The Commission of The City of Bozeman met in regular session in the Commission Hoom,
City Hall Building, Wednesday afternoon, Apri12bt'h, 19h8, at 1:00 o'clock P.M. Those
being present were Mayor Sorenson, Commissioner LO~/e and Commissioner Healy, City Manager
Henderson, City Attorney Lovelace and the Clerk when the following proceedings were had:
The minutes of the last regular session were read, and it was 'noved by Commis si oner
Healy, seconded by Commis sioner LO',17e that trie minutes be approved as read, and the motion I
was carried b:r the following Aye and No vote; those voting Aye being ~layor Sorenson,
Commi ssi oner Lowe and Commis 8i oner Healy; those v oti ng No, none.
Sewer Cownection at Kessler Dairy
j\1ensers. Fred and Arnold Kessler of the Kefsler Dairy, 708 West Main Street, were
present to discuss the matter of the storm sewer connection at their creamery which emp-
ties into an open ditch on North Ninth Avenue. They stated that at the time the new ad-
dition on the west side of their creamery was constructed, the City Engineer informed
them they could not connect to the sanitary sewer because it was already over-loaded and
required them to connect to tne storm sewer. ,
The Commission informed these gentlemen that the sewage from their dairy has created
an unsanitary condition along North Ninth; that the property owners and the Hpalth Depart-
ment have complained, and the condition must be corrected.
The Kessler brotners stated that, in their opinion, the entire responsibility rests
upon the City. It was agreed that the Ci ty hat, s oms responsi bili ty in the matter because
the plumbing was city-inspected, and permission was given to connect to the storm sewer. I
It was pointed out however, that the first step toward correcting this condition must
be to secure necessary plans for changes in the plumbinE together with estimates of
cost of such work and this was definitely a responsibility of the owners. 'The Kessler
brothers agreed to secure such plans and cc-itima tes and to present them at the next
meeting of the City Commission.
L1 brfH'Y Week
The IvIanager stated that the "Friends of Library Committee" has requested a Bozeman
Public Library Week begining May 9th, 19L~8 . The Mayor stated that he would issue a proc-
lamation declaring that week as Bozeman Public Library Week.
Clean-Up Week
The matter of Clean-Up ',veek was broupht up, and it was moved by Commissioner Healy,
seconded by Commissioncr Lowe that the week beginning May 10th, 1945 be designated as
and City men and equipment be used during that week for general clean-up work,

Aye being ~~yor Sorenson, Commissiorer Lowe and Commissioncr Healy: those voting No, none.

Restricted Parking for Railway Express
A communication was read from the Railway Express suggesting that a special parking
meter be installed in front of ttleir Main Street office to limit parking to a 10, 12, or
15 minute period. It was decided that the location of this office is not in a seriously
congested traffic area, the office has a rear entrance for loJ.ding and unloading, tha t
installing special meters in any location would create confusion and set a bad precedent,
and the suggestion should not be favorably considered.
Resoluti.on No. 621 -- Intention to Create SID No. 347
The City Manager stated that the City Attorney as instructed had prepared the resolu-
tion of intention to create Special Improvement District No. 347, for the installation of
water mains on North 4th and North 5th from Villard to Durston Road, and on Villard from
4th to 5th, and on Durston Road from Third Avenue to Fifth Avenue. He present_ed Resolu-
tion No. 621, entitled:

It was moved by Commissioner Lowe, seconded by Commissioner Healy that the resolution
be passed and adopted and May 19th, 1948 be set as the date for the bearing of protests
and the motion was carried by the following Aye and ~o vote; those voting Aye being Kayor
Sorenson, Commissioner Lowe and Commis~oner Healy; those vo ting No, nOTe.
. Claims -- Paul Smith & Rowles-Mack
Claims No. 3092 of Rowles-Mack for 35 band uniforms in the amount of $1,715.00 and
Claim No. 3093 of Paul G. Smith in the amount of $12,500.00 for the balance of the pur-
chase price of his property to be used for the location of the sewage treatment plant
in accordance with the option agreement signed December 27th, 1948 were presented. After
examination of the claims in detail by the City Commission, it w~s moved by Commissioner
Healy, seconded by Commissioner Lowe that the claims be a~proved and warrants drawn for

Aye being Mayor Sorenson, Commissioner Lowe and Commissioner Healy; those voting No, none.
Bids tor Sewage Trea tn ent Plant
A corr~unication from Mr. Allan iVymore, Engineer for Burns & McDonnell, was read sug-
gesting Jur,e 2nd, 1945 as the date for the opening of bids for the construction of the
SewaGe Treatment Plant, and also confirming proposed cha.nges alJproved by tr-Ie City Commis-
sion. It was moved by Commissioner Healy, seconded by Commissioner Lowe that the Clerk
of the City Commission be authorized to advertise for bids for the construction of the

sewage treatment plant, to be opened June 2nd, 194$ at the regular session of the City
Commission, and the motion was carried by the following Aye and No vote; those voting
Aye being Mayor Sorenson, Commissioner Lowe and Commissioner Healy; those voting No, none.
Sale of Revenue BondS
The Manager reported that the Sewer Revenue Bonds had arrived in Minneapolis, but that
al.l deS.ired information had not been obtained regarding the investing of these funds that I
are not immediately needed, but this needed information sho~ld be available for the next
meeting date.
Adjournment
There being no further business to come before the CommiG2,ion at this time, it was
moved by Commissioner Lowe, seconded by Commissioner Healy that the meeting adjourn and
the motion I,ras carried by tte following Aye and No vote; those voting Aye being r.1ayor
