October 6th. 1948. at 1:00 o'clock f. M. Those beins present were Mayor Sorenson. Commissioner Lowe. Commissioner Healy. City Manager Henderson. City Attorney Lovelace and the Clerk when the followi.ng proceedinEs were had: .1 The minutes of the last regular session were read. and it was movec by Commissioner Lowe. seconded by Commissioner Healy that the minutes be approved as reA.d, and the motion wes carried by the following Aye and No vote: those votin[ Aye being; Mayor Sorenson. Commissioner Lowe and Commissioner Healy; those voting No. none. Sale of S. I. D. No. 347 Bonds The Manager stated that a part of the work in Special Improvement District No. 347 has been com- pleted. and it will be necessary to sell the bonds of this djstrict in order to };sy the contractor for the work he has finished. Whereupon. it was moved by Commissioner Healy. seconded by Commissioner Lowe that the Clerk be authorized to advertise for bids for Special Improvement District No. 347 bonds and the motion was carried by the followint; Aye and No vote: those votinG Aye being Mayor Sorenson. Commissioner Lowe and Commissioner Healy; those voting: No, none. Sale of SDS Construction ell The Manager re~'orted that in order to pay current bills for construction of the Sewage Treatment Flant, it will be necessary to cash some of the U. S. Certificates of Indebtedness in which Sewai-';e Disposal System Construction Funds are invested. It was moven by Com.'1lissioner Lowe. secor:ded by Commissioner Healy that the Director of Finance be authorized to cash U. S. Certificates of' Indebtedness I held in the Sewage Disposal System Construction Fund in an amount as recommended by the resident engineer to cover estimated costs for the next three months and the motion was carried by the following Aye and No vote: those voting Aye being Mayor Sorenson. Commissioner L0we and Commissioner Healy; those voting No. none. Bids for S. 1. D. No. 349 The Manager stated that this was the time and place set for the opening of bids for the construc- tion of Sl,ecial Improvement District No. 349. oil mat paving on Call ege Street between Fourth and Eighth Avenue. He presented the affidavit of publication of the Notice to Bidders. and it was there- upon moved by Commissioner Healy. seconded by Commissioner Lowe that the bids be opened and read. and the motion was carried by the following Aye and No vote: those voting Aye bein~ Mayor Sorenson. COlIunissi oner Lowe and Commissioner Healy; those votins No. none. The bid of the Standard Construction Company being the only bid received was opened and read and found to be as follows: For the construction of S. I. D. No. 349 as proposed: $9.668.70 The enGineer's estimate being $5.452.20. and the district having been proposed on this basis. it was moved by Commissioner Healy. seconded by Commissioner Lowe that action be deferred until further 1 investigation can be made and the motion was carried by the following Aye and No vote: those voting Aye being Mayor Sorenson. Commissioner Lowe and Commissioner Healy; those voting No. none. Care 300.00 Band 2.521.20 $ 68.243.02 Garbage 1.552.98 Total 174 'The Manacer stat ed that he has eudi ted these claims and finds them to be true and lawful claims against the City of Bozeman and recommends that warrants be drawn for their payment. After examina- tion of the claims in detail by the City Commissioners, it was moved by Commissioner Healy. seconded by Commissioner Lowe that the claims be allowed and warren ts drawn for their payment and the motion was carried by the following Aye and No vote: those voting Aye being Mayor Sorenson. Commissioner Lowe end Commissioner Healy; those voting No. none. 1 Transfer of Beer License TIle apFlication for a transfer of the beer license for the Stockman Bar from Mr. E. McKnight to Dan Kilbdde was presented. It was moved by Commissioner Lowe. seconded by Commissioner Healy that the transfer be Approved and the proper endorsement be made on the license and the motion was carried by the following Aye and No vote: those voting; Aye beinG MI3yor Sorenson. Commissioner Lowe and Commissioner Healy; those votinE No. none. Applications for City Licenses The followinG applications for City Licenses were lresented: Albert Mahlum North Fifth Grocery The Toggery It was moved by Commissioner Healy. seconded by Commissioner Lowe that the applications be apl'roved and the licenses issued and the motion WQS carried by the following Aye and No vote: those voting; Aye being Mayor Sorensori. Removal of Buildings City Attorney Lovelace presented his wTi tten opinion on the title to the K. J. Stimson proF-erty. His opinion is that the title is not merchantable but that its flaws can be corrected by a "Quiet Ti tle" action. He stated the.t Mr. Stimson has agreed to institute and pay the costs of such an action. 1.75 It was moved by Commissioner Lowe. seconded by Commissioner Healy that the City Manager be authorized to dispose of the garage and other accessory buildings on the Stimson property at the best price obtainable; to have the property. exclusive of that part occupied by the residence. cleared for parking. and to rent the dwelling at $55.00 per month on a month to month basis and the motion was carried by the following Aye and No vote: those voting Aye being Mayor Sorenson.
