SUBJECT: Amendment No. 1 to Agreement for Revocable Encroachment Permit for Front Street and Birch Street Rights-of-Way

RECOMMENDATION: Approve Amendment No. 1 to the Agreement for Revocable Encroachment Permit for Front Street and Birch Street Rights-of-Way (Attachment A) and authorize the interim city manager to execute the amendment.
BACKGROUND: An Agreement for Revocable Encroachment Permit was executed August 19,
2016 which included a deadline of March 30, 2017 for removal of items from the Front Street right of way. The main purpose for the removals was to facilitate the construction of the Front Street Connector Path, a Trails, Open Space and Parks bond project. However, it was determined during
the course of design and engineering of the path that conflict with an existing storm sewer precludes
construction of the bridge abutments for the path. Phase Two of the Montana Department of
Transportation’s Rouse Avenue reconstruction project includes plans for relocating the storm sewer collection system for the Rouse – Oak intersection, which will eliminate this conflict. As such, the deadline for removal of the encroaching items in the Front Street right of way is recommended to be
extended to March 30, 2018 to allow the Permittee additional time to the rearrangement of stored
materials on the property.
