lots 13. 14. 15. 16. and 17; Block A; Black's Addition was given further consideration at this time. The proposal having been given publicity and no protests or objections to it having been made or filed; and the lease and option to purchase the property having been approved as to fOI'm by the City Attorney. it was moved 'by Conunissioner Lowe. secOl,ded by Cmrmissioner He,\j y that thf'i offer of K. Restricted Parking Near College Campus The Manager reported that Montana State College has requested that parkine; be prohibited on the south side of Cleveland Street from Sixth Avenue to Eleventh Avenue and on the west side of Sixth Avenue from Cleveland to Lincoln Street. It was pointed out that F,rohibi ting parking on these streets would c euse congestion on other near-by streets and that Montana State College should provide ample and convenient space for cars to be parked off from streets. The City Manager stated that he considers that an emergency exists so far as parking on Sixth Avenue and Cleveland Street is concerned. that he would issue an emergency order prohibiting parking on one side of those streets as requested by Montana State College. and that he would immediately take up wi th the College authorities the matter of their providing more adequate and better improved parking lots. It was moved by Commissioner Lowe. seconded by Commis sioner Healy. that this ['rorosed action by the City Manager be approved and the motion was carried by the following Aye and No vote: those voting Aye being Mayor Sorenson.
