'I'1'1 ose being present were Mayor Sorenson, Commissioner Lowe, Commissioner Heal.:;, City Manager Henderson, City Attorney Lovelace, and the CleI'kv~hen t.he following proceedings were had: I The minut.es of the last regular session were read, and it was moved by Commissioner Lowe, seconded by Commissioner Healy that. the minutes be approved as read, and the mo ti on was carried by t.he following Aye and No vote; those voting Aye being Mayor Sorenson, Com- missioner Lowe and Commissioner Healy; those voting No, none. Resignation of Officer Benbrooks The ~11anager reported that Police Officer Benbrooks, who has resigned as a member of the Police Department, has had no vacation during the current year. It was moved by Com- missioner Lowe, seconded by Commissioner Healy that Officer Benbrooks be granted ten days vacation with pay and the motion was carried by the following Aye and No vote: those voting Aye being Mayor Sorenson, Commissioner LO',,"e and Commissioner Healy; those voting No, none. Offer For Building On Masonic Tract The r,1anager read an advertisement published on April 17th, 19L,8, calling for offers for the buildings on the Masonic Tract at t.he corner of Babcock 8:: Tracy Avenues, either to be torn down or moved away. He stated that Mr. J. N. Pratt had made an oral offer of $25.00 for the building he is now occupying. In his offer he agreed to move the building from its present location at his own expense and without cost t.o the City, whereupon, it I was moved by Commissioner Lowe, seconded by Commissioner Healy that the offer of J. N. Pratt be accepted and the motion was carried by the following Ayc and No vote; those voting Aye being Mayor Sorenson, Commissioner Lowe and Commissioner Healy; thosc voting No, none. Report The report of the Cashier for the month of March, 1948 was presented. It was moved by Commissioner Healy, seconded by Commissioner Lowe that the repox"t be accepted and ordered filed and the motion was carried by the following Aye and No vote; those voting Aye being Mayor Sorenson, Commissioner Healy and Commissioner Lowe; those voting No, none. Harker Phillips Dairy It was moved by Commissioner Healy, seconded by Commissioner Lowe that the applica- tions be aoproved and the licenses issued and the motion was carried by the following Aye and No vote; ttose voting Aye being Mayor Sorenson, Commissioner Lowe and Commissioner I Healy; those voting No, none. Gas Fitter's and Plumbing Bond of Frank .T. Trunk The renewal certificate for the Gas Fitter's bond in the amount of $2,000.00 and the renewal certificate of the Plumbing bond in the amount of $500.00 of Frank J. Trunk were presented. The certificates were approved as to form by the City Attorney, whereupon it was moved by Commissioner Healy, seconded by Commissioner Lowe that the certificates be approved and accepted and the motion was carried by the following Aye and No vote; those voting Aye being Mayor Sorenson, Commissioner Lowe and Commissioner Healy: those votinp" No, none. - 112 Insta~~ion of Light Posts on Trial Basis The Manager presented and read a proposal from the Montana Power Company to install four light posts with eight 4000 lumen lamps on Eighth Avenue between Alderson arn Dick- erson and between Babcock and Main Street, and also to install thirteen lights with 6000 lumens lamps on the west end of Main Street. These lights are to be installed on a trial basis, and without cost of installation to The City of Bozeman to demonstrate to proper- I ty owners the style of lights and advantages of such improved street lighting if Special Improvement Lighting Districts are established on these streets. Under this trial plan The City of Bozeman would be obligated only for the amount of electric current used during the trial period of four months. After discussion, it was moved by Commissioner Healy, seconded by Commissioner Lowe, that permission be granted to the Montana Power Company to make t~:is temporary installation of street lights on a trial basis and the motion was carried by the following Aye and No vote; those voting Aye being Mayor Sorenson, Commissioner Lowe and Commissioner Healy; those voting No, none. Q,ui t Claim Deed to Property on South 'I'racy The ~anager stated that The City of Bozeman had by Ordinance No. 599 adopted on March 27th, 1931, vacated a surplus strip of land on Tracy Avenue South; that this Ordinance authorized to the Mayor and the Clerk to execute a quit claim deed to the tract, but no such deed has ever been executed. Upon examination and approval of the proposed quit- claim deed by the City Attorney of Lots 20 & 21, Block G, Hoffman's Addition, as requested by the property owner, it was moved by Commissioner Lowe, seconded by Commissioner Healy I that the Mayor and the Clerk of the Commission be authorized to sign the deed for The City of Bozeman and the motion was carried by the following Aye and No vote; those voting Aye being Mayor Sorenson, Commissioner Lowe and Commissioner Healy; those voting No, none. Amendment of Eagles' parking Lot Lease The Manager 8tated that in the lease of the parking lot from the Eagle's Lodge, located at the corner of Bozeman and Babcock, a tract of land in the southwest corner 40xlOO feet is excluded in the lease. He stated the Eagle's Lodge would now like to have this lease amended to include this tract of 40xlOO feet in the southwest corner, but exclude a tract 40xlOO in the northeast corner of the lot. It was moved by Commissioner Lowe, seconded by Commissioner Healy thJ.t the City Attorney be instructed to prepare an amendment to the present lease with the Eagle'S Lodge making t~e proposed change to the lease and the motion was carried by the following aye and No vote; those voting Aye being I"layor Sorenson, Com- missioner Lowe and Commissioner Healy; those voting No, none. Petltlon to Improve Durston Road rJIrs. Martha Bolles was present and presented a peti tion requesting the t tLe Ci ty im- prove Durston Road by grading, graveling and installing necessary drainage culverts. With I few exceptions, the signers of the petition were persons who live outside the City. The Manager was instructed to secure estimates of cost of the proposed improvements and then see if these signers of the petition would be willing to share in the cost of such improvement- Plans for .b'Uture Flood Control ~e Manager reported on preliminary investigation made during the past week for future flood control on the ditch along the City limits at the south end of Black Avenue and 113 Guy's Second Addition. He stated that surveys and estimated costs would be made by the City Engineer and presented to the Commission for consideration at the earliest possible date. Delivery of Sewer Revenue Bonds The Manager reported that the Sewer Revenue Bonds in the amount of $300,000.00 were I ready for delivery to Kalman & Company. Th e !l~ayor and the Clerk of the Commission were &uthorized to deliver the bonds to the Commercial National Bank with instructions for delivery to Kalman & Company through the First National Bank of Minneapolis, Minnesota.
