Those belng present were Mayor Healy, Commifsioner Sorenson, Commissioner Lowe, City Manager Henderson, City Attorney Lovelace, and the Clerk, when the following proceedings were had: I The minutes of the last re~11ar session were read, and it was moved by Commissioner Sorenson, seconded bv Commis s ioner Lowe tha t the minutes be a pproved as read, and the mo- tion was carried by the following Aye and No vote; those voting Aye being Mayor Healy, Commissioner Sorenson and Commissioner Lowe: those voting No, none. Resolution No. 611 -- Final Passage The Manager s ta ted tha t this was the time and place set for the hearing of protests to the final passage and adoption of the resolution levying 19\'y1];:Jg the assessment of Special I~provement District No. 342, sanitary sewer between Eleventh and Twelfth Avenues from Koch to College street. He presented the affidavit of Notice to the property owners, and stated that no protests had been filed and no one was present to protest. He presen ted Resolution No. 611, entitled: A RESOLUTION OF THE COMMISSION OF THE CITY OF BOZ~MAN, MONTANA LEVYING AND ASSESSING A SPECIAL ASSESSMENT FO TAXRS UPON ALL THE PROPERTY IN SEPCIAL IMPROWW"NT DISTRICT NO. 342 IN TI-IE CITY OF BOZEMAN, COUNTY OF GALLATIN, STATE OF MONTANA, TO DBFRAY Tr~ CORT OF CONSTRUCTING AND MAKING THE IM- PROVEMENTS WITHIN SAID SPECIAL IMPROVEMENT DISTRICT NO. 342. It was moved by Commissiorer Lowe, seconded by Commissioner Soren~on that the Reso- lution be finally passed and adopted and the motion was carried by the following Aye and I No vote ,: those voting Aye being Mayor Healy, Commissioner Sorenson and Commissioner Lowe; those voting No, rone. Erection of Temporary Buildings not Conforming with Building Code The Mana ge r s ta ted that he had inquiry regard:ing ere c tJ ng a temporary steel building in Fire Zone No. lo He stated that the proposed building would not conform with the Building; Code, and thA t under the presen t Building Code, adopted in 1938, the City Commis- sion is a Board of Appeal, and the City Manager asked for a general policy as to minor exceptions to the BuildIng Code. The Commissioners expressed the view that, pa rticularly in Fire Zone No. 1, the Code should be strictly adhered to and precedent should not be set by allowing minor exceptions. Revision of BU:lldirg Code The Manager reported that Ordinance No. 685 adopts the 1937 edition of the Uniform Buildinp: Code, as prepared by the Pacific Coast Buildlng Officals' Conference as the Build- ing Code of The City of Bozeman. The Manager pointed out th9 t la ter edi tions of the "Uniform Building Code" have now been issued and that, to bring Bozeman's Building Code up to date, the la test edi tion of the "Uniform Building Code," wi th such changes as are necessary to I conform to local conditions, should be adopted as the "Building Code". The C1 ty A ttorne y was instructed to confer wi th the Building Inspector on necessary changes in the "Uniform Buildtng Code" and to Drepare an ordinance adopting this revised code as the Buildin~ Code of The City of Bozeman. Space for Officer's Reserve Corp. The Manager stated that Colonel David DeLap, of the Offjc ere' Reserve Corp, had made inquiry of the possibility of petitioning off unused space on the second floor of the City 30 Hall for use as office space for the Officers' Reserve Corp. The Commission lnstructed the Mana ger tha t if such work could be done wl thou t expens e to the City and the Ufficers' Reserve Cdrp pald the expense incurred in the us e of the space such as lighting and heating the Commis sl on would a pprove such use of the space. Release of Bond of Fred Q;uinnell The form from the Grea t American Indemni ty Company for the releasing of said bonding I company from any liability of Fred ~uinnell, as Cl ty Manager a s of Augns t 15 th, 1947 was presented. It was moved by Commissioner Lowe, seconded by Commissioner Sorenson tha t the Mayor be authorized to sign the release for The Ci ty of Bozeman and the motion was carried by the following Aye and No vote; those voting Aye being Mayor Healy, Commis piona r Lowe and Commissioner Sorenson; those vottng No, none. Proposed Cost of the Widenin~ of B~bcock Street An estimated cost, as prepared by the Ci t;r Engineer, for the widening of Babcock Street from Black to Grand Avenue, bv the removal of parking strips was presented. After discussion of the proposed improvement and the estima ted costs, the Commission was of the opinion th8t this was a project which should be included in a definite planning for street improvement next year, and the Manager was instructed to include one block south from Babcock Street on Black and Tracy Avenues, in the proposed plan, and a Iso to prepare a letter to the property owners along these streets to inform them of the proposed plan. Purchase of Phot07raphic E~uipment for Police Department The Manager disCllS sed wi th the Commis sionthe ma tter of purchas ing pho tographic equip- ment for the Police Department. Chief of Police Haas was present and was called upon to I present the needs of the Police Department for such equipment. The Manager explained that the purchase involved would not be of sufficient amount as to require Commisslon action, but the matter would be presented with the view of keeping the Commission informed and also getting their reconnnenda tions. The Commissioners expressed the opinion that it was important th8 t our Police Department should be equipped wi th modern equipment and photo- graphiC equipment was necessary in modern police work, and the City Manager should pur- chase such equipment as would meet essential needs. Adjournment There bejng no further business to come before the Commission at this time, i t wa s moved by Commissioner Lowe, seconded b~.
