The Commission of The City of Bozeman met in regular session in the Commission Room,
City Hall Building, Wednesday afternoon, April 14th, 1948, at 1:00 o'clock P.M. Those being
present were Mayor Sorenson, Commissioner Lowe, Commissioner Healy, City Manager Henderson,
City Attorney Lovelace, and the Clerk, when the following proceedings were had to-wit:
The minutes of the last regular session were read, and it was moved by Commissioner

was carried by the following Aye and No vote; those voting Aye being Mayor Sorenson, Com-
missioner Lo\-ve and Commissioner Healy; those voting No, none.
storm Sewer on North Ninth Avenue
Mr. Ed. w. Kurk, 210 North 9th Avemle and Mr. J . D. w11i te, 823 Wes t Lamme, appeared
before the Commission and the City Manager explained that these gentlemen were concerned
about objectionable wastes from the storm sewer which empties into an open ditch on Ninth
Avenue North near their property. It'Nas stated that creamery wastes from the Kessler
Dairy are being dumped into this storm sewer. These wastes accumulate along the open ditch
into wbich the storm sewer empties and an unsanitary condition is tbus created. It was
stated that storm sewers are for disposal of surface drainage only and that any organic
matter should be in the sanitary sev....er. After consideration, it waf: moved by Commiso::ioner
Healy, seconded by Commissioner Lowe that the City Manager be instructed to inform the Kes-
sler Dairy that proper sewer connections must be made at their place of business and the mo-
tion was carried by the following Aye and No vote; those voting Aye being TVlayor :.3orenson,
Commissioner Healy and Commissioner Lowe; those voting No, none.

PLANS FOE SEWAGE 'rREA nrF"N'r PLANT
r1r. Allan Wymore representing Burns & McDonnell, Consulting Engineers, and Fred Quinnell,
Resident Engineer, for tbe Sewage Treatment Plant, reported on a conference which they had
had v....i tb the State Board of Health on April 13th, 1948, relative to plans for tbe sewage
treatment plant. A letter from the State Board of Healtb was presented containing the
following recommendations:
1. That pre-chlorination is a necessary feature and should be provided for
in the construction of the plant.
2. Tha t the Chlorine Itetention Chamber be moved so as to be easily accessible
from the control bUilding.
3 . That the Control Building should be enlarged to provide more floor space.
lj. . TIlat soi] conditions at the proposed location of the sludge beds should be
carefully checked to insure th,:1t the drainage can not contamina,te water in
the vicinity.
5. That the loca tion)f tbe waste gas burner sbould be moved so that it ,muld
be in open view from the Control Building.
6. That further investigations should be made of soil conditions to eliminate
the possibility of alkali effect on concrete.
I Ttlese recommendations were discussed in detail. Mr. Wymore was instructed as follows:
1. To change the plans so that adequate construction would be included in the
plans to provide for pre-chlorination.
2. To move the location of the Chlorine Retention Chamber to within the area
that will be fenced around th e plant.
3. To move the location of the waste gas burner so that it would be visible
from the control building.
Mr. Wymore stated that careful consideration had been given by his firm regardinr; the
floor space of the control building, and it was their definite opinion that tbe control

building as designed in their plans was of sufficient size to meet the needs for the plant
as it is to be constructed and to provide for future expansion of the plant. 'ilie Ci ty Man-
ager was instructed to write the Montana State Board of Health to inform them that their
recommendations as stated in their letter of April 13th, would be carried out with the ex-
cention as to the enlargement of the Control Building and the Manager was instructed to
inform the Board of Health that in view of the recommendations from Burns & McDonnell and I
in view of the necessity of holding costs in the plant construction to a minimum, it is
not deemed advisable to enlarge this building unless the Board of Health presents further
data to show the necessity for doing so.
As to ground conditions at the sludge beds, Mr. Wymore stated that definite informa-
tion is not available, but this is a matter which must be checked during the course of
construction of the plant.
As to soil condi tions wr; ich migh t effect concrete, it was also pointed out that this
is a matter which must necessarily be checked closer during the construction of the plant
and one which does not effect the present plans; however, Mr. Wymore was instructed to
prepare the specifications in the most exact pOSSible detail so that adequate and fre-
quent checks could be made before and during construction to insure the use of proper
aegregate in all concrete construcion.
Courtesy Nickels for Over-Time Parkers
l\1r . Hal. Bolinger, tjr. , Gardiner Waite and John Parker, representing the local American
Legion were present with the proposal that the American Legion institute a plan for use
of courtesy tickets for over-time parking violations. Under the plan, the American I
Legion would set up a fund, keep the records, police would put necessary coins in the
parking meters where they find first offenders and a courtesy card would be put on tile
car with an envelope attached so the offenders could return the coin to the Legion. It
was stated that this plan was being used successfully in other places. In a general dis-
cussion, it was pointed out that parking meters are not installed to rent parking space
but are to measure time so that cars will not park longer than allowed by ordinance, and
the adoption of this plan would in effect be instruction to traffic officers to make
direct violation of the parking meter ordinance. The City Manager explained that he had
information compiled regarding this situation which he would be glad to go over with
this committee or other interested parties.
Request for Street Improvement in North-East Part of City

