HomeMy WebLinkAbout1947-10-01 Bozeman, Montana 33 October 1st, 1947 The Commission of The City of Bozeman met in regular session in the Commission Room, City Hall Building, Wednesday afternoon. October Is t, 1947, at l:OO o'clock P.M. Those being present were Mayor Healy, Commissioner Soren~on, Commissioner Lowe, City Manager Hen- derson, City Attorney Lovelace and the Clerk, when the following proceedings were had to-wit: I The minutes of the last reglJlar session were read, and it was moved by Commissioner Sorenson. seconded by Mayor Healy that the minutes be approved as read, and the motion was carried by the followlng Aye and Fo vote; those voting Aye being ~,~ayor Healy, Commissioner Sorenson~ those voting No, none. Co~missioner Lowe entered and was noted pre~ent. Request to Amend Fire Ordinance ~lr . H. B. LaneJoe, a ttorney for the Gallatin Farmers' Company, appeared before the Com- mission to discuss a proposal by his client to erect a 16,000 gallon above-ground fuel oil storage tank on lots facing Mendenhall Street east of Wallace Avenue. Ordinance No. 663. the Fire Ordinance, requires that above-ground tanks of from 3001 to 21,000 gallons cannot be erected closer than 25 feet to property lines or ad~acent buildin~s. The pro~osal in this case does not meet those req1Jirements. The tract on which it is proposed to erect the tank being 56 feet in width and the tank being 11 feet in diameter, thus leaving only 22t feet of yard space on each side of the tank if the tank was erected in the cen ter of the tra ct. It was pointed out that Ordinance No. 663 makes no provision for appeal in cases of this kind. After discussion it was decided that it would not be wise or practical I to amend an existing ordinance of general application to fit an individual ca~e and the t, ir this case, there was no alternative for the Building Inspector but to refuse a permit for the proposed construction. Bond of Plumbing Inspector The bond of A. W. Coleman as PlumbinE: and Gas Inspector in the amount of $2000.00 was presented. The bond was approved as to form b" the Ci ty Attorney, whereupon, it was moved by Commi~sioner Lowe, seconded by Commipsioner Sorenson that the bond be approved and ac- cepted and the motion was carried by the following Aye and No vote; thoee voting Aye being Mayor Healy, Commissioner Sorenson and Commissioner Lowe; thos e vo ting No, none. Gas & Plumbing Bond of Montana Air Conditioning The Gas Fitter's Bond in the amount of $2,000.00 and the Plumbing Bond in the amount of $500.00 of the Montana Air Conditioning were presented. The bonds were approved as to form by the City Attorney, whereupon, it was moved by Commissioner Sorenson, seconded b, Commissioner Lowe that the bonds be approved and accepted and the motion was carried by the followinrr Aye and No vote; those voting Aye being Mayor Healy, Commi8sioner Sorenson and Commissioner Lowe; those voting No, none. I ~n~ineer's Payroll Approved The Manae:er presen ted the Enp-in<')er' s monthly pa yroll for the month of September, 1947 , the amount of ~;8930.60. preceeding in He recommended that action on other bills for the/month be de- ferred until the next regular meeting to gi ve more time a t this meeting for considera tion of bids for the sewage disposal plant equipment. It was moved by Commissioner Lowe, seconded by Commissioner Sorenson th8t the payroll be approved and warrants be drawn for its payment and the motion was carried by the following Aye and No vote; those voting Aye being Mayor Healy, Commissioner Sorenson and Commissioner Lowe; thos e voting No, none. 34- Resolution No. 612 -- Final PaSSa?B The Manager stated that this was the time and place set for the public hearing on the final adoption of the resolution levylng the assessment for Special Improvement District No. 343, sani tary sewer in the Normandy Rearrangement of the VVes t Side Addi tion. It was moved by Commissioner Sorenson, seconded by Commissioner Lowe that the Resolu- tion be finally passed and adopted and the motion was carried by the following Aye and No vote; those voting Aye beIng Mayor Healy, Commifsioner Sorenson and Commissioner Lowe; those voting No, none. Bids for Sewage Treatment Equipment The Manager stated that this was the time and place set for the opening of bids for equipment to be used in the Sewage Treatment Plart. He pre s en ted the affidavit of publica- tion of the Notice to Bidders, whereu pon, it was moved by Commissioner Lowe, seconded by Commissioner Sorenson that the bids be opened and read and the motion was ca rried by the following Aye and No vote; those voting Aye beIng Mayor Healy, Commissioner Sorenson and Commissioner Lowe; tho,,,,e vo ting No, none.
