SUBJECT: Public Access Easement for East Lamme Street Adjacent to Hawthorne School

RECOMMENDATION: Authorize the Interim City Manager to sign the Public Access
Easement for East Lamme Street adjacent to Hawthorne School.
BACKGROUND: Once the Montana Department of Transportation (MDT) has completed the improvements to Rouse Avenue between Oak Street and Story Mill Road they will begin making
improvements to Rouse Avenue from Main Street to Oak Street. As part of that project they will
be adding a left turn lane for southbound traffic at Lamme Street. In order to install the left turn
lane, MDT needed to acquire right-of-way from the Bozeman School District (BSD). BSD felt that in order to accommodate the new traffic pattern that would result from the turn lane, changes would need to be made to Lamme Street adjacent to Hawthorne School. A number of alternatives
which would meet everyone's needs were considered and ultimately it was decided that 18 angle
parking spots would be added along the south edge of the street next to the school. In order to fit
those parking spots into the street, it became apparent that the sidewalk would have to be located in a public access easement on the school property. The attached public access easement is the result of a series of negotiations involving MDT, BSD and the City, and is necessary to
accommodate the new sidewalk location on the south side of Lamme at Hawthorne School.