Bozeman improve the condition of the roads in the north and northeast section of the City
that serve the industries located in this part of town and the immediate vicinity. Methods
of paving city streets were explained and it das stated that the City plans to do main-
tenance work on North Rouse Avenue as soon as conditions permit, but that permanent street I
improvement would have to be made by the property owners or by outside aid.
Bond of Director of Finance
The bond of L. G. Shadoan as Director of Finance in the amount of $20,000.00 was
presented. The bond was approved as to form by the City Attorney, whereupon, it was
moved by Commissioner Healy, seconded by Commissioner Lowe that the bond be approved and
accepted and the motion was carried by the following Aye and No vote; those voting Aye
beine Mayor Sorenson, Commissioner Lowe and Commissioner Healy; those voting No, none.

Reports
The following reports for the month of March, 1948 were presented:
City Engineer Employment Officer Nursery School
It was moved by Commissioner Healy, seconded by Commissioner Lowe that the reports be
accepted and ordered filed and the motion was carried by the following Aye and No vote;

Bids for Car for City Manager &, Plumbing Inspector
Bids for an automobile to be used by the Ci ty Manager and the Plumbing Inspector ""hich
had been received at the meeting of April 7th, 1948, were brought up for further consider-
ation. The bid of the Northern Automobile Company being the lowest bid and showing a de-
livery date of thirty days, was considered V-e best bid. It "vas thereupon moved by Com-
missioner Lowe, seconded by Commissioner Healy that the bid of the Northern Automobile
Company in the amount of $1,577.46 less a trade-in allowance of $250.00 for the Dod~e
sedan making a net bid of $1,327.46 be accepted and the motion 'Nas carried by the fa llow-
ing Aye and No vote; those voting Aye being Mayor Sorenson, Commissioner Lowe and Commis-
sioner Healy; those voting No, none.

It was moved by Commissioner Healy, seconded by Commissioner Lowe that the applica-
I tions be approved and the licenses issued and the motion was carried by the following aye
and no vote; those voting aye being Mayor Sorenson, Commissioner Lowe and Commissioner
Healy; those voting no, none.
Water and Sewer Line for Community Cannery
The Manager informed the Commission that a building is being moved and remodeled at
the County Fair Grounds for use as a community cannery. A representative of the Gallatin
County Fair Board had requested that the City bear such part of the cost of installing
the wat~r service and the sewer line to this building as is possible. It was pointed out
that the sewer connection would be a normal connection from Tamarack Street, but the water
connection would require a special line of a9proximately 360 feet of water pipe from Rouse
Street, and that on new water services the City Water Department will provide a water
line for sixty feet with a deposit from the consumer to be used in water rent. After dis-
cussion, it was moved by Commissioner Lowe, seconded by Commissioner Healy that the part
of the sewer connection normally made by the Ci ty would in this case be made as a main-
tenance service and at no cost to the County and that the water service be extended sixty

Appointment of ,Tohn Parker to Recreation Board
The written resignation of Elwood Railey as a member of the Recreation Board was pre-
sented and read. Hayor Sorenson 3.nnounced the appointment of John G. Parker to fill the
unexpired term of Elwood Railey as a member of the Board of Public Recreation. It was
~oved by Commissioner Lowe, seconded by Commissioner Healy that the appointment be approved

and the motion was carried by the following Aye and No vote; those voting Aye being Mayor
Sorenson, Commissioner Lowe and Commissioner Healy; those voting No, none.
policemen to work for Police Chief
The Manager stated that the Chief of Police expected to be confined to the hospital
for several days and that other members of the Police Department had volunteered to work
during their time-off shift in place of the Chief so that he would not lose payor vaca- I
tion rights during his confinement to the hospital.
It was moved by Commissioner Healy, seconded by Commissioner Lowe that permission
be granted for the police officers to work for the Chief during his time off, but that
this is done as an emergency expedient and is not to be considered as a precedent and
that other cases are to be decided on their merit, and tte motion was carried by fhe
following Aye and No vote; those voting Aye being Mayor Sorenson, Commissioner Lowe and
Commissioner Healy; those voting No, none.
Adjournment
There being no further business to come b(:;)fore the Commission at tbis time, it was
moved by Commissioner Healy, seconded by Commissioner LO\/e that the meeting adjourn and
the motion was carried by the following Aye and No vote; those voting Aye being Mayor
Sorenson, Commissioner Lowe and Commissioner Healy; those voting No, none.
