SUBJECT: Final Plat for the South University District Phase 2 Minor Subdivision
MEETING DATE: June 26, 2017
AGENDA ITEM TYPE: Consent
RECOMMENDATION: That the City Commission approve the Final Plat for the South
University District Phase 2 Minor Subdivision, authorize the Director of Public Works to execute
the same on behalf of the City of Bozeman, authorize the Director of Community Development
to execute the improvements agreement on behalf of the City of Bozeman, and authorize the Interim City Manager to execute the warranty deed for parkland dedication on behalf of the City
of Bozeman.
BACKGROUND: The City Commission granted preliminary plat approval for the South
University District Phase 2 Minor Subdivision on January 23, 2017, by a 5-0 vote.
§76-3-611(1), MCA, provides that the City Commission shall approve the plat only if:
(a) it conforms to the conditions of approval set forth on the preliminary plat and to the terms of
this chapter and regulations adopted pursuant to this chapter; and
(b) the county treasurer has certified that all real property taxes and special assessments assessed
and levied on the land to be subdivided have been paid.
The County Treasurer has certified that all real property taxes and special assessments assessed and levied on the land to subdivide have been paid. Attached is a memorandum from Mitch
WerBell, Associate Planner, stating the staff has concluded that all terms and conditions of the
preliminary plat approval have been met.
One improvements agreement is required for final plat approval of this subdivision. The
improvements agreement guarantees the installation of public street, water, sewer, and stormwater infrastructure. An irrevocable standby letter of credit in an amount not to exceed
$4,324,474.29 has been provided for financial security. All other necessary infrastructure
improvements are constructed or secured through the City’s South 11th Avenue street project.
The applicant paid $592,673.52 in-lieu of capital facilities to the City for the local share of South 11th Avenue.

The existing park area in the South University District is secured by a public park easement as
depicted and noted on the South University District Phase 1 Minor Subdivision plat. This
subdivision will legally plat the public parks. The landowner provided a warranty deed and realty
transfer certificate, which formally transfer the existing parkland to the City.
UNRESOLVED ISSUES: None identified.
ALTERNATIVES: None suggested or proposed.
FISCAL EFFECTS: Fiscal impacts are undetermined at this time, but will include increased
property tax revenues from new development, along with increased costs to deliver municipal
services to the property.
